SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Approve and authorize the Health Services Director, or his designee (Donna Wigand) , to execute on behalf of the County as follows : 1 . Cancellation Agreement #74-099-2 with John Dawdy, Esq. , effective on the close of business on June 30 , 2001 ; and 2 . Contract #74-099-3 with John Dawdy, Esq. , for the period from July 1, 2001 through June 30 , 2002 , in an amount not to exceed $66 , 000 , for Certification Review/Probable Cause/Capacity Hearing Officer for patients involuntarily confined by County. FISCAL IMPACT• This Contract is 100% funded by Mental Health Realignment . BACKGROUND/REASON(S) FOR RECOMMENDATION(S) : In February 2001 , the County Administrator approved and the Purchasing Services Manager executed Contract #74-099 (as amended by Contract Amendment Agreement #74-099-1) with John Dawdy, Esq. , for the period from January 1, 2001 through December 31, 2001 , for Certification Review/Probable Cause/Capacity Hearing Officer for patients involuntarily confined by County. Due to an unanticipated increase in the volume of hearings the hourly rate being paid to Contractor was no longer cost effective, therefore the Contract Payment Provisions where renegotiated, effective July 1 , 2001 . In accordance with General Conditions Paragraph 5 . (Termination) of Contract #74-099 (as amended by Contract Amendment Agreement #74-099-1) , the Department and Contractor have agreed to a mutual cancellation. Approval of Contract 474-099-3 will accurately reflect the oral agreement between the parties and allow the Contractor to provide services in accordance with the negotiated monthly rate . Approval of Cancellation Agreement #74-099-2 will terminate the prior Contract and approval of Contract #74-099-3 will allow the Contractor to continue providing hearing officer services to County' s confined patients, through June 30 , 2002 . Wigand, LCSW, Mental Health Director SUBJECT: Approval of Retroactive Contract with John Dawdy, Esq., for Hearing Officer Services for Psychiatric Hospitals in Contra Costa County STATEMENT OF NEED FOR RETROACTIVE CONTRACT: Effective January 1, 2001, we contracted with an approved panel of three attorneys to provide hearing officer services for consumers involuntarily confined in psychiatric hospitals in Contra Costa County. Certification review, probable cause and capacity I earings are required by State law. Both CCRMC and Mt. Diablo hospitals selected John Dawdy from the approved panel of attorneys to be their hearing officer. The payment provision in the initial contract for the first six months of 2001, was for $60.00 per hearing. In analyzing the first six months of payment demands for hearings performed at both hospitals, we reali.4ed the volume of hearings was greater than anticipated, as Mr. Dawdy's payment demands were averaging $7,000- $9,000/month. Therefore, we negotiated a more reasonable and cost effective payment provision. The new payment provision is for a flat all- inclusive rate of$5,500/per month for all hearings conducted for the contract period July 1, 2001 - June 30, 2002. The initial contract with Mr. Dawdy was mutually terminated, and this new one initiated, beginning July 1, 2001. BENEFIT TO CONTRA COSTA COUNTY: Hearing officer services will continue to be provided on a cost-effective basis for our consumers involuntarily confined on inpatient units.
