SUBJECT: APPROVE and AUTHORIZE the Public Works Director to Amend the Consulting
Services Agreement with RBF Consulting, to increase the payment limit from
$50,000.00 to $100,000.00, to provide "on-call" plan checking services for
specialized drainage review for projects in the Alamo Creek Watershed, South
County area(Developer Fees) (District III).

I. RECOMMENDED ACTION:
APPROVE and AUTHORIZE the Public Works Director to Amend the Consulting Services
Agreement with RBF Consulting, to increase the payment limit from $50,000.00 to
$100,000.00,to provide"on-call"plan checking services for specialized drainage review for
the first phase of projects in the Alamo Creek Watershed, South County area.

II. Financial Impact:
The estimated cost of the increase of the contract is$50,000.00 funded by developer review
fees, (100%).
111. REASONS FOR RECOMMENDATIONBACKGROUND:
The amendment of the"on—call" Consulting Services Agreement is needed to assist Public
Works Department staff in completing specialized plan check services that are currently
under review for the first phase of projects within the Alamo Creek Watershed. The
hydraulic analysis for the specialized creek restoration projects being built with the first
phase of development are more complicated and will require more review time than was
originally anticipated. We are in the middle of our reviews and will need to continue reviews
to assure that all potential mitigations are properly analyzed prior to approval of final maps
for this first phase of development.
The conditions of approval for the first phase of the Dougherty Valley Developments require
that the projects impacts to Alamo Creek be mitigated to pre-project levels at the Alameda
County line. Mitigation measures are more complicated than originally anticipated and the
Flood Control District has required further analysis to completely review impacts to
downstream property owners and Alameda County. This requires a substantial amount of
additional review time.
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the Consulting Services Agreement is not amended, current review times for plans and
subdivision maps will be significantly delayed.
