RECOMMENDATIONS: Authorize the Sheriff to proceed with enforcement of Co.Ord.95-2 requiring the removal of inoperable vehicles or parts thereof from private property located at 1833 Giaramita St,North Richmond,APN:409- 271-019. The Sheriff requests the Board deny the Appeal and direct the Sheriff to proceed with the abatement action as scheduled, 11 FISCAL IMPACT. No impact Ill. BACKGROUNDIREASONS FOR RECOMMENDATIONS: On June 21, 2000,the site was inspected by Vehicle Abatement Officer, Clyde Smith. Officer Smith identified two(2)vehicles which were dismantled,wrecked or inoperable and fit the parameters of the Abandoned Vehicle Abatement Program. Notice of Intent to Abate Abandoned Vehicles, per County Ordinance 95-2,were mailed to all interested parties on July 11,2000. On June 29,2000,Mr.Pace was sent a letter from the North Richmond Community Action Plan(NRCAP) asking him to keep the,vehicles"out of public view",along with a list of other concerns. 4 On July 13, 2000,tenant Clifford Pace requested an Appeal Hearing before the Zoning Administrator based on his Intentions to repair the vehicles. Mr.Face stated,"The repairs will require no less than six months"and"I have invested a lot of money overtime in both vehicles,being on a fixed income I can only buy parts a little at a time'. On August 23,Officer Smith reinspected the site and found that the vehicles appeared in the same state of disrepair. On August 28,2000,an Appeal Hearing was held in Mr.Pace's absence before the Zoning Administrator. The Zoning Administrators decision was that the vehicles were to be removed within 10 days. Mr.Pace was made aware of this decision by mail on August 30, 2000. On September 5, 2000, Mr. Dace requested a hearing before the Board of Supervisors. Ill. This ordinance amends County Ordinance Cede Division 430 to designate the Sher'ff to administer and a~force the provisions of the A andcned Vehicle Ordinance, and to clarify the provisions on entry onto private grope.-ty. SECTION 11. Section 430-4.014 is added to the County Ordinance Code, to define the ter7n "enforcement officer" to read: 430-4,014 Enforcement Of er. "Enforcement Officerm refers to the Shedif as the fficlal responsible for administering and enforcing the provisions of this division. (Ord. SECTION 111. Chapter 434-6 of the County Ordinance Code is amended, to designate the Sheriff as tete County offic/al responsible for administering the provisions of Division 430, Abandoned Vehicle Ordinance, and to delete all references to the Director of Building Inspection, to read: CHAPTER 430-4 ADMINISTRATION AND ENFORCEMENT 430-6.002 Enforcement Authati ty. The Sherfff Is designated the enforcement officer for this division. The Sheriff and his regularly salaried full-time employees shall be responsible for enforcing and administering this division pursuant to Vehicle Code Section 22663. In the enforcement of this division, such employees and other persons duly authorized by the Sheriff may enter upon private or public property to examine a vehicle or parts thereof, obtain information as to the identity of a vehicle and to remove or cause the removal of an abandoned vehicle. (Ords. E 1.§3, a6-58 §3, 77-112.) 4304.004 Abatement The enforcement officer may have abandoned vehicles abated and/or removed In accordance with the procedure prescribed In this division. (Orris. ES-.2.J3, 8fi�8 §3, 77-112.) 430-4.006 Nctko of lntentSon. (a) Notice. The enforcement officer shall mail a ten- day notes of intention to abate and remove an abandoned vehicle aS a public nuisance, by registered or certfied mail, to the owner of the land, anyone known to be In possession of tete land and the owner of the vehicle, unless the vehicle Is In such Condition that Identification numbers are not available to determine ownership, or unless the property owner and the vehicle owner have signed releases authorizing removal and waiving further interest in the vehicle or parts thereof. (b) Contents. The notice shall contain an estimate of the cost of abatement (including administrative and removal costs) and a statement that this post may be levied as a special assessment on the landowner's land (parcel). It shall contain a statement of the possessor, property and vehicle owner's hearing rights and notice to the property owner that he or she may appear in person at a hearing or may submit a sworn written statement denying responsibility for the presence of the vehicle an his or her land, with reasons for such denial, In lieu of appearing. (Ords. 95-.Z.