R1 n\ I (c) The date, place and other circumstances of the occurrence or transaction 2 which gave rise to the claim asserted: 3 On or about the 19P day of May, 2002, claimant Jose Perez Morales was arrested for an 4 outstanding warrant by the City of Antioch Police Department. He was taken into custody as a 5 6 result of that warrant and was held at the City of Antioch Police Department for several hours 7 after which he was transported to the Contra Costa County Jail. At all times herein material, 8 defendant City of Antioch and its police officers were acting for themselves and also as agents 9 for the County of Contra Costa in executing warrants issued by the Contra Costa County 10 Superior Court and for the purpose of transporting claimant to the Custody and care of the 11 12 Contra Costa County Jail system. 13 While claimant was in custody and control of defendant City of Antioch, enroute to the 14 Contra Costa County Jail, the police officer in charge drove the City of Antioch Patrol car in a 15 dangerous manner, at times exceeding 80 Miles Per Hour on Highway 4 while enroute to the 16 County Jail. Claimant was handcuffed in the rear of the patrol car and was not provided with the 17 18 basic protection of fastened seat belt. The police officer lost control of the patrol car at the exit 19 off of Highway 4 and the patrol car collided with the embankment and claimant sustained severe 20 injuries to his person, including but not limited to his back and neck, and possibly his right upper 21 extremity. Claimant was transported to County Hospital where he was examined by a physician 22 who prescribed a course of medical care for claimant. Claimant was thereafter transported to the 23 24 county jail where he was held in custody for several days without proper medical care, and 25 which the County of Contra Costa was aware was necessary for the treatment of claimants 26 injuries. Claimant was unable to procure proper medical care for his injuries, a delay which 27 claimant is informed and believes led to a worsening of his overall medical condition. 28 I (c) Damages claimed from defendants, and each of them as aforesaid, so far as it is 2 known at the time of presentation of the claim are as follows: 3 Claimant has suffered personal injuries and has suffered loss of earnings or loss of 4 earning capacity, incurred medical expenses for treatment of his injuries, and has suffered from 5 6 pain and suffering as a result of those injuries. The total amount of damages, both present and 7 prospective are presently unknown to claimant, but claimant asserts that the total damages will 8 likely be within the Unlimited Jurisdiction of the Superior Court of the State of California. 9 (d) The names of the public employee or employees, so far as is known to claimant at the 10 time of presentation of this claim are outlined in (c) above. Blank said the following; Blank was with a party of seven who left Saturday, 6-29-02 for hiking overnight along the Northfork of the American River. They began their hike at the Palisades Creek traiihead and were returning on today's date. MP-Jeffrey Engleton's dog became injured and he had to carry the dog in his backpack. Blank suggested that he and MP- Dave Marshall take a trail which leads to Soda Springs rd and only three miles,while the rest of the party returns to the Palisades Creek traiihead staging area. Engleton and Marshall split from the rest of the party and were on their way toward Soda Springs rd. At approx. 1600 hrs, Blank and the rest of the party arrived at Palisades Creek traiihead.All parties left for home and Blank drove to the staging area on Soda Springs rd to pickup Engleton i and Marshall. Blank waited until darkness without anyone showing up and decided to report them as being overdue. Blank said Engleton and Marshall had warm clothing and a sleeping bag. I determined that due to darkness and it being a warm night, 1 would wait until morning to began a search. Sgt. Mike Harris was notified of the incident and the PCSO helicopter was scheduled to search the area in the morning. 7-01-02 The Command post was established at the Palisades Creek traiihead and I had phone contact 0700 hrs; ; with Blank who stayed the night at the Soda Springs rd staging area. PCSO helicopter(Eagle 1)arrived and began searching. The SAR Communication van and members of the SAR ground team, mountain rescue team, and 4x4 team were called out. Lt. Rick Armstrong was informed of the incident by phone. 0950 hrs; Engleton and Marshall were located as they came out of the traiihead at Palisades Creek. They appeared tired but said they had no injuries. Engleton related that they were hiking the trail toward Soda Spring rd when they came to a landslide area and couldn't get through. They had to backtrack and come out at the Palisades Creek staging area. However, It was getting late and decided to bed down for the night due to darkness. 1000 hrs; The search was terminated and all SAR volunteers accounted for.Sgt Mike Harris and Lt. Armstrong were notified. I was able to immediately determine the sighting was in fact human remains. Deputies Murchison, Machado, Conners, and Derrick walked to the location from Yankee Jims bridge. The physical description of the location was 336 meters down river from the Iowa Hill bridge on the North pork of the American River. The remains were located under a large boulder(approximately 20 feet in diameter) on the down riverside. The decedent was submerged in approximately 18 inches of water. The decedent was supine with his feet pointed down river (southerly direction). The decedent was in advanced stages of decomposition but intact. There was a log approximately 12 inches in diameter wedged long the decedent's left side along with smaller sticks and rocks. I saw that the decedent was still wearing socks but I was unable to determine if there were any other garments due to the decomposition. We dislodged the debris and pulled the decedent out from