I was shopping at Albertson's in EI Cerrito and came across a broken table in the refuse at the market. I decided to get it, fix it and use it in the temple's wash house. Officer R. De La Lampa Badge 55 stopped me and told me to put it back. I did... Checking my vehicle he discovered that I was not registered. I promptly told him why I did not register it. (copies inclosed..) Officer Lampa Badge 55 ignored all my stickers on my van and also ignored my Declared Status of a National. Officer Lampa Badge 55 completely ignored the law of the United States of freedom. Under the Vehicle Code.., you are only subject to registration, citation or violation if you are a in a Commercial Enterprise. Private Citizens who fully own their vehicles with no loans or leans attached to them are not in the commercial jurisdiction and are not subject to the municipality. By taking my van from me which was my lively hood Officer Lampa is guilty of Theft from a private Citizen Exercising his Constitutional Rights under the United States Code. This officer further violated my rights by calling Seidells Towing Company 645 South 32nd in Richmond to "take by force" with out due process or a court order MY private property {my van} on the spot. Registration is not mandatory under the laws of this country. The constitution is the supreme law of the land. Doug Hun is also liable the Towing companies Garage Principle. Dean Kriens Statement of how damages occurred—November 14, 2000 On November 14, 2000, at approximately 6:45 p.m., I was driving south on Dougherty Road, south of Crow Canyon Road. It was dark and due to the heavy commuter traffic, I was driving with my headlights dimmed. After leaving the divided road area, Dougherty Road changes into a very narrow, dark, curving section of road as one approaches North Gale Ranch Road and Bollinger Canyon Road. There are no street lights in this area. The road becomes two way with double painted lines down the middle. The speed limit is 35 mph and I was driving well within the limit. There were no vehicles in front of me for perhaps 1000 feet. As one approaches this intersection,the attached photo exhibits show the nature of the road, the rural setting and the lack of appropriate and required signs which one expects to find, and does .find, on most similar streets. The negligence of Contra Costa County in providing proper warning signs and the absence of danger signs caused my auto to strike the gore(point of the road divider) with my right front wheel. This resulted in extensive damage to my automobile as described on the repair order. Sufficient advance notice and use of signs, examples which I have provided herein, would have made this a safe intersection. I know of one other person who had this same after dark experience as I at this intersection. She also damaged the steering mechanism of her auto. LJn,rii.. 41n C•1C INYO COUNTY SHERIFF'S DEPARTMENT = • ADDITIONAL NARRATNE 00-1x037 On 10-09-2000, at approximately 1115 hours, two off duty Inyo County Search and Rescue Volunteers, Dean Chavez, who is an EMT and Robert Lane, were recreationally hiking to the summit of Mt. Whitney. They were on the trail Crest near Keeler Needle, when a hiker walking down the trail passed Chavez. Before the hiker reached Lane, he lost his balance and fell off the trail. Chavez and Lane estimated the fall to be about 20 feet. The hiker, Arnold Faerber sustained head injuries and a possible broken arm. Chavez called the Sheriffs Dept. requesting a helicopter to fly Faerber out. U.S. Forest Service helicopter 525 was requested to extract Faerber. The weather condition was unstable with winds reaching an estimated 30 M.P.H. The location Faerber was at did not allow the helicopter to land. Along line from the helicopter to a litter was used to lift Faerber and carry him to the Lone Pine Airport. Faerber was transported by ambulance to Southern Inyo Hospital. COST MANPOWER: Cpl. As stated in the attached claim, claimant's cause of action occurred on 15 or about June 15, 2000. 16 2. The time for presentation of such claim under Government Code § 911 .2 17 expired on or about December 15, 2000. 18 3. The reason for failure to present such time within the time provided in 19 Government Code§ 911 .2 was as follows: 20 From June 15, 2000, the day of the incident to the present, Lianette Hollie has 21 been incarcerated in Valley Sate Prison in Chowchilla, California. Therefore, she has 22 been unable to assist counsel in determining the exact date of the accident and the 23 facts and circumstances of the accident. Additionally, on two separate occasions 24 plaintiff's counsel has written to the County of Contra Costa asking for an incident 25 report verifying the accident Ms. Hollies claims occurred on June 15, 2000 during her 26 transportation to the West County Detention Center. - 1 - 4nnlinntinn Fnr Pcrmiccinn Tn Pracont A I atn (Maim 1 Said claim was not timely filed because of mistake inadvertence and excusable 2 neglect since it was unclear as to whether or not counsel had been retained by Ms. 3 Hollie who was incarcerated in Valley State Prison throughout this period of time. 4 Both telephone contact and mail contact confirming this representation was difficult 5 if not impossible throughout this period of time. When counsel learned that Ms. Hollie 6 was still under the impression that she was to be represented by counsel, this claim 7 was immediately filed. Because of the uncertainty at the time of the initial contact 8 with Ms. Hollie and because no incident report was received from the Contra Costa 9 County Sheriff's Department confirming this accident, counsel inadvertently failed to 10 calendar the six (6) month claim statute. 11 Additionally, Ms. Hollie's incarceration effectively prevented her from securing 12 counsel and affirming that she had counsel, thus this claim should be allowed because 13 of her mistake inadvertence and/or excusable neglect. 14 More importantly, the County of Contra Costa has not been prejudiced by this 15 one month delay in asserting a claim for a bus accident which occurred on or about 16 June 15, 2000. Since no incident report has been forwarded to Ms. Hollie or counsel, 17 only the county is aware of the witnesses to the accident and only the county is in 18 possession of records relating to liability. Martinez or another employee of Contra Costa County. The transport bus was traveling in the vicinity of 37"' and McDonald in Richmond on its way to the West County Detention Facility. As the bus was traveling a violent collision occurred. The violent impact threw Ms. Hollie through the bus and onto the floor. Claim Against Contra C* County Claimant: Lianette Hollie January 10, 2001 Page 2 Claimant is informed and believes, and thereupon alleges, that the County of Contra Costa and their employees were negligent in the maintenance, operation, and use of said Bus. Said public entity negligently hired and trained its employees in the maintenance, use and operation of the bus which caused or was a cause of the injuries and damages sustained by plaintiff. Claimant is still investigating the nature and extent of this accident and when additional information regarding defendants' acts and/or omissions is known, claimant will amend this Claim accordingly. As a proximate result of the actions and/or omissions of the County of Contra Costa and their employees, Lianette Hollie sustained injuries and damages which continue to today.
