BACKGROUND: The Board of Supervisors received a memorandum dated September 19, 2001 from the Aviation Advisory Committee requesting clarification from the Board of the Aviation Advisory Committee's role and responsibilities relative to the new Ad Hoc Airport Roundtable Committee established by Supervisor DeSaulnier. I would like the Internal Operations Committee to consider the attached materials in clarifying what the roles of each of these committees are and determining if there is any potential duplication of effort or conflicts in missions between the two committees, and to present findings and recommendations to the Board of Supervisors. Attached are copies of the following documents: 1. Two memoranda from Russell Roe, Chairperson of the Aviation Advisory Committee, both dated September 19, 2001, asking for clarification of the AAC's role and responsibilities; 2. A 1965 Board Order forming the Aviation Liaison Committee; 3. A 1972 Board Order approving the Aviation Liaison Committee bylaws and a copy of the bylaws themself,which identify the purpose and objectives of the Committee; 4. A 1977 Board Order recommending that the Aviation Liaison Committee be reconstituted as the Aviation Advisory Committee; 5. The August 21, 2001 minutes of the Aviation Advisory Committee; and 6. Draft September 18, 2001 minutes of the Aviation Advisory Committee. The Aviation Advisory Committee was established by the Board of Supervisors to fulfill those functions outlined in the attached Board Orders. The fact that other committees have been formed to comment on airport issues does not have any legal bearing on the existence or function of the Aviation Advisory Committee. As we review the minutes of the Aviation Advisory Committee and Mr. Roe's memoranda of September 19, 2001, it appears that the Committee is not asking for a legal analysis of its purpose. Rather, it seeks verification from the Board that it performs a service that is of continuing value to the County and to the Board of Supervisors. As chartered by Board Order resolution, the AAC was given responsibility to make recommendations to the Board of Supervisors on a variety of airport issues, including airport noise. Most of us were interviewed and picked by you to serve in this capacity. This interview and selection process was to ensure that the County's airports and communities were fairly treated and fairly represented. As a result of the Board of Supervisors process, the 12 member AAC is made up of representatives from each of our five Supervisor Districts. More so, it is also made up of representatives from every city surrounding the airport, the college district, public at- large positions and airport businesses. But in a disturbing way to the members of the AAC, it has come to our attention that a new "community based" group has been formed by District IV to discuss noise issues at Buchanan Airport, the noise complaint procedures of Contra Costa County, and other airport issues. According to actual handouts from the District IV Supervisor's office the newly formed"Airport Roundtable" committee will be "formally approved" by the "Contra Costa County Airport Subcommittee. Your representatives on the AAC are deeply concerned that this "Round Table" committee's membership seems to be non-representative of the County and its many varied communities, districts and businesses. its members seem to have been hand picked frorn a limited arca'in one district or location. Most of District's IV members seem to be affiliated with or are officers of anti-aviation groups who have and continue to publish false and misleading information.,:Even more disturbing is that the vice-president of"People Over Planes"has been hired as an employee working for District IV. Roe, /#/ nv-� Contra Costa County's Aviation Advisory Committee Chairperson Subject: Buchanan Airport Master Plan Public Hearings The Aviation Advisory Committee (AAC) rinds it difficult to fulfill its responsibilities, recommend or advise the Board of Supervisors (BOS) on airport and aviation issues if the AAC • is circumvented and not asked or approached by the Board before action is taken. This was the case with the action taken on this present issue dealing with the preapplication for federal funds for an update to the Airport Master Plan and Noise Study for the Buchanan Airport. The AAC feels that the process for dealing with this issue could have been handled much better, and with a broader and more diverse public input had the AAC been able to recommend many different possible actions to the Board on this aviation issue, such as timely notification and public meetings in all the diverse communities in our County instead of targeting one specific locale. Also, your AAC representatives request the Board's clarification on the status and makeup of the Board of Supervisor's Airport Subcommittee. The AAC has spent thousands of collective hours pouring over mountains of materials and research to make recommendations to the Airport Subcommittee on board orders and airport economic impact reports and other airport issues, only to have these important issues and.recommendations buried or held up indefinitely by the Airport Subcommittee. The AAC believes that since the Board originated these issues, they should be returned for discussion and action by the full Board of Supervisors. Again, the AAC is unsure of the makeup of the current Airport Subcommittee due to the recent redistricting and boundary changes. We are also unsure of the purpose and necessity