Y the Americans with Disabilities Act (ADA) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the Risk Manager to execute a renewal contract with Skamser and Associates for consultation and technical assistance on the County's Americans with Disabilities Act (ADA) Program in an amount not to exceed $60,000. FINANCIAL IMPACT: Costs for consultation and technical assistance are funded through the Workers' Compensation Self-insurance Trust Fund. BACKGROUND/REASONS FOR RECOMMENDATION: The Americans with Disabilities Act provides protection against discrimination to disabled individuals. The Act prohibits discrimination on the basis of disability in employment, public services and public accommodations. The Act makes employment discrimination against qualified individuals with a disability unlawful. It prohibits discrimination in training, promotion, retention and other aspects of employment and requires employers to provide reasonable accommodation to qualified disabled employees and applicants for employment. AYES: NOES: ABSENT: ABSTAIN: q ATTESTED i JOHN SWEETEN,CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR Contact: Ron Harvey—335-1443 cc: CAO Risk Management Auditor-Controller Skamser&Associates D:\My Documents\Board Doc's\Board Order-Skamser.doc BY DEPUTY SUBJECT: Contract with Skamser & Associates for Consultation and Technical Assistance on the Americans with Disabilities Act (ADA) DATE: December 4, 2001 PAGE: 2 BACKGROUND/REASONS FOR RECOMMENDATION (Continued): Skamser & Associates provides assistance on final stages of the Countywide bank of essential functions job descriptions; assists departments in developing and modifying essential functions for testing purposes; provides consultation on modification to existing policies affected by ADA, State ADA laws, and related law; including confidentiality, and harassment and hostile work environment as it relates to individuals with disabilities; trains staff on various ADA related issues including accommodation, hiring and sensitivity training; provides assistance to departments and Human Resources on hiring issues related to individuals with disabilities. Coordinates and holds accommodation meetings. Mediates with employees, employer representatives and unions regarding disability related issues. Provides advice to Workers' Compensation staff on FEHA/Workers' Compensation interrelation. Skamser & Associates researches and writes new procedures required by legislation and regulations. Skamser & Associates also provides ongoing consultation on a case by case basis on accommodation for existing staff with disabilities, provides consultation and interacts with County Counsel on litigation issues, and maintains a system for the identification of employees being provided job modification and a system for the assessment and response to requests for accommodation. She locates assistive devices and orders equipment. She consults with medical staff on accommodations, fitness for duty and hiring procedures. She provides assistance to departments with program and building access issues as well as assistive devices for the public. The contract with Skamser & Associates is for the six-month period, January 1, 2002 through June 30, 2002, at an hourly rate of$60. During that time, the consultative services will be monitored and evaluated.
