FINANCIAL IMPACT: No County cost. The agreement allows up to $1,219,850 of childcare costs incurred by the County to be reimbursed with CaIWORKs funds allocated to the Contra Costa Community College District. BACKGROUND: The Contra Costa Community College District receives a State allocation of CalWORKs funds for services to CaIWORKs participants enrolled as students at the Contra Costa Community College District College campuses. This revenue agreement will allow Employment and Human Services to identify and receive reimbursement for up to $1,219,880 in childcare costs of the participants enrolled in FY 2000/2001. The billing period for this contract will be through September 30, 2001. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): In 1993/1994, the County and all cable systems in Contra Costa County entered into a written agreement entitled "Agreement for the Delivery of Access Programming in Contra Costa County" (the "Agreement"), which governs the provision of County-wide PEC programming by the County on Contra Costa Television ("CCTV"). That Agreement provided for the distribution of CCTV on a single dedicated channel. Channel numbers were agreed upon with each cable system signing the Agreement. As a result of upgrades to their systems to digital, AT&T has requested to move CCTV to a common channel (Channel 27) throughout the County. Because this requires an amendment to the current agreement, a disruption for current viewers and a change of promotional materials, staff has negotiated the terms and conditions specified in the attached Amendment with AT&T representatives. If AT&T agrees to these terms and conditions, staff recommends that the Board of Supervisors approves the Amendment. 2 AMENDMENT TO THE AGREEMENT FOR THE DELIVERY OF ACCESS PROGRAMMING IN CONTRA COSTA COUNTY This amendment to the agreement referenced in paragraph A ("Amendment") is entered into on October 17, 2000, by and between the County of Contra Costa, a political subdivision of the State of California(the "County") and the following systems operating in Contra Costa County: TCI Cablevision of California, Inc.; Televents of East County, Televents, Inc.; Tele-Vue Systems, Inc.; Heritage Cablevision of Delaware, Inc.; UACC Midwest, Inc.; TCI of East San Fernando Valley, L.P.; Contra Costa Cable Company; and Crockett Cable Systems, Inc. hereinafter collectively the "AT&T Parties". The parties agree as follows: A. Previous Agreement In 1993/1994, the County and all cable systems in Contra Costa County entered into a written agreement entitled "Agreement for the Delivery of Access Programming in Contra Costa County" (the "Agreement'), which governs the provision of County-wide PEG programming by the County on Contra Costa Television ("CCTV"). As of the date of this Amendment, the AT&T Parties bound by and subject to the Agreement. The parties now desire to amend the Agreement to provide for the distribution of CCTV on a single dedicated channel, Channel 27, throughout Contra Costa County (See attached proposed line up change which does not include San Ramon). B. Terms and Conditions AT&T Parties are authorized to distribute CCTV on Channel 27 subject to all of the following terms and conditions: 1. The County and subscribers will be notified thirty (30) days prior to the channel change occurring. 2. The AT&T Parties' system located in San Ramon will carry CCTV on Channel 27 effective February 1, 2001. The AT&T Parties will install equipment necessary to receive and transmit CCTV's signal at no additional cost to subscribers. 3. The AT&T Parties will promote, at no cost to the County, CCTV's channel change by advertisements in local newspapers, channel lineup cards, TV Guide, Channel billboard ads and marketing pieces sent to customers thirty days prior to the channel change and thirty days after the change. A copy of each marketing piece, ad or promotion piece will be sent to the Cable TV Administrator. 4. On or before November 15,2000, the AT&T Parties will submit on a collective basis a check for $2,500 to CCTV for administrative costs as a result of the channel change. 5. The AT&T Parties shall not relocate CCTV to another channel throughout the remaining term of the Agreement, December 31, 2003, with the exception of must carry or retransmission consent. In the event AT&T needs to move the channel, the County will be notified in writing thirty days prior to the channel change. C. Does Not Supersede Agreement Except to the extent that the AT&T Parties are authorized to distribute CCTV on Channel 27 subject to the terms and conditions of this Amendment, all other terms of the agreement not in conflict with this Amendment remains in full force and effect. RECITALS Caltrans and County, pursuant to Streets and Highways Code 130 are authorized to enter into an Agreement for the control of ground squirrels and other burrowing rodents through the use of poison bait, fumigation and traps within Caltrans highway right of way in Contra Costa County. SECTION I County Agrees: 1. County shall furnish all labor, materials, equipment and appropriate chemicals for the control of ground squirrels and other burrowing rodents with Caltrans highway right of way in Contra Costa County by means of poison bait, fumigation and traps. The work shall be done on an as-needed basis as indicated by site conditions and time of year. 2. The County shall be restricted to the following chemicals and application rates* A. Diphacinone (.01%) @ 10 lbs/acre- 3 applications per week B. Diphacinone (.005%) @ 18 lbs/acre-bait station C. Gas Cartridges 1 cartridge per burrow D. Phosroxin Tablets 2 tablets per burrow E. Zinc