RECOMMENDATIONS
AUTHORIZE the Community Development Director or his designee, on behalf of the
County Water Agency to execute a contract amendment with Michael H. Cheney in the
amount of $20,000.00 for continuing services through 06/3012001. This amendment,
effective 09/01/00, increases the contract amount from $75,000.00 to $95,000.00.
FISCAL IMPACT
There is no fiscal impact associated with the above-mentioned contract. Mr. Cheney's
contract costs are recoverable from industry as part of the recently formed San Francisco
to Stockton (Suisun Bay Channel and New York Slough Channel) Maintenance
Assessment District 1999-1.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This contract amendment is necessary for the contractor to continue to work with the
County Water Agency on the ship channel projects, including the newly formed San
Francisco to Stockton (Suisun Bay Channel and New York Slough Channel) Maintenance
Assessment District 1999-1. Work will primarily focus on the further identification and
feasibility of the array of potential disposal sites, and the development of appropriate
permitting and related contractual requirements.

II. FISCAL IMPACT:
These services are requested and paid for by customer departments, and the costs for the contract are
100%charged out.
III. BACKGROUND:
The Lease Management,Division of General Services is currently being reorganized. In the interim, the
Department is utilizing contract consultants to perform management of lease projects, including
preparation of lease documents and renewal of leases. This contract would provide continuation of the
services of one of the consultants,Hervi Ebel. It is expected that the reorganization would be completed
in approximately six months.

used, in whole or in part,for religious worship or instruction.
10. Independent Contractor Status. This Contract is by and between two independent contractors and is not intended to and shall not
be construed to create the relationship between the parties of agent,servant,employee,partnership,joint venture,or association.

12. Access to Books and Records of Contractor,Subcontractor. Pursuant to Section 1861(v)(1)of the Social Security Act,and any
regulations promulgated thereunder, Contractor shall, upon written request and until the expiration of four years after the
furnishing of services pursuant to this Contract,make available to the Secretary of Health and Human Services,the Comptroller
General, the County, or any of their duly authorized representatives, this Contract and books, documents, and records of
Contractor that are necessary to certify the nature and extent of all costs and charges hereunder. Further,if Contractor carries out
any of the duties of this Contract through a subcontract,with a value or cost of$10,000 or more over a twelve-month period,such
subcontract shall contain a clause to the effect that upon written request and until the expiration of four years after the furnishing
of services pursuant to such subcontract,the subcontractor shall make available,to the Secretary,the Comptroller General,the
County,or any of their duly authorized representatives,the subcontract and books,documents,and records of the subcontractor
that are necessary to verify the nature and extent of all costs and charges hereunder. This special condition is in addition to any
and all other terms regarding the maintenance or retention of records under this Contract and is binding on the heirs,successors,
assigns,and representatives of Contractor.
13. Reporting Requirements. Pursuant to Government Code Section 7550,Contractor shall include in all documents or written reports
completed and submitted to County in accordance with this Contract,a separate section listing the numbers and dollar amounts
of all contracts and subcontracts relating to the preparation of each such document or written report. This section shall apply only
if the payment limit under this Contract exceeds$5,000.
14. Indemnification. The Contractor shall defend,indemnify,save,and hold harmless the County and its officers and employees from
any and all claims, costs and liability for any damages, sickness, death, or injury to person(s) or property, including without
limitation all consequential damages, from any cause whatsoever arising directly or indirectly from or connected with the
operations or services of the Contractor or its agents,servants,employees or subcontractors hereunder, save and except claims
or litigation arising through the sole negligence or sole willful misconduct of the County or its officers or employees. Contractor
will reimburse the County for any expenditures, including reasonable attorneys' fees, the County may make by reason of the
matters that are the subject of this indemnification,and if requested by the County will defend any claims or litigation to which
this indemnification provision applies at the sole cost and expense of the Contractor.
15. Legal Authority. This Contract is entered into under and subject to the following legal authorities: California Government Code
Sections 26227 and 31000.

