Financial Impact: No impact to the County General Fund. The Management Program is funded by the former Southern Pacific Right of Way Trust Account. 111. Reasons for Recommendations and Background The former Southern Pacific Right of Way, also known as the Iron Horse Corridor, is 18.5 miles long traversing north-south between Mayette Avenue in Concord and the Alameda County line in San Ramon. The County acquired the corridor in the 1980's using State transportation grant funds. The State grant obligates the County to preserve the corridor for a potential mass transit facility. The County's policies regarding the use and ownership of the corridor indicate that the right of way shall remain in public ownership along its entire route, be used as a non-motorized transportation route (the Iron Horse Trail) and underground utility corridor and provide an easement for a potential transit facility. In response to requests by residents living near the Iron Horse Corridor, the Board of Supervisors directed staff to develop a Management Program for the iron Horse Corridor that would include a landscaping program consistent with the current and committed uses within the right of way. County Supervisors Mark DeSaulnier and Donna Gerber were authorized to form an advisory committee to work with staff to develop the Management Program. The Iron Horse Corridor Advisory Committee was formed in January 1998 and consists of eight residents representing the cities and unincorporated areas along the corridor and an agency representative from the East Bay Regional Park District. The Board of Supervisors directed that the Management Program consist of six elements, Mapping, Use Conditions, Joint Use Criteria and Standards, Landscaping, Public Information and Funding. Following is a description and status of each of the elements of the Iron Horse Corridor Management Program. Mapping: Preparation and maintenance of right of way maps that record the location of all existing and committed uses and easements. The County Public Works Department has prepared a Record of Survey for the entire corridor that identifies existing easements within the corridor. New easements, licenses and leases are being recorded on the maps. An easement for future transit is being delineated by the Public Works Department and will be indicated on the Record of Survey maps. Use conditions. Inventory of existing license agreements, contracts, and conditions for existing and committed uses. The County Public Works Department, Real Property Division is the property manager for the right of way and has records of the existing licenses, easements, leases and contracts. SUBJECT: Accept the status report on the Iron Horse Corridor Management Program and adopt the Landscape Element DATE: October 17, 2000 PAGE 3 Joint use Criteria and Standards: Establishment of criteria and standards to ensure the coexistence of the existing and committed uses, and to evaluate the ability to accommodate new uses that may be proposed in the future. Criteria for joint use within the corridor has been stated in Board of Supervisor policies, the County General Plan, the Pleasant Hill BART Area Specific Plan and in the contract with the State for acquisition funds. There are also specific requirements by easement holders within the right of way for joint use. New criteria for landscaping was developed as part of the Landscape Element of the Management Program. Staff is summarizing the existing policies, criteria and standards for review by the Advisory Committee. The Committee may want to suggest new criteria for Joint Use to be adopted by the Board of Supervisors. Landscaping: Identification of the location and type of landscaping that can be accommodated in the right of way, and the cost for installation and maintenance. The Iron Horse Corridor Advisory Committee concentrated their efforts to date on completion of the Landscape Element. The document was prepared with the help of a consultant and with input from the public, adjacent communities and existing easement, license and lease holders within the corridor. The Landscape Element includes criteria, design goals and guidelines for landscaping within the corridor, a range of landscape treatments and cost estimates, a plant palette, and a process for implementation. The Landscape Element is being presented today to the Board of Supervisors for adoption. Public Information: Development of a public information element to inform interested individuals of the Management Program. Notice of the Management Program was mailed to all residents and property owners along the corridor when it was initiated and two public workshops were held during the development of the Landscape Element. The Consultant also developed a web page to inform the public of the project, give status reports and receive input. A draft of the Landscape Element was sent to each city and to citizen groups representing communities along the corridor. Advisory Committee members provide project updates to the communities they represent and receive feedback. Staff will notify the public of the completion of the Landscape Element and work with the Advisory Committee to develop some ongoing strategies for continued public information and involvement. Funding: Update of existing fees and establishment of new mechanisms to cover program costs. Specific mechanisms will be established to cover installation and maintenance of landscaping, such as formation of an assessment district, private contributions, grant funding or a combination of new revenue sources. A report of existing revenue and expenditures for the former Southern Pacific Right of Way Trust Account has been prepared. During the development of the Landscape Element, various funding mechanisms were explored, however no specific recommendations have been prepared. Staff and the Iron Horse Corridor Advisory Committee will continue work on the Funding Element and bring a report to the Board of Supervisors with recommendations on implementation.
