In order to protect the public health,
1 . CONSIDER a recommendation to assess, analyze and evaluate the
County' s preparedness to respond to acts of terrorism and
bio-terrorism.
2 . REFER this request to Supervisor Gerber as chair of the Joint
Conference Committee (Hospital) and Sheriff Rupf with
responsibility for the Office of Emergency Services .
Supervisor Gerber and Sheriff Rupf will fulfill a co-chair
role in coordinating the assessment/evaluation and report
back to the Board.
3 . REQUEST that Supervisor Gerber and Sheriff Rupf involve and
coordinate appropriate parties including, but not limited to,
CAO, Fire Chief, Health Services Director, Public Health
Director, EMS Director, Environmental Health Director, and
Hospital Administrator.
4 . REQUIRE a report to the Board of Supervisors . Said report to
outline what the County currently has in place both to
protect our staff as they carry out their duties and to
protect the citizens we serve. The report should also
identify, if applicable, recommended additions .

BACKGROUND:
Contra Costa County has done more planning and preparing for
disaster response than many jurisdictions in California due to the
probability of earthquake and the extensive industrial facilities
along the waterfront, including refineries .
For example, in February 2001, Contra Costa County was awarded
$300, 000 in grant funds to participate and improve emergency
response as part of a planning strategy to deal with hazardous
materials incidents . (See attached news article) There are and have
been disaster drills and other planning exercises .
However, given the heightened awareness of the need for disaster
preparation following the events of September 11th, and the
national discussion of the potential of bio/chemical
Terrorism, many employees and residents are inquiring about these
matters .
Being prepared and taking a leadership role relative to disasters
that threaten the public health is one of the major roles of
county government . While both Federal and State agencies will be
involved in these issues at their level, an incident will require
a local response from emergency first responders in fire, police,
and health services .
Therefore, it is appropriate and timely that the County complete a
comprehensive, multi-level assessment and evaluation. In
addition, it provides an opportunity to reassure staff, citizens
and other agencies that there are plans and contingencies in place
of which they may not be aware. For example, it would be the new
Laboratory at the Contra Costa Regional Medical Center that would
do the tests to detect whether a biohazard is involved in a
specific incident . This laboratory is a state of the art facility
with the necessary equipment and staff expertise to respond. This
is just one of many resources that the County provides to protect
employees and the public .
But if there is more that we can and should do, now would be the
time to make that determination.
There are on-going efforts in many departments and agencies; this
recommendation is intended to pull the information together,
evaluate it, and present it to the Board and public and to
recommend any identified improvements for the Board' s
consideration.
FISCAL IMPACT: Not anticipated to be beyond the cost of County
staff time already budgeted.

On this date, the board considered a recommendation assess, analyze and evaluate the County's preparedness
to respond to acts of terrorism and bioterrorism.
The Board discussed the matter.
The Chair invited comment from the public. There were no requests to speak on this item.
After further discussion, the Board took the following actions:
1. REFERRED this request to the County Administrator, as the Chair of the Emergency Services Policy
Board;
2. REQUESTED that the County Administrator involve and coordinate appropriate parties including,
but not limited to, CAO, Fire Chief, Health Services Director, Public Health Director, EMS Director,

RESOLUTION OF THE BOARD OF SUPERVISORS OF
CONTRA COSTA COUNTY APPROVING A FINANCING TO
BE UNDERTAKEN BY THE CALIFORNIA STATEWIDE
COMMUNITIES DEVELOPMENT AUTHORITY TO BENEFIT
SEVEN HILLS SCHOOL
WHEREAS, Seven Hills School (the "School") has requested that California Statewide
Communities Development Authority (the "Authority") participate in a financing for the purpose of
financing the acquisition, construction, renovation and reconstruction of certain educational facilities
(the "Facilities") located within the County of Contra Costa(the "County"); and
WHEREAS, the Authority will issue its revenue bonds (the 'Bonds"), in an aggregate
principal amount not to exceed $7,000,000, in connection with the financing; and
WHEREAS, the Authority and the School will enter into a loan agreement (the "Loan
Agreement") under which the Authority will loan the proceeds of the Bonds to the School and the
School will use such moneys for the purpose of financing the costs of acquisition, construction,
renovation and reconstruction of educational facilities; and
WHEREAS, pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended
(the "Code"), the issuance of the Bonds must be approved by the County because the Facilities are
located within the territorial limits of the County; and
WHEREAS, the Board of Supervisors of the County (the 'Board of Supervisors ") is the
elected legislative body of the County and is the applicable elected representative required to approve
the issuance of the Bonds under Section 147(f) of the Code;
WHEREAS, the School and the Authority have requested that the County approve the
issuance of the Bonds in order to satisfy the public approval requirements of the Code, and to satisfy
the requirements of Section 147(f) of the Code and the requirements of Section 9 of the Amended
and Restated Joint Exercise of Powers Agreement (the "Agreement"), dated as of June 1, 1988,
among certain local agencies, including the County; and
WHEREAS, pursuant to Section 147(f) of the Code, the Board of Supervisors has, following
notice duly given, held a public hearing regarding the Financing and the execution and delivery of
the Loan Agreement, and now desires to approve the Financing and the execution and delivery of the
Loan Agreement;and
WHEREAS, the Board of Supervisors understands that its actions in holding this Public
Hearing and in approving this Resolution do not obligate the County in any manner for payment of
the principal, interest, fees or any other costs associated with the issuance of these bonds, and said
Board of Supervisors expressly conditions its approval of this Resolution on that understanding.
NOW, THEREFORE, 13E IT RESOLVED, by the Board of Supervisors of the County of
Contra Costa, as follows:
Section 1. The Board of Supervisors hereby approves the issuance of Bonds for
purposes of Section 147(f) of the Code and Section 9 of the Agreement.