of an Airport Subcommittee since the County airports are of such great concern to all Contra Costa County cities, communities, and businesses. Name The name of this organization shall be the Contra Costa County- Aviation ountyAviation Liaison Committee. II. Membership A. Ten members shall be appointed by the Board of Supervisors; two members shall be nominated by each Supervisor. B. Initial appointments shall be for either two or three-year term. Appointments after initial appointments shall be for two-year terms. Interim vacancies shall be appointed by the Board of Supervisors on the nomination of the Super- visors who nominated the former member. M. Term Members are appointed to two-year terms after initial appoint- ments terminate. IV. Attendance Requirements A. Attendance is required and failure to attend-three scheduled consecutive,meetings shall be-considered as automatic re- signation; a significant pattern of absences may also be considered grounds for dismissal. B. Members may be excused by the chairman for authorized absences. C. Dismissal and replacement of Committee members is only by Board of Supervisor's action. V. Quorum �:.. B. The ALC may initiate discussions, observations, investi- gations, and make recommendations on aviation or airport matters affecting the County, to the Board of Supervisors. C. Mendez, Director of Airports KC Coyle, Supervisor of Airport'Operations Timothy Johnson, Airport Intern Diane Favero, Airport Secretary APPROVAL OF MINUTES: Minutes were approved for June 19,2001 meeting. Philip Day, East County, motioned for approval and Fred Egli, District III, seconded the motion. July was not an official meeting because there was no quorum. According to the Brown Act if there is no quorum the. meeting has to be cancelled. (The quorum for the AAC meeting is six.) An invitation was extended to all AAC members to'>.bttend a Brown Act Training session on October 4, 2001, at.the Board Chambers. 1 airport staff. Russell Roe stated that it sounds like District 4's Round Table is dealing with the same issues that the AAC Committee is charged and chartered with. The majority of the AAC members suggested writing a letter to the Board of Supervisors regarding District 4's Round Table committee as usurping the AAC authority. Russell Roe made a motion and Schubert Sarkis, Diablo Valley College, seconded the motion to draft a letter and bring it back at the next AAC meeting for approval before being sent to the Board of Supervisors Lynn McWilliams, a member of the public, expressed concern regarding noise complaints. She asked how are these complaints handled? David Mendez gave a brief summary of the noise ordinance and how the noise complaints are handled. The Airport Staff has always been dedicated to responding to the noise complaints as quickly as possible. However,we have had the Airport Environmental and Community Relations Officer position vacant for over several months and this has put staff behind in handling the noise complaints in a timely manner. Timothy Johnson has been hired as a management intem to handle the noise complaints and has been working hard for the past two months. Mr. Mendez reported that we are now current with our responses to the noise complain: B. It was stated by the AAC members that last year the application for the Buchanan Master Plan and Byron Master Plan were pulled from the Board of Supervisors agenda. The Supervisor for District 5 placed the Byron Master Plan application back on the agenda. The application was approved by the FAA for Byron. On August 14,2001,a preapplication for an update to the Buchanan Master Plan and Business Plan on the Board of Supervisors agenda was again pulled. David Mendez explained that the preapplication is asking FAA for possible federal funding and it is no guarantee that funding is going to occur. Russell Roe questioned if is necessary to have a public meeting for a preapplication? David Mendez stated that it is the Board of Supervisors' discretion to have a public meeting and the airport staff supports the supervisor's decisions. These public meetings are to inform the public what a preapplication is about and it is not going to change the Master Plan as it stands now. Members of the AAC were concerned that they were not involved in the decision regarding the two public meetings. The AAC members would like to be more involved with advising the Board of Supervisors when it is necessary to decide if a public hearing is necessary or not. Input from the general public is favored for updating the Buchanan Master Plan, but why should it be just a select group giving their input and jeopardizing the update for the rest of the county. It was suggested this concern be added to the letter to the Board of Supervisors. This preapplication will be on the agenda for September 25 and at that time the Board of Supervisors will vote on it. C. Bill Manning sent a letter of resignation from the Airport Land Use Committee to David Mendez last month. David Mendez is looking for a new appointment for the ALUC position. Chairman Russell Roe asked for comments from the public. No comments were made and the motion was passed, all ayes. PUBLIC COMMENTS: None. DIRECTOR OF AIRPORTS' REPORT: Timothy Johnson, Airport Management Intern, reviewed the noise report stating the complaints were down 47%and operations were down 23%. Fuel for Buchanan was down 15% and Byron was up 12%. 