FIXING February 11, 2003 at 9:30 a.m. for a Public Hearing in Room 107 of the Board of Supervisors' Chambers, 551 Pine Street, Martinez, California to certify the tabulation of the ballots submitted for the proposed assessment and re-assessment,and levy the proposed assessment. 3. DIRECT the Public Works Director to mail,by first class mail, a written notice and ballot to each parcel owner within Subdivision 8455 and existing Zone 35 in compliance with Proposition 218. Financial Impact: There will be no financial impact to the County General Fund. All costs will be covered with revenue from the LL-2 Zone 35. III. Reasons for Recommendations and Background: The developer is required by Condition of Approval to install landscaping facilities in the public right-of-way within boundaries of said District and annex to the County's Landscaping District, CWLSD (LL-2) Zone 35 for maintenance and operation of those facilities. Due to the increased maintenance costs involved in maintaining the Pedestrian/Bicycle Trial Easement and the inclusion of additional center median island landscaping,the Board of Supervisors proposes to increase the maximum assessment rate in Zone 35. Proposition 218 provides that any new assessment may not be approved if it is opposed by a majority of the property owners voting on the proposed assessment. The Board Order and Resolution complies with the requirements for new assessments under Proposition 218. IV. Consequences of Negative Action: Funds will not be available to maintain the landscaping and other improvements therefore this project will not be able to proceed. The Board of Supervisors of Contra Costa County FIlNDS THAT: 1. The County is currently processing SD008456, Offer of Dedication for Pedestrian/Bicycle Trail Easement (the"Development")consisting of 1 parcel,more specifically described in Exhibit A. 2. In addition, due to the annexation of the Development's Pedestrian/Bicycle Trail Easement and additional center median island landscaping facilities, the Board of Supervisors proposes to increase the maximum assessment rate in Zone 35 to be effective for FY2003-04. Therefore,the parcels within the existing Zone 35 will need to comply with Proposition 218 with a ballot and notice process. A summary of the current and proposed assessments is attached as Exhibit B. 3. On December 7, 2001 the applicant for the Development submitted a request to the Department of Public Works for inclusion of the Development into Countywide Landscaping District (LL-2) Zone 35 to be effective for FY"2003-04. The County intends to initiate proceedings to annex the Development into Countywide Landscaping District(LL-2)Zone 35 pursuant to that request. 4. Once the Development is annexed into Countywide Landscaping District (LL-2) Zone 35, the parcel(s) within it will receive a Special Benefit over and above that received by the general public in the form of landscape improvements as defined in Section 22503 of the Streets and Highways Code and the Landscaping and Lighting Act of 1472. 5. In order to fund the Extended Services that will be provided to the parcels within the Development, it will be necessary to levy a service charge (the "Assessment"). The service charge meets the requirements of an `°assessment" under Article XMD of the Caiifomia Constitution because it is conferred to provide special benefit,defined above,to the parcels within the Zone. 6. Based upon its review of the Engineer's Report,the Board finds that: (a) The special benefit financed by the Assessment will directly benefit the parcels within the development. Methodolozy for Calculatinz LandscaPW2 Assessments In the event that the proposed assessment is levied, the total amount chargeable to Countywide Landscape District (LL-2) Zone 35 will be $7,199.97 per eligible acre plus CPI. The "benefit received" is based on upon the Equivalent Dwelling Unit (EDU) factor per acre. The landscaping assessment for this Zone is based upon several factors such as (1) cost required to pay the utility bills; (2) the number and types of parcels within this Zone; (3) a reserve fund for administrative and accounting services provided by the County; (4) unforeseen expenses such as utility rate increases, and (5) maintenance including replacement costs of the improvements. The assessment revenue is used to pay for the total costs of operating the Landscape District and those costs are apportioned among the various parcels in the Countywide Landscape District (LL-2) Zone 35. '/0J f ` EXHIBIT C 17 BALLOT NOTICE Why did you receive this Ballot? The passage of Proposition 218 requires a vote on all new assessments that will be used to pay for the cost of constructing, operating, maintaining and servicing public landscaping in the Countywide Landscaping District (LL-2) Zone 35. How Much is the Assessment? The assessment will be $7,199.97 per EDU/acre per year. The total amount levied by the assessment, with regards to this development is approximately$59,183.72 per year. Why should you Vote? Your vote will decide if the assessment will be imposed. Only returned ballots will be counted. Will this Assessment Increase in the.Future? The .Benefit Zone does not intend to increase the assessment, and it cannot be increased without another election. What does the Assessment Fund Allow? The assessment allows the Benefit Zone to provide and maintain landscaping within the public right of way. How was my Assessment Calculated? The total cost to provide and maintain landscaping improvements is allocated to each property based on estimated special benefit received, Essentially, each single family home in the development is allocated the same assessment. An Engineer's Report detailing the method of assessment, budgets and assessments for each parcel is available for review at the Contra Costa County Department of Public Works, 255 Glacier Drive, CA 94553-4897. Method of Voting Only returned ballots or written letters which identify the property and specify the property owners' support or opposition are counted. Mail your ballot in the self addressed postage paid envelop or deliver it in person to the Contra Costa County Public Works Department, 255 Glacier Drive, Martinez, CA 94553 prior to January 13, 2003 or you may hand carry your ballot to the Public Hearing on February 11, 2003. Ballots received after the close of the Public Hearing can not be counted. Ballots are weighted by the amount of assessment that would be paid. If a majority of ballots returned, weighted by their assessment, are opposed to the assessment, the assessment will not be imposed. Ballot Procedures This ballot is for the sole use of the property owner(s) of the parcel(s) identified herein which is located within the Countywide Landscape District (LL-2) Zone 35. The ballot may be used to express either support for or opposition to the proposed Countywide Landscape District (LL-2) Zone 35. In order to be counted, this ballot must be signed and