§3, 86-58 J3, 77.112.) 430--6.008 Inoperable rA>rkcwahle Vehkies. (a) This chapter's notes of intention Is not required for removal of a vehicle or part thereof which Is inoperable due to the absence of a motor, transmission or wheels and incapable of being towed, and is valued at less than two hundred dollars by a person specified in Vehicle Code Section 2.28,55; provided, that the property owner has signed a release authorizing removal and waiving further interest in the vehicle or part thereof. Prior to final disposition under Vehicle Code Section 22562 of such a I&valued vehicle or part for which evidences of registration was recovered, the enforcement officer shall provide notice to the registered and legal owners of intent to dispose of the vehicle or part, and if the vehicle or part Is not claimed and removed within twelve days after the notice Is mailed from a location specified in Vehicle Code Section 22662,final disposition may proceed. The County, the enforcement officer or any contractor thereof shall not be liable for damage caused to a vehicle or part thereof by removal pursuant to this section. a (b) This section applies only to Inoperable vehicles located upon a pard that Is: (1) zoned for agricultural use: or(2) not Improved with a residential structure containing one or more dwelling units. Chapter 4304 of the County Ordinance Code Is amended to delete aq references to the Director of Building Inspection and to substitute to substitute Chapter 4304 hearings and appeals. CHAPTER 430-8 HEMNCS AND APPEALS 430-8.042 Nearing Requests. (a) Request. Within ten days after the mailing date of the notice of intention to abate and remove,the vehicle owner, landowner or possessor of property may request the zoning administrator for a public hearing on the question of abatements and removal and the estimated cost thereof. (b) Discharge. if, wfthin this ten day period, the landowner submits a sworn written statement denying responsibility for the presence of the vehicle on his land with his reasons for such denial, said statement shall be construed as a request for a hearing which does not require his presence. (c) Notices. The zoning administrator shall immediately notify the enforcement officer of + any such requests or disclaimer. (Orris. 85-2,_§4, M58 §3, 77.11.2.) 430-6.004 No Hearing. If no disclaimer or request for h& ring is received within the ten day period, the enforcement cr5cer or any person he or site authorizes shall abate and remove the vehicle or parts thereof. Thereafter, the costs of abatement shall be tollec!ed pursuant to Chapter 4130-22. (Ords. 95-,,,,L..§4, 86-5a 3, 77-112.) 430-3.006 Hearing Nodccr. Her or she may delay the Ume for removal of the vehicle or parts thereof, N in his or her opinion, the circumstances Justify It At the conclusion of the public hearing, the toning administrator may find that there Is an abandoned vehicle and order It abated and/or removed as a public nuisance and disposed of as hereinafter provided and determine the cost of abatement to be charged against the landowner. The order requiring removal shall Include a description of the abandoned vehicle and the correct Identification number and license number cf the vehicle If available. (b) If It Is determined at the hearing that the vehicle was placed on the land w9tlicut the consent of the landowner and that he or she has not subsequently acquiesced In its presence,the zoning administrator shall not assess the cost of abatement(administration and removal) against the property upon which the vehicle Is located or otherwise attempt to collect such costs from such landowner. (Ords. 85- ?„§4, -58 S3, 77-112.) 4304.012 Notice of Decision. 1f an Interested party makes a written presentation to the zoning administrator but does not appear, he or she shall bi notified In writing of the decision. (Ords. g5- §4, W58 3, 77-112.) 