SHIU, PUBLIC WORKS DIRECTOR DATE: December 18, 2001 SUBJECT: Approve the Right of Way Contract, the Agreement for Conveyance of Real Property, and accept the Grant of Easement from Pittsburg Unified School District for property rights in connection with the State Route 4 East, Railroad Avenue to Loveridge Road Project, Pittsburg area. SCH# 2000112007. Project No. 4660-6X4287 Task: ACQ Account: 3540 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE the Right of Way Contract, the Agreement for Conveyance of Real Property, and ACCEPT the Grant of Easement from Pittsburg Unified School District. B. AUTHORIZE the Public Works Director to execute said Right of Way Contract and Agreement for Conveyance of Real Property on behalf of the County. C. APPROVE the payment of $54,200 for said property rights and AUTHORIZE the Auditor- Controller to issue a check in said amount payable to the Pittsburg Unified School District, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the abov referenced Grant of Easement recorded in the Office of the C my Recorder. Financial Impact: The activity is funded by Contra Costa Transportation Authority (100%). III. Reasons for Recommendations and Background: These property rights are required for the State Route 4 East, Railroad Avenue to Loveridge Road Project in accordance with the approved plans and specifications. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
