I. RECOMMENDATION
A. FIND, based on the evidence set forth below and as contained in (lie minutes of the Board
uneeting, pursuant to Pt►blit Conirtact Code Sections 20134 and 22050, that all emergency exists,
that the emergency will not permit a delay resuhing Erom a Competitive solicitation Isar bids, tans#
that the action described in this order is necessary to respond to the emergency.
13. DELEGATE to the General Services Director the authority to proceed its the most expeditiolls
manner with the Replacement of 1-IVAC System at Richmond health_ Center, 100.38► Street,
Richmond.
C. DIRECT lite Director of General Services to make reports to the Board of Supervisors, as
required by Public Contract Code Section 22050, stathig the ret►so►as justilying why the cmergency
will not permit a delay resulting from a competitive solicitation for bids and why tlae action is
necessary to respond to the enlergeticy, to enable the Board of Supervisors to review the
emergency action and to determine that there is a need to continue the action,

III. BAS,
A. Can Tuesday, September 19, 2000 the Kathabar dehumidification system at the Richmond Health
Center failed, causing Kathene solution and condensation to drip from the ceilings and the
HVAC system to be shut down. This resulted in the facility having to close until temporary
repairs could be made.
B. The existing system was originally installed in 1966 and is an unconventional system which is
difficult to maintain and repair, and does not provide adequate ventilation in a significant portion
of the building. A complete new modem energy efficient HVAC system needs to be installed
since the system can now only operate at 50%capacity and may fail again.
C. 1t will be necessary to relocate all, or at least a portion of, the operations of the facility to
temporary space in order to accomplish the work in an efficient manner and to avoid disruption
during construction.
D. The replacement of the HVAC system is vital to Health Services' ability to deliver health care
and treatment services to their patients, and is therefore necessary for the life, health, welfare,
and safety of the citizens who rely on Health Services .for critical health care services and
medical treatment.
E. To reduce the remodeling construction schedule so that the work can be completed before spring,
the County Administrator and Health. Services recommend a finding that an emergency exists
that will not permit the delay resulting from a competitive solicitation for bids, and that Board
action is necessary to respond to the emergency.
