SUBJECT: ACCEPT the Agreement and Grant of Easement from the State of California, acting by and
through the 23' District Agricultural Association, for property rights in connection with the
"L" Street Reconstruction at the Fairgrounds Project, Antioch area. CP# 97-10

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. ACCEPT the Agreement and Grant of Easement dated October 16, 2001 from the State of
California, acting by and through the 23rd District Agricultural Association.
B. AUTHORIZE the Chair of the Board of Supervisors to execute the Agreement and Grant of
Easement on behalf of the County.
C. DIRECT the Real Property Division to have the above-referenced Agreement and Grant of
Easement recorded in the Office of the County Recorder.
II. Financial lmpact: None
III. Reasons for Recommendations and Background:
These property rights are required for the "L" Street Reconstruction at the Fairgrounds Project in
accordance with the approved plans and specifications. CEQA was previously approved by the
Board of Supervisors on April 1, 1997.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

THIS AGREEMENT AND GRANT OF EASEMENT is made and entered into by and between the STATE OF
CALIFORNIA, acting by and through the 23`d District Agricultural Association hereinafter called State, and CONTRA
COSTA COUNTY, a political subdivision of the State of California, hereinafter called Grantee.
State, pursuant to the provisions of Section 4051 of the Food and Agricultural Code of the State of California, hereby
grants unto Grantee, its successors and assigns forever, an easement to locate, relocate, construct, reconstruct, alter,
use, maintain, inspect, repair and remove an underground traffic loop detector deemed necessary therefor by Grantee,
over, on, under and across that certain real property situated in the City of Antioch, County of Contra Costa, State of
California, as described in the attached.Exhibit"A", consisting of one page, and by this reference made parts hereof.
THE PROVISIONS ON THE REVERSE SIDE HEREOF CONSTITUTE A PART OF THIS AGREEMENT.

Real property situated in the City of Antioch, County of contra Costa, State of California, being a
portion of that parcel of land as shown on the Land Surveyors Map, filed July 18, 1947, in Book II
of LSM at page 49 records of said County, described as follows:
Commencing at the southerly terminus of the course North 1671.61 feet being on the westerly
right-of-way line of County Road("L" street City of Antioch) as shown on said Land Surveyors Map
(II LSM 49); thence south 03°53'00" west 226.86 feet to the Point of Beginning; thence from said
Point of Beginning leaving said line north 86007'00" west 50.00 feet; thence south 03°53'00" west
50.00 feet; thence south 86007'00" east 48.75 feet to the westerly right-of-way line of "L" Street;
thence along said right of way line north 12°56'00" east 7.96 feet and north 03053'00" east 42.13
feet to the Point of Beginning.
Containing an area of 2,496 square feet of land, more or less.
