SUBJECT: Approve Project Contingency Fund Increase and Contract Change Order No. 4 for the
2001 RAC Overlays - Federally Funded project, Project No. 0662-6R4243-01, Central,
South, and East County areas.

I. Recommended Action:
APPROVE project contingency fund increase of$300,000 fora new total of$559,325 and Contract
Change Order No. 4 in the approximate amount of$435,738 in order to compensate the contractor,
Top Grade Construction, Inc. for existing item increases.
II. Financiallmpact:
The project contingency funds are currently insufficient to cover the increased cost. The increase
in contingency funds will be funded by the Transportation Equity ct(8 . o)and Measure C Funds
(11.5%).

III. Reasons for Recommendations and Background:
Additional funding is needed to pay the contractor for increases in contract work. The work
included additional pavement and base failure repair on Pacheco Road (Site 2) between N.
Buchanan Circle and Center Avenue; on Treat Boulevard (Site 3) between Jones Road and Walnut
Creek Channel and on Willow Pass Road (Site 4) between Clearland Drive and Highway Avenue.
The additional pavement and base distress occurred through winter between the time the plans
were designed and the time construction began.
This change exceeds the project contingency fund and approval of the project contingency fund
increase is required to compensate the contactor for the increase in contract item work.
IV. Consequences of Negative Action:
The lack of approval would prevent successful completion of this contract and preclude payment to
the contractor for required work.