A. Contractor's Obligations. During the term of this Contract, Contractor shall, under the general direction
of the Acting Lease Manager:
1. Negotiate to lease property for the County and special districts;
2. Manage lease projects to include activities such as review of construction and/or remodeling
plans; determination and application of related laws, guidelines or regulations; and
estimation of costs;
3. Preparation of lease documents;
4. Renewal of leases;
5. Coordinate activities related to lease management projects with engineers, architects,
attorneys,property owners,title companies, contractors, service providers, and other County
staff;
6. Prepare reports, Board Orders, specifications and correspondence;
7. Adhere to work schedules as directed;
8. Complete other paperwork, such as timesheets, as directed;
9. Prepare reports and maintains records for County use independently, not using contractors,
subcontractors, or others paid directly by the Contractor.
B. Insurance.
1. Automobile Insurance. During the entire time of this Contract and any extensions or modification
thereof, Contractor shall keep in effect a policy of motor vehicle liability insurance for any use
Contractor makes of a private automobile in the performance of this Contract, as required by State
Law. Contractor shall immediately, by end of the next working day, notify County of any
cancellation or material change in insurance coverage.
C. Payment Provisions.
$45.00 per hour, not to exceed 540 hours $24,300.00

RECOMMENDATIONS
1. Authorize the Community Development Director to sign a contract with Ove Arup &
Partners for consulting services on the Downtown El Sobrante Transportation and Land
Use Plan for an amount not to exceed$70,000, for the period from November 14, 2000
through June 30, 2001.
2. Authorize the establishment of a Project Steering Committee to advise the County in
monitoring the consultant's progress and assist the County in obtaining community
input on the project.
FISCAL IMPACT
None to the General Fund. The County is providing $15,000 in County road funds for the
contract. The rest of the contract is paid for through a$50,000'Transportation for Livable
Communities" (TLC)grant from the Metropolitan Transportation Commission and$5,000 in
Community Development Block Grant funds provided to the El Sobrante Chamber of
Commerce.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Metropolitan Transportation Commission {MTC}in July awarded the County a$50,000
TLC planning grant to help finance the development of the Downtown EI Sobrante
Transportation and Land Use Plan. Staff and the EI Sobrante community have completed
a consultant selection process, resulting in a recommendation to hire a consultant team
headed by Ove Arup & Partners of San Francisco to develop the transportation and land
use plan, implementation program, and environmental assessment.

The recommended consultant team also includes BMS Design Croup, an urban design
firm; Mundie &Associates, a market analysis firm; and Pittman & Names, a planning firm
that will work on the environmental issues. The lead firm, Ove Arup&Partners,will handle
the transportation planning aspects of the project and will serve as project manager for the
consultant team. All four firms on the team are based in San Francisco.
The consultant team will work with the EI Sobrante community and staff to develop a plan
for Downtown EI Sobrante that will improve internal circulation within the downtown for all
modes of transportation, recommend land use changes such as mixed use involving
residential downtown uses, and develop design guidelines for future development. The
project is part of the ongoing effort to revitalize Downtown El Sobrante and restore its
economic viability and appeal to shoppers, businesses and visitors.
This recommendation is the result of a selection process conducted by the Community
Development Department and the 94803 Task Force, a community group in El Sobrante.
The Community Development Department distributed a request for proposals to 53
qualified consulting firms. Three proposals were received, and all three proposing
consultants were interviewed. The selection panel included five community members from
EI Sobrante and four staff members representing the Community Development
Department, the Public Works Department, the West Contra Costa Transportation
Advisory Committee (WCCTAC), and Supervisor Gioia's office.
Upon completing the interviews, the panel was unanimous in its recommendation for the
team headed by Ove Arup & Partners.
Exhibit A shows the Scope of Services on which the contract with Ove Arup will be based.
It is taken from the request for proposals that was issued for the project, and is subject to
change based on negotiations with Ove Arup. The Board on October 24 authorized the

