Glover Costa DATE: October 9, 2001 C , O u n t r SUBJECT: AUTHORIZE THE NEGOTIATION OF A JOINT /�• •/ POWERS AGREEMENT WITH THE CITIES OF ANTIOCH, BRENTWOOD, AND OAKLEY TO CREATE A NEW JOINT POWERS AGENCY FOR THE PURPOSE OF FUNDING EXPANDED REGIONAL TRANSPORTATION PROJECTS IN EASTERN CONTRA COSTA COUNTY SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: AUTHORIZE the negotiation of a joint powers agreement with the cities of Antioch, Brentwood and Oakley to create a new joint powers agency for the purpose of funding expanded regional transportation projects in Eastern Contra Costa County. FISCAL IMPACT There will be no financial impact to the general fund. Revenue generated is from dedicated fees imposed on building permits for new uses. BACKGROUND: The East Contra Costa Regional Fee and Financing Authority ("ECCRFFA") was established by the East Contra Costa Regional Fee and Financing Authority Joint Exercise of Powers Agreement dated August 9, 1994. Presently, the following agencies are members of the ECCRFFA: the cities of Antioch, Brentwood, Oakley, and Pittsburg, and the County of Contra Costa. Currently, the ECCRFFA provides funding assistance to the following projects: • State Route 4 East from Bailey Road to the State Route 4 Bypass; • State Route 4 Bypass from State Route 4/State Route 160 to Vasco Road, including Marsh Creek; and • Buchanan Road Bypass. Page 2 of 2 The Board of Directors of the ECCRFFA has determined that there is a significant funding and project shortfall in the regional transportation fee program and that an increase in fees is needed. The Authority undertook a nexus study to determine both the regional projects necessary to facilitate the future transportation system needs and the level of funding required to support the expanded program. The nexus study identified the following expanded "Significant Regional Projects" and "Important Regional Projects": Significant Regional Projects • Laurel Road extension to State Route 4 Bypass; • Byron Airport Road between Vasco Road and Byron Highway; • Vasco Road safety and operational improvements; • State Route 239, Brentwood to Tracy: study, design and right of way protection; and • State Route 4/Main Street Improvements, Lone Tree Way to West of Vintage Parkway. Important Regional Projects • Northern Parallel Arterial Group in the City of Antioch and in Bay Point, which includes Delta Fair Boulevard, Buchanan Road, Fitzuren Road, and West Tregallas Road; • Southern Parallel Arterial Group within the City of Antioch, which includes Delta Fair Boulevard, Buchanan Road, Fitzuren Road, and West Tregallas Road; • Byron Highway Improvements; • Commuter Transit. The Authority's nexus study determined that the level of fees for each new building permit must be increased to the following levels in order to fund these expanded projects: Single Family Residential Unit $7,500/dwelling unit Multiple Family Residential Unit $4,600/dwelling unit Non-residential uses $1.00/sq.ft. Non-standard uses $7,500/peak hour trip The current fee is approximately $5,000 in the cities of Oakley, Brentwood and Antioch, as well as most of the unincorporated East County. Pittsburg and Bay Point now pay approximately $1,200. The non-residential uses have fees ranging from $.30 to $.60 per square foot. Under the terms of the ECCRFFA, a fee increase requires the unanimous approval of all members. The City of Pittsburg has indicated that it does not wish to participate in a fee increase at this time. As such, the representatives to the Authority from the County and from the cities of Antioch, Brentwood and Oakley, have determined that a second joint powers agency should be formed for the purpose of funding the expanded transportation projects described above. The Board's action today does not create the new joint powers agency, nor does it establish a new level of fees. This action is only to authorize the County's representative to the Authority to negotiate a new joint powers agreement for the purposes stated herein, which will be brought back to the Board for consideration at a later date. CONSEQUENCES OF NEGATIVE ACTION Failure to authorize the negotiation of a new joint powers agreement will leave the existing program intact, but will not increase the scope of projects or speed project delivery.
