County DATE: January 12, 2000 SUBJECT: LEGISLATION: SB 1333 (SHER) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ADOPT a position in SUPPORT of SB 1333 (Sher)which would extend until January 1, 2015 the sunset date on the imposition of the $1 surcharge on vehicle registrations to fund the abandoned vehicle abatement program. BACKGROUND: This County has implemented a service authority for abandoned vehicles and has been collecting the $1 surcharge on vehicle registrations for a number of years. Current law provides that the surcharge can only be imposed for a period of ten years from the date the surcharge was initially collected. Different counties implemented the abandoned vehicle legislation on various dates so the sunset date will impact them at different points in time. Senator Byron Sher has introduced SB 1333 to extent that time period to January 1, 2015 for all counties. As can be seen from the attached data, the $1 surcharge currently generates over$800,000 annually. The majority of the money goes to the cities because of the formula for distribution of the funds. However, the County receives over $100,000 annually which supports the Sheriffs abandoned vehicle program. in the past year over 6,000 cars have been towed under this program countywide. It is recommended that the Board go on record in support of SB 1333 so that we can continue to operate this valuable program. Gregory Subject: ABANDONED VEHICLE FIGURES Per your request attached are the figures for monies received and vehicles removed by members of the Abandoned Vehicle Service Authority. There are 19 members of the Authority which includes the 18 cities and the county. Attached is a copy of the allocation figures used to distribute the monies received from the state. All of the members of the service authority would support their legislation sponsored by Senator Sher. The Abandoned Vehicle Abatement Program is a highly support effort of citizens. Many feel that their removal helps maintain property values. Should you require additional information on the this matter, please advise me. LEGISLATIVE COUNSEL'S DIGEST SB 1333, as introduced, Sher. Abandoned vehicle fee. Existing law, in addition to other fees imposed for the registration of a vehicle, authorizes service authorities to impose an additional fee of $1, and continuously appropriates the money to fund specified vehicle abatement programs. These provisions are required to terminate not later than 10 years from the date that actual collection of the fee commenced. This bill would extend the termination date for the fee collection until January 1, 2015, and would extend the fee and continuous appropriation until that date, thereby making an appropriation. Vote majority. Appropriation; yes. Fiscal committee: yes. State-mandated local program: no. The people of the State of California do enact as follows: 1 SECTION 1. Section 9250.7 of the Vehicle Code is 2 amended to read 3 9250.7. (a) A service authority established under 4 Section 22710 may impose a service fee of one dollar ($1) 5 on vehicles registered to an owner with an address in the 6 county that established the service authority. The fee 99 SB 1333 —2- 1 -2-1 shall be paid to the department at the time of registration, 2 or renewal of registration, or when renewal becomes 3 delinquent, except on vehicles that are expressly 4 exempted under this code from the payment of 5 registration fees. 6 (b) The department, after deducting its 7 administrative costs, shall transmit, at least quarterly, the 8 net amount collected pursuant to subdivision (a) to the 9 Treasurer for deposit in the Abandoned Vehicle Trust 10 Fund, which is hereby created. All money in the fund is 11 continuously appropriated to the Controller for 12 allocation to a service authority that has an approved 13 abandoned vehicle abatement program pursuant to 14 Section 22710, and for payment of the administrative costs 15 of the Controller. After deduction of its administrative 16 costs, the Controller shall allocate the money in the 17 Abandoned Vehicle Trust Fund to each service authority 18 in proportion to the revenues received from the fee 19 imposed by that authority pursuant to subdivision (a). If 20 any funds received by a service authority pursuant to this 21 section are not expended to abate abandoned vehicles 22 pursuant to an approved abandoned vehicle abatement 23 program within 90 days of the close of the fiscal year in 24 which the funds were received and the amount of those 25 funds exceeds the amount expended by the service 26 authority for the abatement of abandoned vehicles in the 27 previous fiscal year, a fee imposed pursuant to subdivision 28 (a) shall be suspended for one year, commencing the 29 following January 1. 30 (c) The fee imposed by a service authority shall 31 remain in effect 32 thm the ..yde4 eelleetien f the f eemmeneed until 33 January 1, 2015.