1 (AAC)about their concerns and issues regarding the preapplication. This part of the AAC's purpose is not being utilized. The main purpose of the letter was to ask for clarification of the AAC's role. John Stuckey, Member at Large, asked Frank Bell, Contra Costa Airports Association and a member of the District IV Ad Hoc Round Table Committee, to review the purpose of the Ad Hoc Round Table Committee. Frank Bell provided a brief synopsis of the committee. Russell Roe stated that since the inception of the District IV Round Table,the AAC has not had public input at their meetings. Virginia Schaefer, Airport Land Use Commission, stated the AAC was formed to do the same thing that the District IV Ad Hoc Round Table Committee is doing. The AAC was carefully thought through to have a wide spectrum of members to represent the communities in District IV and the County as a whole. The Board of Supervisors appoints their own members. Philip Day, East County, motioned for the letter to be approWed. Sarkis Schubert, seconded the motion and it was unanimously approved. B. Russell Roe presented the second draft letter that will be sent to the Board of Supervisors regarding the role of the District IV Ad Hoc Round Table Committee and the status of the Airport Advisory Committee. There was a brief discussion and then the second letter was motioned for approval by Sarkis Schubert and seconded by Virginia Schaefer. It also was unanimously approved. AIRPORT LAND USE COMMISSION REPORT: Meeting was cancelled and there is no chairman for the commission. BYRON AIRPORT REPORT: None. COMMITTEE COMMENTS: Russell Roe commented that the process for the Buchanan Field Airport Master Plan Business Plan and Part 150 Noise Study was being manipulated by a privileged few. Public meetings were instituted right before the vacation of the Board of Supervisors and set this for the agenda on September 25h. :r Russell Roe stated that he found out that the item would be postponed on September 25, because Supervisor DeSaulnier will be out of the country. If this happens, most likely the County will miss the FAA's deadline and be postponed for another year. Further, the County Counsel shall review all possible options the county, as an airport proprietor, has to deal with the impacts of noise upon the community. 7) The Airport Subcommittee shall be briefed by the Airport Manager on the status of existing state, pre-FAA federal, and FAA grant restrictions on our airports. There shall be an analysis of the impact of such restrictions and relevant court rulings on the County's ability to exercise its proprietary leasing rights under U.S. case law. Included in this discussion shall be the status of the tower airport occupancy change. The Airport Manager shall brief the Subcommittee on the minimum requirements for retaining current FAA tower staffing and contingency plans if minimum requirements were not met. 8) The Airport Manager shall provide the Aviation,Advisory Committee with a review of all existing leases, and a summary of leasing policies and current objectives for both aviation and non-aviation leases. The review of each lease shall include the current revenue, term and status of provisions for shielding the County against liabilities for acts of God, accidents or other identifiable mishaps. The Airport Manager and the Aviation Advisory Committee shall review the County's possible liability due to the conduct of leasees and its sub leasees. The Airport Manager and the AAC shall further review the County's contractual obligations to its leasees for acts of God, accidents and other identifiable mishaps, which are possibly not covered by the existing leases. This review by Airport Manager and the AAC shall be forwarded to the County Counsel.for review and comment with the objective of improving future lease agreements. BACKGROUND Contra Costa County has been the operator of Buchanan Field Airport since 1946, serving a variety of needs for local pilots, freight operators, corporate aircraft and pilot training facilities. These operations provide many services to this area, but impact a large number of homes in our community. Byron Airport became part of the County Airport system in 1988. In the years I have represented the Fourth District, which includes Buchanan Field, there has never been a comprehensive review by the Board of our airport system. As diligent and concerned proprietors I believe it is only appropriate that a review process be undertaken to ensure that we are both wise and caring stewards of this charge. We must be sure that we are doing all we are capable of doing, under the law, to operate our facilities at maximum safety while protecting neighbors from the impacts of airport noise. Further, it is important that we correctly assess the airports' role in our local transportation system and in the local economy, and make sure that they are optimizing their economic potential. It is critical that we plan wisely for our airports' future so that they can continue to be important resources for our county. ADDENDUM TO ITEM D.7 Agenda May 4, 1999 On this day, the Board of Supervisors considered the report presented by Supervisor DeSaulnier on the proposed review of Contra Costa County Airport operations and possible related actions. Following Board discussion, Supervisor DeSaulnier moved the staff s recommendations, and included studying the possible use of radar at the airport. Supervisor Uilkema seconded the motion. Following further discussion, the Board took the following action: APPROVED the recommendations as listed, and INCLUDED the possible use of radar in the future.