Proiect Steerino Committee
A Project Steering Committee will provide direction for the planning process, ensuring the
process stays consistent with the goals and vision established by the El Sobrante
community and County staff. The Committee's charge will be to: f) advise County staff
throughout the process in monitoring the progress of consultant tasks and providing
feedback to the consultants as each task is performed; and 2) assist in arranging and
organizing community meetings to obtain task-specific input from as wide a group of
interests as possible.
The planning process is expected to take six or seven months. It is anticipated the Project
Steering Committee will meet approximately once per month, although more frequent
meetings may be called as necessary. The number of Steering Committee meetings
attended by the consultants will be determined through the final work plan that is
negotiated with the consultants. Their proposal on the project calls for four meetings with
the Steering Committee.
Membership in the Project Steering Committee will be drawn from the community and staff
organizations shown in Exhibit B.
The community organizations shown in Exhibit B include residents of both the County
unincorporated area and the City of Richmond portion of El Sobrante.
Opportunities will be provided throughout the process for input from additional
organizations and jurisdictions not represented on the Project Steering Committee. These
additional opportunities for input are mentioned in the Scope of Services in Exhibit A.
EXHIBIT A
SCOPE OF SERVICES
The information in this Scope of Services is preliminary. It is subject to revision
based on proposals received, negotiations with the selected consultant(s), and
development of the Final Workplan, which is the first deliverable in the contract.
Any revisions to this Scope of Services will be forwarded immediately to the grantor
(the Metropolitan Transportation Commission).
Interested firms may propose work plans that differ with this Scope of Services.
Proposers who suggest a different workplan should include an explanation of the
differences and why they are suggested.
This Scope of Work indicates the tasks to be performed by a consultant or team of
consultants to assist with the revitalization of downtown El Sobrante. There are three
primary components of the consulting work: development of a transportation and land
use plan, development of an implementation p ggram, and a scan of environmental issues
re ag rdinthe-plan.
The transportation and land use plan for the downtown area will identify the locations
and provide designs for transportation improvements, including parking, to accommodate
motor vehicle, bus, pedestrian and bicycle access and circulation. The plan will identify
a mixed-use development strategy for retail, commercial, office, affordable residential
and public spaces that is compatible with community goals. The plan will also include
design guidelines that integrate buildings, streetscapes, landscaping and adjoining spaces
in an attractive and accessible center for the El Sobrante Valley.
The consultant(s)will develop an jWlementation pr�gram for the transportation,
streetscape and public space improvements. Short term and long term projects will be
identified to serve phased development of the downtown area. The implementation
program will include a list of likely funding sources, construction schedule estimates and
permit requirements, among other items.
The consultant(s) will conduct a scan of environmental issues associated with the planned
improvements, for use by County staff'in an Initial Study to meet the requirements of the
California Environmental Quality Act. County staff will create and publish the Initial
Study, using input and recommendations from the consultant's environmental scan.
The consultant project will provide recommendations to revitalize downtown El
Sobrante. These recommendations, pending approval by the Board of Supervisors, will be
used by Contra Costa County to guide future infrastructure investments and development
in downtown El Sobrante. The recommendations will be used in part as the basis for an
amendment to the Contra Costa County General Plan and its development standards and
regulations pertaining to El Sobrante.
Downtown El Sobrante Transportation and Viand Use Flan
Contra Costa County
The 94803 Task Force, in consultation with County staff, developed the improvements
that the consultant will work on. The Task Force was created as one of the outcomes of a
Downtown Visioning Workshop conducted in January 2000 with funds from a
Community Development Block Grant.
County staff and representatives of the 94803 Task Force will jointly oversee the
consultant's work. The County Community Development Department is the lead agency.
The County Public Works Department also will be involved.
Task 1. Develop final workplan.
la Meet with Project Steering Committee (County staff and 94803 Task Force
representatives)to kick off the project. Review the list of desired improvements
and additional background material to be provided by County staff. Discuss the
task, workload involved, deliverables and deadlines to ensure shared
understanding of the project and each task.
lb Deliver final workplan for the project. Subsequent to the kick-off meeting,
Consultant will conduct further review of background information and will inform
the Steering Committee of any additional background information needed to
perform the tasks. The Steering Committee will attempt to obtain the additional
information if it is available. If the additional necessary information is not
available, Consultant and Steering Committee will discuss ways to proceed.
This task involves one meeting with the Project Steering Committee.
2t7Deliverable 1h: Workplan, based on the initial Scope of Services and
subsequent review by Consultant.
Task 2. Develop a transportation and land use plan for downtown El Sobrante.
2a Meet with the 94803 Task Force to discuss the list of desired improvements
provided in Task#la. Based on that list and input from the 94803 Task Force,
deliver a set of alternative designs for the improvements. The alternative designs
should be provided both for the transportation improvements and the streetscapes
or landscapes that could accompany the transportation improvements. The
alternative designs should indicate the dimensions of all the transportation and
streetscape/landscape improvements, and the materials needed to implement or
construct them. Design alternatives also should be delivered for mixed-use
retail/commercial/affordable residential units that could be built in the downtown
area, consistent with the Mixed-Use Land Use Designation defined in the Contra
Costa County General Plan. Information on the comparative advantages and
disadvantages of each alternative design should be provided.

