1. Recommended Action:
APPROVE Project Contingency Fund increase of $220,000.00 and Contract Change Order No.
4 in the approximate amount of $170,000.00 and AUTHORIZE the Public Works Director to
execute it in order to compensate the contractor, Ghilotti Construction Company, Inc., for increases
in existing contract items.
11. Financial Impact:
The Project Contingency Funds are currently insufficient to cover the cost of extra work. The
increase in contingency funds will be funded by Transportation Equity Act 21 91%) and Measure
C Funds (9%). ,

Ill. Reasons for Recommendations and Background:
Additional funding is needed to pay the contractor for increases in existing contract items, The
additional work included pavement failure repair and installing rubberized asphalt concrete.
Changes made exceed the limits specified in Public Contract Code Section 20395 and exceeded
the project contingency fund. APPROVAL of the Change Order and project contingency fund
increase is REQUIRED.
IV. Conseggences of Negative Action:
The lack of APPROVAL would prevent successful completion of this contract and preclude
payment to the contractor for required work.

The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on May 3, 2000 contracted with Ghilotti Construction Company, Inc., for
overlaying various roads with rubberized asphalt concrete, with Safeco Insurance Company of America
as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of September 25, 2000.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

11. FINANCIAL IMPACT:
The activity is funded by Contra Costa Transportation Authority(100

Contra Costa County, in coordination with the Contra Costa Transportation Authority and the California
Department of Transportation, proposes to acquire private residential, special use, and vacant properties located
in the City of Pittsburg (along Frontage Road south of State Route 4) on a voluntary basis with the existing
landowners who are willing to sell (Figure 1). The proposed project will involve only the negotiated, voluntary
acquisition of I special use, I vacant, and 28 residential properties (51 units) and relocation of occupants as follows:
)i,- I special use property,(the Pittsburg Elks Lodge), located at the southwest corner of Frontage Road and
Crestview Drive,and 1 vacant property (owned by the Elk's Lodge),located at the southeast corner of
Frontage Road and Crestview Drive (Figure 2a);
2 buildings of the Lido Square Apartment complex (8 units) adjacent to Frontage Road, between
Crestview Drive and Crestview Lane(Figure 2a);
11 single-family homes adjacent to Frontage Road,between Los Medanos Elementary School and Marsh
Avenue (Figure 2b); and
➢ 16 multiple-family duplexes (32 units) adjacent to Frontage Road,between Marsh Avenue and Crestview
Drive (Figure 2b).
The purpose of the project is to provide for advance right-of-way acquisition of properties with willing,sellers for
the possible construction of an expanded freeway along the southern portion of State Route 4 in the City of
Pittsburg. The eventual freeway and Frontage Road construction activities, which are not part of this proposed
project, are subject to separate environmental review under CEQA and approvals. Additionally, the County will
not undertake new activities on the properties(other than relocation) or make a decision as to the future use of the
proposed properties until the proposed freeway widening or any other use of the properties has undergone CEQA
review as a separate project.
It can be seen with certainty that there is no possibility that the activity may have a significant adverse effect on
the environment. The activity will not result in any physical modifications to the environment. It involves the
purchase of properties from willing sellers and the associated relocation costs. The activity has been determined
to be in compliance with the General Plan of the City of Pittsburg,
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize funding.

I. Recommended Action:
A. APPROVE Settlement Agreement and Release and ACCEPT the grant Deed dated October 9, 2000
from Dinesh Maniar.
B. AUTHORIZE the Public Warks Director to execute said Settlement Agreement and Release on behalf
of the County.
C. APPROVE payment of$10,000 in connection with the terms of the Settlement Agreement and
Release.
D. AUTHORIZE the Auditor-Controller to issue a check in said amount payable to First American
Title Company, 1850 Mount Diablo Blvd., Walnut Creek, CA 94596, to be forwarded to the Real
Property Division for delivery.
H. Financiallmpact:
Payment of$10,000 is from State Route 4 East/Bailey to Railroad funds which are 100% reimbursable from.
the Contra Costa Transportation Authority.