430 1.014 Xpppeals. (a) The enforcement cfi5cer, the landowner, any known possessor of the parol or the vehicle owner may appeal the zoning administrator's decision by filing a written notice of appeal within tan calendar days after his or her derision. The zoning administrator shall promptly transmit the proceedings to the Board of Supervisors. (b) The Burr's clerk shall promptly give written notice of the time and place of the hearing to the appellant and those persons specified In Section 4304.006(a). (c) The Board $trail promptly hear such appeal, and may aff.firm, amend, or reverse the order, or take other action it deems appropriate. Section 430.10.004 of the County Ordinance Cade is amended to delete the reference to the 60irector of Building Inspection" and to substitute "e^fcr-ament ►Icer,` tc read: 430.10.004 Nodfy D.M.V. Within five days alter removal of an abandoned vehicle, the enforcement offlicer shall so notify the Department of Motor Vehicles, Identifying the vehicle or parts, and sand it any evidence of registration available` including registration certificates, certificates of title and license plates. Section 430-10.006 of the County Ordinance Code is amended to delete the reference to the "Director of Building Inspection" and to substitute "enforcement officer", to read: 430.1+0.006 Cant Record. The enforcement officer shall prepare an itemized written account of his or her expenses Incurred to abate the nuisance where it Is proposed to collect costs pursuant to Chapter 430-12. Section 430-12.004 of the County Ordinance Code Is amended to delete the reference to the "Director of Building Inspection" to "enforcement officer," to read: 430-12.+004 Notice of Aasessimerrt. June 29,2000 Dear North Richmond Resident, We are writing to you today as fellow North Richmond residents. In March,a number of North Richmond residents created a North Richmond Community Action Plan (NRCAP). The mission of this plan is to be a blueprint to improve the quality of life and revitalize the community. The plan was created solely by community input. A total of eight focus groups were held where North Richmond residents told us what they liked about our community,what they did not like,and what they would like to see North Richmond-become in the next five years. One thing that residents frequently mentioned that they did not like was the physical environment in North Richmond. This included the trash on the streets and vacant lots,abandoned cars,boarded up buildings etc. We are working with the City of Richmond and Supervisor John Gioia's Office to address some of these issues. However,as North Richmond residents,we believe that each North Richmond resident has a responsibility to help keep North Richmond clean and beautiful. As a goad neighbor we would like you to help us by: 1) Keeping/Removing/Sweeping trash off vacant lots,streets Sidewalks, and curbs and gutters 2) Keeping abandoned vehicles covered or out of public view 3) Informing the police department when you find someone dumping trash in an inappropriate place 4) Ensuring that if you pay someone to dump your trash that they take it to the landfill and not dump it on a vacant lot. 5) Keeping lawns cut North Richmond is a great place to live. Had officer Smith asked I would have showm him the new parts yet to be installed on the Fairlane and will be sending the heads out to be rebuilt this month.Other parts will be repaired/rebuilt later. The Ford Pick-Up is near completion but a computer is needed for start-up and two tires.In addition I still have to pay$425.00 before I get the title.My plans are to repair both vehicles. Pace Background: On June 21, 2000, the site was inspected by Vehicle Abatement Officer, Clyde Smith. Officer Smith identified two (2) vehicles which were dismantled, wreck or inoperable. Notice of Intent to Abate Abandoned Vehicles per County Ordinance 95-2 were mailed to all interested parties on July 11, 2000. On July 13, 2000, tenant Clifford Pace requested an Appeal Hearing before the Zoning Administrator based on his intentions to repair the vehicles. Mr. Pace state, `The repairs will require no less than six months and "I have invested a lot of money over time in both vehicles, being on a fixed income I can only buy parts a Tittle at a time." On August 23, Officer Smith reinspected the site and found that the vehicles appeared in the same state of disrepair. Authority: Section 22660 of the California Vehicle allows the County to adopt an ordinance establishing procedures for the abatement and removal, as possible nuisances, of abandoned,wrecked,dismantled,and/or inoperative vehicles or parts thereof from private property. Contra Costa County adopted County Ordinance 86-58, establish local abatement procedures for the removal of abandoned, wrecked, dismantled, and/or inoperative vehicles or parts thereof from private property. The ordinance was amended under County Ordinance 95-2 to make the Office of the Sheriff the agency responsible for the enforcement of the provisions of the Abandoned Vehicle Abatement Program. Recommendation: If the vehicles cannot be repaired in a timely manner, allow the Sheriffs Office to proceed with this abatement action.