dated in the space provided by an owner or, if the owner is a partnership or a corporation,by an authorized representative of the owner. Those executing this ballot on behalf of a corporation, partnership, trust or other entity must also indicate title or office below the identification of the property owner (e,g., trustee, President, General Partner, etc.) If the property is owned ,Jointly (e.g., common, joint tenants) one or both property owners may sign the ballot. There is only one ballot for each property even though the property may have more than one owner. If both owners of the property vote the same, the ballot counts as one vote. If both owners vote differently, one in support and one opposed, then the votes cancel each other out and the ballot will have a"zero"vote. Public Hearing The hearing will be held on February 11, 2043 at 9:30 a.m. in the Board of Supervisors Chambers, County Administration Building, 651 Pine Street, Martinez, CA 94553. Results of the returned ballots will be announced after the close of the public testimony portion of this meeting. At this hearing, the Board will take final public testimony and take action on whether or not to levy the assessments based upon the testimony and ballots received. Treanor, and DIRECT the Clerk of the Board to post the vacancy. BACKGROUND On August 19, 2002, Walter G. Treanor celebrated his 36th anniversary of service to Contra Costa County and its employees. Mr. Treanor was originally appointed to the Civil Service Commission in 1966 by Supervisor James Moriarty. Mr. Treanor remained on the Civil Service Commission until the establishment of the Merit System in 1981 and has served as the Chairman of the Merit Board since its inception. Chairman Treanor's commitment and passion for his position has been consistent throughout the years. Chairman Treanor was wavering in June of this year as he pondered whether he should seek another reappointment. At the urging of his other Board members and of his own devotion to those he served, he was reappointed. Chairman Treanor was a caring and compassionate man who made everyone who appeared before him feel comfortable and relaxed whether they were an appellant representing themselves, a Union leader or representative, a member of the County Counsel's Office or a Department Head. He was a patient person who was especially sympathetic to appellants who were unfamiliar with the Merit System rules and regulations and did everything he could to guide them through the complicated processes. He was also a great listener. Whether he ruled in favor of the appellant or of the appointing authority, all parties left knowing that they had the opportunity to thoroughly present their case, and more importantly, that their views and opinions were heard. Chairman Treanor was fair and equitable throughout his career which gained him the respect of all whom appeared before him. Walter G. Treanor, a decorated Naval Officer in World War 11, passed away on November 28, 2002 leaving behind two children, four grandchildren, and his wife of 56 years. Contra Costa County has suffered an irreplaceable loss and Chairman Treanor will be missed. Programs for Children and Teens Field Days and Workshops Field Day:Maintenance of Back Country Roads March 26, 8:30 to 3:00, Fern Cottage at EBRPD Kennedy Grove. For directions go to EBRPD Fern Cottage website. The Contra Costa RCD will sponsor a field day focusing on the maintenance of unsurfaced fire and access roads on rangelands and other open spaces. The purpose is to exchange information and share experiences about the best ways to stabilize secondary roads, minimize erosion, and reduce the amount of maintenance required each year. Topics will include grading techniques, outsloping, stream crossings, scraping for firebreaks, culverts, water concentration problems, and when to leave well enough alone. After the presentations, the group will look at examples of back country roads. There is no fee for the field day. Funding for the event is provided in part by the USDA-NRCS. Workshop:Enhanced Grazing for Fire Fuel Management A field day was held on July 17, 2001 at Sugarloaf Ranger Station in Walnut Creek. Ranger Ron White of the Walnut Creek Open Space District has successfully used a dilute application of molasses to focus cattle grazing in areas designated to serve as firebreaks. Compared to discing, grazed firebreaks reduce erosion, prevent gullying, and reduce weed infestations. Contra Costa RCD is working with fire protection experts to define situations where this method of enhanced grazing is effective. For example, a narrow strip of disced land may be combined with a wide adjacent strip of grazed land. Early in 2002, the Contra Costa RCD will publish a brochure about the molasses spray technique, and a second free workshop will be held in the summer of 2002. Landowners and resource managers applauded Joslyn's previous videos on pampas grass and other invasive species and CCRCD is pleased to have had a role in creating this new production. Funding for the video was provided by an EQIP Educational grant from MRCS as well as donations from California Department of Food and Agriculture, California Department of Parks and Recreation, Dow Elanco, and the California Native Plant Society. There are two versions of the video. The 26-minute version of the video covers yellow starthistle's history, biology, and several control methods, and is suitable for a general audience. For those who want more information, the 50-minute version has additional interviews with California's leading experts on yellow starthistle and delves into the broader issue of the threat of invasive species to California's biodiversity. Local Weather Data Available Online from the CIMS Network Farmers, golf courses, and landscape maintenance professionals can fine-tune irrigation to local weather conditions using weather data online. The Contra Costa RCD maintains a weather station in Brentwood that is part of the CA Department of Water Resources' CIMIS network. Other Contra Costa agencies maintain weather stations in Walnut Creek and Concord. You can view and download data for these stations, and stations state-wide, at the CIMIS website. Programs for Children and Teens Elkus Ranch Range and Natural Resources Camp Contra Costa RCD offers scholarships to high school students to attend the annual Range and Natural Resources Camp at Elkus Ranch near Half Moon Bay in June. Students spend a week sleeping in tent cabins and teaming about ecology and practical land management skills such as plant identification, livestock management, wildfire, fire, and range analysis and improvement. if you know a student that may be interested in applying for this year's range camp, please contact the Contra Costa RCD. CARCD Speech Contest High school students, grades 9-12, are invited to compete in the California Association of Resource Conservation Districts' annual speech contest.