Section 2. The officers of the Board of Supervisors are hereby authorized and directed,
jointly and severally, to do any and all things and execute and deliver any and all documents,
certificates and other instruments which they may deem necessary or advisable in order to
consummate the issuance, sale and delivery of the Bonds by the Authority, and to execute and deliver
such certificates and other documents they may deem appropriate and otherwise to carry out, give
effect to and comply with the terms and intent of this Resolution. Any actions heretofore taken by .
such officers are hereby ratified and approved.
Section 3. The Board expressly conditions its approval of this Resolution on its
understanding that the County of Contra Costa shall have no obligation whatsoever to pay any
principal, interest, fees or any other costs associated with the Authority's issuance of these private
activity bonds for the construction of improvements at Seven.Hills School in Contra Costa County.
Section 4. This Resolution shall take effect from and after its passage and approval.

school and a qualified 501(c)(3)organization.

The Seven Hills School, established in 1962, is a not-for-profit, independent,
coeducational day school for children from pre-school through eighth grade. The campus
is located on 9.5 acres in suburban Walnut Creek. With it fully enrolled student body of
370 students, the school strives to be an economically and ethnically diverse community.
Approximately 19.5% of the student body represents students of color and approximately
10% of the students receive tuition assistance.
The school property, formerly the Seven Hills Ranch, was purchased in 1966 and is
situated in an unincorporated area of Walnut Creek. The campus consists of II
buildings; outdoor play areas including a tennis court, swimming pool, a lower field,
climbing structures, and two outdoor eating areas; a gymnasium and technology center.
The school attracts students from a wide area of central Contra Costa County.
The school is embarking on a master plan project which includes the renovation of
several buildings, construction of certain new structures and rehabilitating the play areas
and entrance ways. The Seven Hills School is filing an application for Conduit Financing
from the California Statewide Communities Development Authority in order to complete
its tax-exempt financing for the project.
The Seven Hills School provides many public benefits to the community it serves directly
and indirectly. The School provides over 5% of tuition revenue as financial aid,totaling
approximately $200,000 in the current school year.
Seven Hills does not discriminate on the basis of"age, color, creed, disability, gender,

financial aid, and other school-administered programs. Seven Hills's goals of excellence

Seven Idills's students come from economically. culturally and geographically diverse
backgrounds. In a region known for its transience, the school is a strong community that
serves as an anchor for curmat and alumni families.
C. SOVRCEs AND USES olF Fuxns: Attached is a summary of the Sources and Uses of
Funds for the financing. The Seven Hills School will be providing funds to reimburse
certain costs of issuance expenditures above the allowable 2% limit for nonprofit
corporations.
D. FINANCING DESCRIFFION: The Seven Hills School will be issuing Fixed Rate Non-
Rated Tax-Exempt Revenue Bonds. Final maturity is scheduled to be in the year 2031
with debt amortization creating level bond payments for the life of the financing (with
several years of interest only payments initially) . The financing will provide a bond
-reserve account equal to one year's maxum debt service payment. The interest rate
will be negotiated with the buyer(s) and debt service payments will be made on a semi-
annual basis_ The structure will provide approximately $5.0 million of construction
proceeds upon delivery of the bonds.
E. SECURrTY DESCRIPTION: The security for the bonds will be a pledge of Gross
Revenues from operations of the School as well as the land aid building (real estate) of
the school campus.