Phosphide (1%) @ 6 lbs/acre P. Zinc Phosphide (2%) @ 6 lbs/acre * The authorized amount is an estimate only. 3. County shall wear all required personal protective equipment as specified by the label of the applied rodenticide, and follow all safety precautions specified by the same label. County shall assume responsibility for protecting pedestrians, children and pets from exposure to poison bait and/or fumigants and traps. SECTION II Caltrans Agrees: Caltrans shall reimburse County for the actual cost of materials and supplies used at the worksite in performance of this agreement (including applicable sales tax). Cost of materials and supplies is to be substantiated by an invoice signed by the County's authorized representative, verifying the actual cost and delivery of replaced components. SECTION 111 It Is Mutually Agreed: In consideration of the foregoing and the mutual promises of the parties hereto, the County and Caltrans agree as follows: 1. Hold Harmless Clause Neither STATE nor any officer or employee thereof is responsible for any damage or liability occurring by reason of anything done by County under, or in connection with any work, authority, or jurisdiction delegated to County under this Agreement. It is understood and agreed that, pursuant to Government Code Section 895.4, County shall fully defend, indemnify, and save harmless the State of California, all officers and employees from all claims, suits, or actions of every name, kind, and description brought for or on account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by County under or in connection with any work, authority, or jurisdiction delegated to County under this Agreement. 8. Non-Discrimination During the performance of this agreement, County and its subcontractors shall not unlawfully discriminate, harass or allow harassment, against any employee or applicant for employment because of sex, race, color, ancestry, religious creed, national origin, disability(including HIV and AIDS), medical condition (cancer), age, marital status, denial of family and medical care leave, and denial of pregnancy disability leave. County and subcontractors shall insure that the evaluation and treatment of their employees and applicants for employment are free from such discrimination and harassment. County and sub-contractors shall comply with the provisions of the Fair Employment and Housing Act (Government Code, Section 12900 et seq.) and the applicable regulations promulgated thereunder(California Code of Regulations, Title 2, Section 7285.0 et seq.). The applicable regulations of the Fair Employment and Housing Commission implementing Government Code, Section 12990 (a-f), set forth in Chapter 5 of Division 4 of Title 2 of the California Code of Regulations are incorporated into this agreement by reference and made a part hereof as if set forth in full. Cost Principles A. County agrees to comply with Federal procedures in accordance with Office of Management and Budget Circular A-87, Cost Principles for State and Local Governments. B. County also agrees to comply with Federal procedures in accordance with 49CFR, Part 18, Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments. C. Any costs for which payment has been made to County that are determined by subsequent audit to be unallowable under Office of Management and Budget Circular A-87 or CFR 49, Part 18, Uniform Governments, are subject to repayment by County to State. 10. Insurance. County shall provide Caltrans proof of Worker's Compensation Insurance or self-insurance pursuant to Section 3700 of the Labor Codes. A copy of this certificate shall be returned along with this Agreement after approval by the Board of Supervisors and the County legal Counsel or Attorney. Final signature will not occur until this information is provided by the County. 11. Obligations Nothing in the provisions of the Agreement is intended to create duties or obligations to or rights in third parties to this Agreement or affect the legal liability of either party to the agreement by imposing any standard of care with respect to the maintenance of State highways different from the standard of care imposed by law. 12. Records Retention For the purpose of determining compliance with Public Contract Code Section 10115, et. seq. and Title 21, California Code of Regulations, Chapter 21, Section 2500 et. seq., when applicable, and other matters connected with the performance of the agreement pursuant to Government Code Section 8546.7, County, subcontractors and the State shall maintain all books, documents, papers, accounting records, and other evidence pertaining to the performance of the agreement, including but not limited to, the costs of administering the agreement All parties shall make such materials available at their respective offices at all reasonable times during the agreement period and for three years from the date of final payment under the agreement. The State, the State Auditor, FHWA, or any duly authorized representative of the Federal government shall have access to any books, records, and documents of County that are pertinent to the agreement for audits, examinations, excerpts, and transactions, and copies thereof shall be furnished if requested. 