SUBJECT: Accept Completion of Improvements for Highway 4, Road Improvement
Agreement for RA 1031 (cross-reference SUB 7.907) being developed by Centex
Homes, Byron area(District III).
The Public Works Director having notified this Board that the improvements for RA
1031 (cross-reference SUB 7907) have been completed as provided in the Road Improvement
Agreement with Centex Homes heretofore approved by this Board;

SUBJECT: Accept Completion of Improvements for Highway 4, Road Improvement
Agreement for RA 1031 (cross-reference SUB 7907) being developed by Centex
Homes, Byron area (District III).

NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of December 4, 2001 thereby establishing the six-month terminal period for
the filing of liens in case of action under said Road Improvement Agreement:

November 7, 1995 The American Insurance Company
BE IT FURTHER RESOLVED the payment (labor and materials) surety for$359,550.00,
Bond No. 1.1141552031 issued by The American Insurance Company be RETAINED for the six
month lien guarantee period until April 2, 2002, at which time the Clerk of the Board is
AUTHORIZED to release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening of Highway 4 is ACCEPTED as
complete; the right of way was conveyed by separate instrument, recorded on November 30,
1995, in Book 383 of Maps on page 27.
BE IT FURTER RESOLVED that the beginning of the warranty period is hereby
established, and the $7,200.00 cash deposit (Auditor's Deposit Permit No. 268234 dated October
17, 1995) made by Centex Real Estate Corporation and the performance/maintenance surety for
$711,900.00, Bond No. 11141552031 issued by The American Insurance Company be
RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code until
released by this Board.