This task involves a series of meetings with specific community groups and with
the general public. The exact number of meetings is to be determined, The
Consultants) will not be required to set up, organize or run the meetings.
The community has expressed interest in visual simulation models to show
different alternatives. Visual simulation is not a required element of this Scope of
Services, but proposing firms are encouraged to include this if it can be done
within the budget for this contract.
Deliverable 2b:Presentation materials on the Alternative Transportation and
Land Use Plans for Downtown El Sobrante developed in Task 2a.
2c Deliver a Preliminary Transportation and Land Use Plan. The plan should
indicate the dimensions of all transportation facilities and streetscapeJpublic space
improvements (and amount of right-of-way needed), the materials needed to
implement or construct them, and all other information needed to develop the
Implementation Program that will be required in Task 3. For transportation
facilities and their streetscapes and landscapes, provide conceptual drawings,
typical cross sections and dimensions. Designs should not only include the
downtown area but also the entryways to the downtown(San Pablo Dam Road
eastbound at El Portal Drive, and San Pablo Dam Road westbound at Appian
Way). For potential mixed-use developments in the downtown area, provide a
conceptual plan drawing.

Task 3. Develop an Implementation Program for the improvements, with short-term and
long-term components.
3a Develop and deliver an Implementation Program for use by the County in
implementing the improvements that were designed in Task 2. The
Implementation Program should identify a short-term and long-term component,
with short-term projects being those that could be implemented within a year to
18 months. Information should include cost estimates for each improvement, an
estimated construction schedule or timeframe, likely funding sources, and any
phasing that the consultant recommends for any of the projects. If any of the
improvements involve operational issues or have unusual maintenance issues,
these should be addressed in the Implementation Program. (Note: Contra Costa
County seeks resources to fund an economic assessment of the amount of retail
business that could be sustained in Downtown El Sobrante. This economic
assessment, or market study, is considered a parallel effort to the Downtown El
Sobrante Transportation and Land Use Plan. However, if interested firms know
of a way to fit such a study into this contract, they are encouraged to do so.)
This task will involve one meeting with the Project Steering Committee.

Task 4. Scan the likely environmental issues in a manner that is consistent with the scope
of topics needed for an Initial Study under the California Environmental Quality Act
(CEQA).
4a Evaluate the improvements contained in.Deliverable 2e (Final Designs) and
Deliverable 3a (Implementation Plan) for possible environmental impacts, paying
particular attention to the impacts required as part of the CEQA Initial Study
process. Report to the Project Steering Committee on the degree to which the
projects will have impacts in these areas, and provide recommendation on how
the County should proceed with environmental review(full environmental impact
report on overall project, separate environmental impact reports on each
component project, negative declaration, etc.) County staff will use this
information in preparing the Initial Study and determining findings of the Study.