13. Relationship of Parties It is expressly understood that this is an Agreement by and between two independent parties and that this is not intended to, and shall not be construed to, create the relationship of agent, servant, employee, partnership,joint venture or association, or any other relationship whatsoever other than that of two independent parties. Contract No. 04A1168 Agreement Sheet 6 of 8 County Agreement No. 14. drug Free Workplace Certification By signing this agreement, County hereby certifies under penalty of perjury under the laws of the State of California that they will comply with the requirements of the Drug-Free Workplace Act of 1990 (Govemment Code Section 8350 et seq.) and will provide a drug-free workplace by doing all of the following: 1. Publish a statement notifying employees that unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited and specifying actions to be taken against employees for violations, as required by Government Code Section 8355(a). 2. Establish a Drug-Free Awareness Program as required by Government Code Section 8355(b), to inform employees about all of the following: a) the dangers of drug abuse in the workplace, b) the person's or organization's policy of maintaining a drug-free workplace, c) any available counseling, rehabilitation and employee assistance programs, and d) penalties that may be imposed upon employees for drug abuse violations. 3. Provide as required by Government Code Section 8355(c)that every employee who works on the proposed agreement or grant: a) will receive a copy of the company's drug-free policy statement, and b) will agree to abide by the terms of the company's statement as a condition of employment on the agreement or grant. 4. Failure to comply with these requirements may result in suspension of payments under the agreement or termination of the agreement or both and County may be ineligible for award of any future state agreements if the Department determines that any of the following has occurred: (1) County has made a false certification or, (2) violates the certification by failing to carry out the requirements as noted above. 15. Subcontracting The County shall perform the work contemplated with resources available within its own organization and no portion of the work shall be subcontracted. 16. Funding Requirements A. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of congressional or legislative appropriation of funds, for the mutual benefit of both parties in order to avoid program and fiscal delays that would occur if the contract were executed after that determination was made. This contract is valid and enforceable only if sufficient funds are made available to the State by the United States Government or the California State Legislature for the purpose of this program. In addition, this contract is subject to any additional restrictions, limitations, conditions, or any statute enacted by the Congress or the State Legislature that may affect the provisions, terms or funding of this contract in any manner. . C. It is mutually agreed that if the Congress or the State Legislature does not appropriate sufficient funds for the program, this contract shall be amended in writing to reflect any reduction in funds. C. The State has the option to void the contract under the 30-day termination clause or to amend the contract to reflect any reduction of funds. Rupf, Sheriff-Coroner Contra Costa DATE; September 21,2000 Cf3Unt}f SUBJECT: Contract for Inmate Commissary Services SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE and AUTHORIZE the Sheriff Coroner, or designee,to execute, on behalf of the County, a five year contract with Canteen Corporation to provide vending and commissary sales to inmates at the County adult detention facilities for the period November 1, 2000 through October 31, 2005. FISCAL IMPACT: There is no fiscal impact to the County. This contract provides revenue to the Inmate Welfare Fund with no County or Inmate Welfare Fund expenditures. BACKGROUND: Under the terms of the contract the Sheriff retains ultimate and ongoing control over the operation of vending and commissary sales to inmates while relieving staff of the daily operational functions of this service. The five-year contract with Canteen Corporation was competitively bid. The current contract provides a commission to the Sheriffs inmate Welfare Fund of 28.5% on all net sales. CONSEQUENCES OF NEGATIVE ACTION: If the contract is not approved, Sheriffs Office staff would be required to devote additional time to provide personal items and snacks to inmates and the revenue generated by the contract for the Inmate Welfare Fund would be lost. FISCAL IMPACT: Approval of this Agreement will result in $25, 000 from WestEd, a non- profit organization with offices in Oakland and San Francisco, for the Tobacco Related Disease Research Project (TRDRP) . No County funds are required. BACKGROUND/REASON(S) FOR RECOMMENDATION(S) : The Tobacco Prevention Project works to reduce environmental tobacco smoke, to counter pro-tobacco influences, and to reduce youth access to tobacco in Contra Costa County. The project also works with community organizations to adopt tobacco prevention as part of their organizational mission and is committed to tobacco control collaborative efforts with other Public Health and Health Services projects . The core of much of the work accomplished by the project involves the youth leadership initiative, TIGHT (Tobacco Industry Gets Hammered by Teens) . The goal of this project is to document : 1) the supports that are required to organize a successful youth development project, 2) the impact that youth have on changing tobacco policies in their own community, and 3) the impact youth have on policy-makers in those communities . The funding for this project will provide the necessary resources to conduct an in-depth evaluation that can be utilized to secure future funding for the youth program. Three certified and sealed copies of the Board Order should be returned to the Contracts and Grants Unit .
