Pedestrians must walk behind a guardrail to get out of traffic. Now that the rain has started,they must walk in mud to get out of traffic. This section has a slight grade and pedestrians are not totally visible to drivers. Fire - This section has many oak trees that are dropping their leaves. On 12/30/99 under the same conditions there was a fire. Response# 099006497. Erosion- Erosion has exposed the roots of the oak trees. While other cities and communities are taking great care of the environment, the County has not taken any steps to save the native oak trees or the environment. As you can see in my pictures, the trees are in danger of falling and the rain continues to erode the dirt shoulder. The problem is the gross violations of 3 ton load limit of vehicles in our subdivision and limited cooperation from the Highway Patrol to cite individuals that are in violation of this load limit law. The law was passed by Board of Supervisors of Contra Costa County Resolution 3311 of 9 May 1989. The law was passed to protect our streets Which are not designed to. handle excessive loads. To date to our knowledge one citation was given on 11 October 2001. We are aware of 40 violations as of 25 November 2001 since S & P Towing started appearing in Viewpointe on 29 September 2001. The latest violation on 25 November 2001 is S & P < Towing, license member 6R08653 from 903 Sandy Cove, parked along ball park on 900 block of Coral Drive between 12:11 am through 9:20 am. Citizens of Viewpointe have much invested in our homes and neighborhood and when problems occur we expect, services we pay for through our property taxes, are provided. As an elected official, your constituents expect you to provide recognition and/or suggested resolution to our problems. To date we have received no response to our suggestions of I October 2001 and 5 November 2001 letters. In conversation with Sargent Meyers of CHP he readily admits he does not have the resources to enforce traffic problems throughout the county. This is evident also in various incidence of"road rage" experienced this past summer in Viewpointe by speeding youths-problem will not revert to County until someone dies. Sargent Meyers cannot be readily reached during weekdays, he is in the field 90% of day and CHP is not available to public at all on weekends. What adds to confusion is how the responsibilities have been divided. The Sheriff is responsible for citing and towing abandoned vehicles, the County Public Works department is responsible for road maintenance and yet the CHP (a state agency) is responsible for enforcement of"road rage" and traffic violations. This problem could easily be solved if the Highway Patrol would do their job. If the violators were ticketed and fined they would soon realize that it is to costly to continue violating the load limit law. Please respond on how you intend to assist your Viewpointe constituents in resolution of this ongoing problem. We specifically want response to resolution of Items I and 2 in letter dated 5 November 2001. This problem will be specifically addressed at the RMAC meeting at 7:00 PM 28 November 2001 at the Rodeo Senior Center. We welcome a written response to our letter and recommended solutions, Items I and 2 our letter of 5 November 2001 to this ongoing problem. What is violation fine and has your office asked the Sheriff if he can do this job more expeditiously than the CHP?I want to reiterate that on 5 November 2001, Tyrone of Code Enforcement dismissed investigation of cases RF010794/Rf 010793. This astounds us based on evidence of violations with loads presented to the county on multiple occasions. I have been working with the Highway Patrol of 5001 Blum Road, Pacheco, to get a handle on gross violations of load limits within our subdivision. County o rs passed a traffic resolution 3311, pursuant to S 5701 CVC limiting gross vehicle weight mmercia rucks to 6000 pounds . A number of diesel tractors, 900 of which appear to be owner operators, have been observed parked on the street and in driveways of residence. Typical GVW observed and confirmed via trace by CHP of weight fees paid are in the range of 15, 000 pounds and one I estimate at 22, 000 pounds GVW. I have photographs of ten consistent violators and have witnessed six other violators, so problem is not limited to a few people . The infrastructure is suffering the consequences . Damage to the road surface, damage to Highway 80 overpass, and road surface at California Street has been noted and I will be addressing that to county code enforcement office in Martinez that District 2 Supervisor Jeff Smith' s office has referred W to. CHP Lt . Jay Roberts has been extremely helpful in helping me attack the immediate problem of my neighbor who has been observed by me some twenty times in the last year. That problem appears to have ended via CHP request for compliance with "PIP" program forcing owner to reveal safety and maintenance records which shows he is not in compliance with terminal maintenance. CHP has been unable to enforce enclosed traffic resolution as they say they must witness the violation (truck actually traveling on streets listed) or have testimony of a witness to that effect. I have been a witness in this sense to only one of these violations, that is, I observed the violator drive the street, follow him to his residence and get positive I .D. on the driver and this is somewhat confrontational to say the least . One witness to . at least two hundred violations in the last year. The problem I am facing is that with each violation there is an infection of violators (or as Lt . Roberts puts it "the broken window syndrome" ) . At one time I had 5 violators on one street (Viewpointe) . Problem has been on going for approximately one year and half. In an attempt to get she word out to each driver, I am preparing a xerox flyer to make each violator aware of the ordinance (even though they must know they are flying in the face l of the ordinance, as it is clearly posted at Viewpointe and Willow / and California Sand Highway 80 at cab height to a diesel tractor-see CV 21461 (A) Signs are also posted on Willow and 4, Hig way north and southbound adjacent to Willow CHI,iighway venue exit . During the preparation of this letter, 3 January 1994, I observed an additional violation that increases the worse case overload discussed in paragraph two. I observed a diesel tractor with forty foot dirt truck trailer being repaired on the street outside of a residence. Driver indicated. he had just completed a welding repair to a failed axle shaft on his trailer axle. Your guess is as good as mine, 15, 000 pound tractor and lets say empty trailer is 20, 000 pounds . Almost six times the load limit on street (Seascape Circle) .
