BARRY, AICP ''' Costa COMMUNITY DEVELOPMENT DIRECTOR - County DATE: September 19, 2000 SUBJECT: Amendment to Joint Powers Agreement governing the Eastern Contra Costa Transit Authority SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Approve and authorize the Chair to sign an amended Joint Powers Agreement governing the Eastern Contra Costa Transit Authority (ECCTA), as requested by ECCTA. FISCAL IMPACT None. BACKGROUND/REASONS F=OR RECOMMENDATIONS The Eastern Contra Costa Transit Authority provides bus service in East County under the name of Tri Delta Transit. The County is one of the participating jurisdictions in the ECCTA Joint Powers Agreement ECCTA recently amended the Joint Powers Agreement to allow the City of Oakley into the annual rotation for chair of the ECCTA Board of Directors. This is the only change being proposed for the Joint Powers Agreement. The change will not impact the County's participation, dues, or any other aspect of the agreement. ECCTA seeks approval of the amendment by its member jurisdictions. The amended Joint Powers Agreement is attached, with County Counsel's signature attesting as to the form of the agreement. Staff recommends the Board of Supervisors approve the amendment and authorize the Chair to sign the amendment. Following signature, the amendment will be transmitted back to ECCTA per their request. Exhibit A includes a letter from ECCTA General Manager Jeanne Krieg and the proposed amendment to the Joint Powers Agreement. Would you please submit this amendment of the JPA to your Board of Supervisors for approval at their next meeting and return all six originals to us, signed by your County Counsel, your Board of Supervisors Chair and your County Clerk. Sincerely, Jeanne Krieg General Manager Tri Delta Transit/ Eastern Contra Costa Transit Authority Enc: 6 copies of the First Amendment to the Restated Joint Powers Agreement Establishing the Eastern Contra Costa Transit Authority JK:am ftecycfed Paper • C FIRST AMENDMENT TO BYLAWS OF THE EASTERN CONTRA COSTA TRANSIT AUTHORITY WHEREAS pursuant to the First Amendment to the Restated.Joint Exercise of Powers Agreement Establishing Eastern Contra Costa Transit Authority dated ,2000(""JPA") the County of Contra Costa,the City of Antioch,the City of Brentwood,the City of Pittsburg,and the City of Oakley(hereinafter""members"),have amended the JPA to admit the City of Oakley as a member of the Eastern Contra Costa Transit Authority;and WHEREAS the parties desire to amend the Bylaws of the Eastern Contra Costa Transit Authority("Bylaws")to add the City of Oakley as a member; NOW,THEREFORE,Section 3.02 of the Bylaws is hereby amended to read as follows: 3.02 APPOINTMENT AND TERM OF OFFICE. Each Director and alternate shall be appointed to a two-year term of office. A Director or alternate may be an elected or other public official or a private person. If,during his/her term of office,a Director or alternate resigns,dies,is replaced by the appointing member or in the case of the Director-at-Large,the other directors,or otherwise ceases to represent the appointment member,the appointment member shall appoint a new Director or alternate to serve the unexpired balance of such term of office. Directors' and alternates'terms of office shall be staggered so that one- half of the terms expire each year. Except as amended herein,the Restated Joint Powers Agreement Establishing the Eastern Contra Costa Transit Authority dated May 21,1996 remains in full force and effect.
