SPECIFIC REQUESTS OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION:
1. MAKE FINDING, under Section 31000 of the Government Code, and in conjunction with Board
finding made on October 20, 1998, that 2530 Arnold Drive, Martinez, is a remote site for purposes
of building cleaning services;
2. AUTHORIZE the Purchasing Agent to include this site in the custodial services contract which was
bid and awarded in November, 1998,
II. BACKGROUND,
In October, 1998, the Beard of Supervisors approved that certain County sites could be best served for
building cleaning services if they were done using contracted janitorial providers, rather than in-house
forces. The criteria and sites declared remote were reviewed and approved by Contra Costa County
Employees Association, Local No. 1. The Board also approved a policy establishing that custodial
services contractors working for Contra Costa County pay their employees prevailing wages and
benefits as determined by the State Director of Industrial Relations, and authorized the Purchasing
Agent to execute regionally-based contracts for custodial services for the period November 1, 1998
through October 31, 2000 with a two-year option to continue the contracts, adding and deleting sites as
required to do County business. (A copy of that Board Order is attached.)
The Summit Centre at 2530 Arnold Drive, was purchased by the County in July, 1999. The previous
owner's existing custodial contract was continued until it terminated, and it is now appropriate to have
that site declared remote and added to the other County-owned sites which are done by contract. The
Summit Centre has private tenants who continue to lease space, and therefore, meets established criteria,
as described. When Summit Centre is occupied solely by County departments, then County custodians
will perform the building cleaning work.

III. FISCAL IMPACT:
The County has been able to negotiate considerable savings in custodial contracts by combining
geographical areas and bidding them out regionally. It is estimated that the current contract which was
bid and awarded in November, 1998, was a savings of 31% over the previous costs for contract custodial
services.

RECOMMENDATION:
1. MAKE FINDING, under Section 31000 of the California Government Code,that the locations identified on
Attachment A, for the purposes of building cleaning services, are remote from available County employee
resources and that the County's economic interests are served by contracts rather than by paying additional
travel expenses to existing County employees.
2. ADOPT policy (Attachment B) establishing that janitorial services contractors who provide services to
Contra Costa County shall be required to pay their employees prevailing wages and benefits for contracted
custodial services, as determined by the State Director of Industrial Relations for Contra Costa County.
3. AUTHORIZE the Purchasing Agent to execute three contracts far custodial !ervices in various geographical
areas within the County for a total amount of$188,000 for the period November 1, 1998, through October
31, 2000s with a two-year option to continue the contracts, adding or deleting sites as required to do County
business through October 31, 2002.
BACKGROUND:
Representatives from the General Services Department and Contra Costa County Employees Association Local
No. 1 have met and conferred on criteria and have reached agreement on the sites (Attachment A) which we are
requesting the Board to declare remote. Further, we agreed that we would meet and discuss with them any
additional sites, which might come into the County inventory prior to declaring them remote. We also agreed
that, if any of these sites become no longer remote, we would be willing to modify the site list. A few childcare
sites in Richmond and San Pablo still are being discussed by Local No. 1 and the Community Services
Department, and no agreement has been reached regarding these locations.

Finding Certain Sites Remote, Adopting Policy Regarding
Custodial Services Contracts, and Authorizing the County
Purchasing Agent to Execute Contracts for Custodial Services--Board Order—Page 2
California Government Code Section 31000 provides that the Board of Supervisors may contract for services on
behalf of the County, and that such services "may include maintenance or custodial matters if the board finds
that the site is remote from available county employee resources and that the county's economic interests are
served by such a contract..."
Those sites which we are requesting the Board to declare remote for purposes of custodial services only are
either:
a) In geographical locations which are away from the County's government centers, e.g., Oakley, Brentwood,
Lafayette, Moraga, Kensington.
b) Buildings/facilities which are small and which are budgeted for few hours of custodial service, making it
inefficient to do with County staff, for example, health facilities such as the Tri-cities Discovery Center in
Pinole.
c) Special use facilities and/or facilities where private tenants share leased space with County operations, such
as some daycare centers, the Contra Costa County Health Club in Martinez, and some Health Services
locations.
The General Services Department has surveyed other Bay Area government agencies to determine their policies
regarding the payment of "area wages" and providing health benefits to custodial. contractors. The County
Administrator's Office and County Counsel have been consulted regarding this issue. We are recommending
the adoption of a policy modeled on that of Santa Clara County which uses the current rate for Public Utilities
Janitor/Cleaner within the County as set forth by the Director of the State Department of Industrial Relations.
The current rate for Contra Costa County has been determined to be $7.34 per hour for wages, and $1.01 to
$1.52 per hour, depending on length of service, for health benefits, with provisions for paid vacation, holiday
pay, paid sick leave, and overtime. With Board approval, all current and prospective custodial contractors will
be required to meet these rates, and all contracts shall include language establishing these minimum wages and
benefits.
FISCAL IMPACT;
There is no additional funding required to implement the currently-bid contracts for custodial services, and the
currently-bid contracts will provide savings over the previous contracts at an estimated overall savings of 31
percent.

POLICY
RELATING TO PREVAILING WAGE AND BENEFIT REQUIRENIENTS
FOR CONTRACTED JANITORIAL SERVICES
In order to ensure that appropriate wages and benefits are provided to County-contracted janitorial service
workers, the County shall require employers of these workers to pay them a prevailing rate of wage and
benefits. In the absence of a State mandated prevailing rate for this class of work, this policy establishes the
rate of wages and benefits that shall be provided to County-contracted janitorial service workers by their
employers.
The prevailing rate of wages and benefits for the above-noted janitorial workers shall be the current rate for
Public Utilities Janitor/cleaner within Contra Costa County as set forth by the Director of the State Department
of Industrial Relations.
For the purposes of this policy all firms contracted by the County to provide janitorial services that have
janitorial service employees shall provide these employees the rate of wages and benefits as set forth above.
Firms that do not have employees are exempt from paying the stated rate of wages and benefits.
