Recommendation:
AUTHORIZE the Health Services Director or his designee, Wendel Brunner, M.D., to sign a
hold harmless agreement indemnifying St. Anselm's Episcopal Church located at 682 Michael
Lane, Lafayette, CA 94549 on Friday, January 25, 2002.
Background:
The facility will be used on Friday, January 25, 2001 for the Healthy Families Program to hold a
staff retreat.
Fiscal Impact•
Funding for rental is included in the State allocation for SCHIP Healthy Families Outreach and ,
Enrollment Program.

OCCASIONAL AND/OR CONTINUING USE GUIDELINES
FOR NON-RELIGIOUS ACTIVITIES
I. Definitions: As used in these guidelines the term Occasional Use is defined as the one time
use of St. Anselm's church, parish hall or classrooms for non-religious purposes by any
individual group or organization other than by individuals who are members of St. Anselm's
or groups or organizations which are part of St. Anselm's or sponsored by St. Anselm's.
Continuing Use is defined as the regularly scheduled use, e.g. weekly, monthly, etc., of St.
Anselm's church, parish hall or classrooms for non-religious purposes by any individual or
organization other than by individuals who are members of St. Anselm's or by groups or
organizations which are part of St. Anselm's or sponsored by St. Anselm's.
2. The purpose of any organization group or individual using any of the facilities of St.
Anselm's Episcopal Church must not be, both in philosophy and practice, incompatible with
the policies the Episcopal Church and the Rector and Vestry of St. Anselm's Church.
3. Donations: Suggested donations for the Occasional and/or Continuing Use of St. Anselm's
facilities are outlined on the attached schedule. These donations will be used to off-set the
expenses incurred in the use of these facilities(i.e. electricity, maintenance and cleaning).
4. Requests for Occasional Use and/or Continuing Use may be made by letter or telephone call
to the Rector. Neither Occasional Use nor Continuing Use activities will be scheduled to
conflict with Church activities. Should such a conflict arise, the Occasional or Continuing
Use activity will be rescheduled or canceled. Every effort will be made to avoid such
conflicts and to provide ample time to reschedule conflicts should they occur. St. Anselm's
Church reserves the right to cancel the Occasional and/or Continuing Use privilege at any
time.
5. Any organization, group, or individual using the facilities must agree that they will be
completely responsible for any liability including personal injury, property damage, or
professional liability resulting from their use of the facility. If the play yard is to be used, a
certificate of liability insurance naming St. Anselm's Episcopal Church as an additional
insured may be required.
6. Any individual group or organization will leave the facilities in a clean and orderly condition
and will return the furnishings to their original configuration or the arrangement needed for
the next use or activity. A cleaning deposit will be collected in advance of use. The return of
the cleaning deposit is contingent upon conformance with this article.

7. One individual member of the group will be designated to be personally responsible for the
security of the buildings following the use of the facilities. This means that all windows
must be closed, all lights turned off, all equipment turned off, all.doors locked. Rest
rooms should be checked to see that no water has been left running, lights are off, and
doors are locked.
8. The individual or the assigned representative of any group or organization designated in
paragraph 5 will sign a statement that the individual group, or organization agrees to abide by
these guidelines as a condition of their use of any portion of our facilities. This
individual/representative will also provide his/her address and a telephone contact number
for days and evenings.
9. Any food or beverage to be served will be prepared elsewhere and served in accordance with
county health department regulations. Dishes and kitchen equipment owned by the Episcopal
Church Women of St. Anselm's Church and stored in the kitchen are not available for
occasional use unless a separate agreement is arranged through the ECW. Any alcoholic
beverages served must be offered in conformity to the established policy of the Diocese of
California(copy attached). This policy restricts beverages to beer and wine and requires that
non-alcoholic alternatives be presented and offered in a similar and equally attractive
manner..
10. The use of any non-biodegradable or non-recyclable food service containers is prohibited.
This includes all styrofoam cups, dishes and similar items.

** Cleaning deposit is fully refundable if facilities are left in a clean and orderly condition and
all furnishings returned to their original configuration. If any facility is not left in a clean and
orderly condition after use, the cost of cleaning will be deducted from the cleaning deposit.

ALCOHOL AT CHURCH FUNCTIONS
1. When alcoholic beverages are offered, non-alcoholic beverages must also be made available.
Non-alcoholic beverages must be served in an equally accessible and attractive manner as the
alcoholic beverages.
2. Alcoholic beverages shall not be sold without a license. That's the law.
3. Any food or beverages made with alcohol must be clearly labeled. This also applies to any
food in which the alcohol has been"cooked out."
4. A responsible member of the parish must be in control of the serving of alcoholic beverages
during functions. Drunkenness is always inappropriate behavior.
5. The sponsor of an activity must take responsibility for - and is legally liable for- intoxicated
persons. This responsibility M"include providing transportation home.
6. The final responsibility for distributing and following these guidelines lies with the clergy,
wardens and vestry of a congregation.
7. This policy is to be disseminated to the congregation and to all users of church facilities in the
use agreement. A copy of this policy should become a part of the use agreement for persons
or organizations renting space (i.e. weddings).
