Recommended Action: APPROVE and AUTHORIZE the Chief Engineer to execute a contract on behalf of the Contra Costa Clean Water Program with GeoSyntec Consultants to perform technical services to fulfill requirements of the Joint Municipal National Pollutant Discharge Elimination System (NPDES) Permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards for Contra Costa County, nineteen (19) of its incorporated cities and the Contra Costa County Flood Control and Water Conservation District. (Stormwater Utility Fee Assessments) (All Districts) Project No.: 0929-6X7055 DATE: November 6, 2001 PAGE 2 II. Financial Impact: The contract's estimated cost is $85,000. The cost shall be funded by the cities and County proportionate to their respective populations through stormwater utility assessments. III. Reasons for Recommendations and Background: The United State Environmental Protection Agency issued the National Pollutant Discharge Elimination System (NPDES) Regulations for stormwater discharges on November 16, 1990. These regulations required Contra Costa County, its incorporated cities and the Contra Costa County Flood Control and Water Conservation District to obtain NPDES Permits for municipal stormwater discharges. The Permits seek to significantly reduce or eliminate all pollutants from entering the waters of the San Francisco Bay— Delta Region. The Joint Municipal NPDES Permits were originally granted on September 15, 1993 by the San Francisco Bay Regional Water Quality Control Board and on January 29, 1994 by the Central Valley Regional Water Quality Control Board covering all of the incorporated and unincorporated areas of Contra Costa County. This contract allows GeoSyntec Consultants to provide the necessary technical services for the 2001/2002 fiscal year. The technical services provided by GeoSyntec Consultants are specialized and critical to the success of the overall Program. The Contra Costa Clean Water Program went through an extensive selection process culminating in the recommendation that GeoSyntec Consultants be hired for the 2000/2001 fiscal year; and, based on satisfactory performance be retained for the 2001/2002 fiscal year to provide such services. The unanimous recommendation of the Contra Costa Clean Water Program is to contract with GeoSyntec Consultants for the 2001/2002 fiscal year. IV. Consequences of Negative Action: If the consulting services agreement with GeoSyntec Consultants is not approved, then all municipalities will be in non-compliance with the Joint Municipal NPDES permits issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards. Potentially, fines totaling $10,000 per day and $10.00 per gallon of stormwater discharge for all affected entities could be imposed.
