AUTHORIZE the Fire Chief, Contra Costa County Fire Protection District, as the Acting Fire Chief of the East Diablo Fire Protection District, to execute the amendment to the fire station agreement. 2. APPROVE related appropriation and revenue adjustments, copies attached. FISCAL IMPACT: The cost to the District is a maximum of $226,400.00 ($206,400.00 is the estimated cost of the additional 940 square feet the District is responsible for plus a $20,000.00 contingency). This amount will be funded out of the District's Developer Fee Special Revenue Fund Dept/Org No. 7027. BACKGROUND/REASONS FOR RECOMMENDATION: The County approved the Discovery Bay West project in 1994 for the development of 1,759 residential units. On December 5, 1997, the final development plan (County File #DP913025) and Vesting Tentative Map (County File #SD917686) was amended for the project. Condition of approval #34 requires the developer to "negotiate to design, construct and equip a fire station for service to the project area as required by the East Diablo Fire District or its representatives." The Board of Supervisors approved the fire station agreement on March 7, 2000, and an amendment to the agreement on March 13, 2001, involving the relocation of the fire station to a better site along with a change requiring the developer to commence construction of the fire station prior to issuance of the 200th rather than 117th building permit for the project. Hoffman Company East Diablo FPD BY DEPUTY CAO, Rich Seithel • October 16, 2001 Amendment to the Agreement to Provide Fire Station for Discovery Bay West in the East Diablo Fire Protection District to Add Approximately 940 Square Feet to Building Plan Page 2 This amendment will add approximately 940 square feet to the current floor plan, approximately 4800-5000 square feet, resulting in a new floor plan of approximately 5740-5940 square feet. The additional square footage will provide an employee training area, space for program needs, storage and multi-purpose area, room for future emergency services needs, and possible administrative space. This new floor plan incorporating the added square footage will mirror the standard floor plan design for new stations in the Contra Costa County Fire Protection District. Pursuant to the fire station agreement, the Hofmann Land Development Company (the developer) is responsible for constructing and equipping a fire station at the developer's expense in accordance with East Diablo Fire Protection District's specifications. However, the cost of the additional square footage -- estimated at $206,400.00 -- is the District's responsibility. In summary, Hofmann is responsible for the following related costs in addition to the construction costs of the fire station as follows: • Type 1 Fire Engine $ 297,175.00 • Fire Engine Equipment 70,362.00 • Fire Station Equipment 46,925.00 Total $ 414,462.00 Taking a credit for the $206,400.00 the District owes Hofmann for the additional square footage, Hofmann owes the District $208,062.00 ($414,462.00- $206,400.00). In light of the credit, the District plans to fund its maximum cost of $226,400.00 ($206,400.00 estimated cost plus a $20,000.00 contingency) out of its Developer Fee Special Revenue Fund. The Hofmann Land Development Company is in agreement with this amendment providing for the added square footage. (M 8134 Rev. 2/86) DRAFT SECOND AMENDMENT TO AGREEMENT TO PROVIDE 6 . 0 FIRE STATION FOR DISCOVERY BAY WEST This Amendment to the Agreement dated March 7, 2000, to provide a Fire Station for Discovery Bay West ("Agreement") is entered into on this day of , 2001, by and between Hofmann Land Development Company, a California corporation (formerly known as Talisman Realty Group, Inc.) (hereinafter referred to as "Developer") and the County of Contra Costa (hereinafter referred to as "County") and the East Diablo Fire Protection District (hereinafter referred to as "District"). Paragraph 4. of the Agreement, Construction Plans, is amended to add approximately 940 square feet to the current floor plan (approximately 4800-5000 square feet), so that paragraph 4. reads as follows: "Developer shall design and construct the Fire Station in substantial accordance with the plans provided by Jerry Loving Architects previously used for other Fire Stations in Contra Costa County and using the same level of construction.standards used for these fire stations, a modified floor plan of which is attached hereto as Exhibit "B" (approximately 4800-5000 square feet). This modified floor plan is further modified to add approximately 940 square feet, resulting in a new floor plan which is attached hereto as Exhibit "131" (approximately 5740- 5940 square feet). The plans for the Fire Station shall be subject to review and approval by East Diablo Fire Protection District ("District") prior to commencement by Developer of any construction activities for the Fire Station. Pursuant to paragraph 7., Costs of Development and Construction of Fire Station, the site preparation and the design, construction and equipping of the Fire Station shall be at the sole expense of the Developer. However, the District is responsible for additional costs associated with added 940 square feet since the District requested revisions to the final plans. The additional costs are estimated at $206,400.00. Also, pursuant to paragraph 5., Developer to Provide Fire Engine, the Developer shall pay for the purchase of a new Type 1 fire engine. In summary, the Developer is responsible for the following related costs in addition to the construction costs of the Fire Station (except for additional costs associated with added 940 square feet) as follows: • Type 1 Fire Engine $ 297,175.00 • Fire Engine Equipment 70,362.00 • Fire Station Equipment 46,925.00 Total $ 414,462.00 Taking a credit for the $206,400.00 the District owes the Developer for the additional 940 square feet, the Developer owes the District $208,062.00 ($414,462.00 - $206,400.00). If the actual costs for the additional square footage are less than $206,400.00, the Developer will pay the difference to the District. A'mendinent to Fire Station Agreement. Date If the actual costs for the additional square footage are more than $206,400.00, the District will pay the difference to the Developer not to exceed $20,000.00, provided the Developer provides documentation supporting the additional costs to the District for review and the District approves said costs." All other terms and conditions as stated in the Agreement, a copy of which is attached hereto and incorporated herein by reference, shall remain in full force and effect.