under the boulder and moved him approximately 25 feet down river to a small sand bar. We placed the decedent inside three separate body bags and moved him to the other side of the river (river left). Eagle 1 returned to the site and hovered a few feet while I climbed in the helicopter and the deputies lifted the decedent into the helicopter. The department Dive Team members met Markgraf at the 'Yankee Jims bridge at 0900 hours on 08-12-02. I transported Markgraf to the helipad in Colfax where we met with Eagle 1. In September 2000,I applied for employment as a Firefighter with the County of Contra Costa(the County) in response to an announcement published by the County. This announcement detailed"The Selection Process"to be used in determining candidates to be offered employment. The process described was specific and, as described, would result in a precise numerical score and rank to be used in selecting employees for this position. Despite scoring 95.03%and ranking number nine out of over sixteen hundred initial applicants, I was not hired. Over thirty applicants who scored lower and were ranked below myself were hired for this position. The selection process, as described, included a written examination, a physical ability test, and an oral interview. The three parts were scheduled and held on different days, and at different locations over an almost one-year period. This process required hundreds of applicants to travel to the testing sites and often required that they wait for several hours to participate. Upon learning that I had not been selected(June 2002), and that candidates with lower scores had been employed,I requested explanations from various County administrators. I have been supplied with a copy of the County's Personnel Management Regulations, which is referred to in the Job Announcement. However,nothing in these regulations explains, amends, or permits the total disregard of an established ranked hiring list. In June 2002,I contacted the Contra Costa County Fire Protection District Personnel Officer, Web Beadle, in an attempt to obtain an explanation of the District's hiring practices. Mr. beadle informed me that based upon my education and experience, other candidates were deemed to have higher chances for success. I then wrote a letter to Contra Costa County Fire Protection District Fire Chief,Keith Richter, describing my qualifications and requesting further explanation. Chief Richter replied by stating that the results of the second interview panel along with education and experience were the basis for selecting eligible candidates for employment.Note that neither the job announcement nor any personnel regulations describe or discuss the existence or requirement of the second interview panel, which the Chief is now claiming is a critical deciding factor in the hiring process.Note also that according to my personnel file,I satisfactorily passed this second interview panel in all respects.Note also that no quantifiable score is included in any document derived from this interview panel. Finally, note that the position applied for is an entry-level position, and as such,has minimal requirements in education and experience. This is reflected in the job announcement. I do,however,have extensive education and experience directly applicable to the fire service. I have a Bachelor's degree in Biochemistry. I have seven years experience in medical research. I have a California Firefighter I certificate,Driver/Operator 1 All B certificate, and HazMat-First Responder certificate. I have over two thousand hours experience as a volunteer and part time paid Firefighter/Engmeer/EN[TT for Cordelia Fire Protection District. I was ranked number one in my fire academy at Solano Community College. I have letters of recommendation from the Fire Chief and my shift Captain from Cordelia Fire District. Finally,I am a veteran and former Air Force Air Traffic Controller. I find it hard to believe that all of the other candidates hired exceeded my qualifications. I have also been supplied with a copy of the County's Affirmative Action Plan. This plan does not explain the hiring of over twenty other white male applicants with lower score and rank than myself on the hiring list. While the job announcement did include the statement"It is the policy of Contra Costa County not to discriminate because of race, color,national origin, gender, sexual orientation,religion, age, or disability"the County's Affirmative Action Policy and practice are in direct conflict with this statement. The County actively and openly discriminates against white male candidates,giving preferential treatment to women and minorities. This not only contradicts the statement made on the job announcement, it is in violation of California Constitution article I § 31. By shipping over myself and other qualified candidates and hiring applicants with louver scores and ranking,the County not only ignored the terms of its awn job announcement and policies, it also ignored its fiduciary duty to the people of Contra Costa County. The administrators of the County government are entrusted by the people to utilize public resources to increase the safety and general welfare of its citizens. The hiring practices described in this claim give the appearance that County administrators are treating government jobs as their own personal property, to be distributed according to their own whim and will. While vested government employment is typically considered a property interest, it does not belong to government administrators. Bitten, Assistant Director of Human Resources Keith Richter, Chief, Contra Costa Fire Protection.District/Affirmative Action Liaison Web Beadle,Personnel Officer, Contra Costa Fire Protection District Damages incurred from the actions of the County exceed$10,000. Litigation arising from these events will.,therefore, be in the form of an unlimited civil action f€ffling under the jurisdiction of California Superior Court.
