RECOMMENDATION: APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract with the Department of California Highway Patrol for State provided traffic control on Walnut Avenue and Marsh creek Road effective July 9, 2001, through July 21, 2001, at a cost not to exceed $20,000. II. FINACIAL IMPACT: The maximum contract cost of$20,000 is available and will be paid from Road Funds. BY ,DEPUTY Purchasing Auditor Controller Contractor P.W.Accounting California Highway Patrol SUBJECT: APPROVE AND AUTHORIZE the Public Works Director, or designee, to Execute a contract with the Department of California Highway Patrol for State provided traffic control on Walnut Avenue and Marsh Creek Road during the period of July 9th through July 21, 2001, at a cost not to exceed $20,000, Brentwood area [Project No. 0672-6U28311 DATE: December 4, 2001 PAGE: 2 III. REASONS FOR RECOMMENDATION AND BACKGROUND: The Public Works Department planned to apply a double chip seal surface treatment to various roads throughout the County during the summer of 2001. Two of the roads scheduled for treatment; Marsh Creek Road and Walnut Avenue, have relatively high traffic volumes. To promote public and worker safety during the chip seal application process, the Department negotiated an agreement with the Contra Costa Area Office of the California Highway Patrol on June 11, 2001, for State furnished patrol services to enhance traffic control on the project site. The agreement was subsequently formalized with a short form contract executed by the County on June 25, 2001, and forwarded to the Department of California Highway Patrol for execution. Subsequently, the Headquarters Office of the California Highway Patrol determined that the execution of a State of California Traffic Enforcement Agreement would be necessary rather than the short form contract furnished by the County. The Traffic Enforcement Agreement presented by the Department of California..Highway Patrol has been reviewed and approved as to form by County Counsel. IV. CONSEQUENCES OF NEGATIVE ACTION: The local office of the California Highway Patrol provided enhanced traffic enforcement services to the County in accordance with the understanding outlined in the short form contract. Without a fully executed agreement, the Public Works Department will be unable to pay for the California Highway Patrol services. It is important to maintain a good working relationship with the California Highway Patrol.
