Financial Impact: There is no impact on the General Fund. The various park districts throughout the unincorporated areas impacted by this action will fund this action. III. Reasons for Recommendations and Background: In a number of the County's larger neighborhood parks, various youth sports teams/leagues have been monopolizing use of these park facilities for their practices and games. Neighbors have voiced concerns about these sports groups dominating use of these parks after school and all day on weekends. Additionally, with practice fields at a premium, these sports groups vie with each other for use of these parks. Contra Costa County's park system consists of eleven(11)neighborhood parks varying in size from 2 to 16+ acres,three (3) community centers, six(6) tot lots ranging in size from 1/4 acre to 1/3 acre, and one (1) 2 1/2 mile long urban trail (see attached County parks brochure). Funding for the maintenance and operation of these facilities is derived from a variety of sources such as assessment districts, user fees, and taxes. The County's Public Works Department is responsible for the maintenance and operation of these facilities. Staff contacted various city recreation departments throughout the County to: 1) ascertain if they had similar issues in their parks, and 2)to gather information about solutions they developed to address the various user needs. Generally, youth sports leagues were not charged for use of the park facilities. However, these groups were required to apply for a permit, abide by the rules outlined on the permit and furnish a Certificate of Insurance naming the public entity as additional insured. Permits were generally for a 2 to 3 hour period of time. Requests for use for a longer duration were required to furnish portable restroom facilities at their expense. Staff recommends adoption of a new article to the County Ordinance Code requiring groups of 20 or more persons and sports leagues to obtain a permit(see attached "draft" Permit) from the Public Works Director for use of a County signposted park. Youth sports groups will be required to provide a Certificate of Insurance. Private groups comprised of 20 or more individuals will not be required to provide a Certificate of Insurance. Youth sports groups are generally affiliated with a larger national/state-wide sports organization and can easily and affordably obtain insurance coverage. Private groups of 20 or more individuals may not have this type of insurance availability. Staff further recommends approval to signpost all current and future Contra Costa County parks (see attached sample sign). SUBJECT: INTRODUCE ORDINANCE REQUIRING PERMITS FOR GROUP USE OF COUNTY PARKS AND FIX FEBRUARY S,2000,FOR ADOPTION OF ORDINANCE AND POSTING OF SIGNS AT COUNTY PARKS(Countywide) DATE: JANYTARY 18, 2000 PAGE 3 IV. Consequences of Negative Action: Implementation of this new article to the County Ordinance Code will provide for a more equitable use of County parks. Without passage of this article, youth sports leagues will continue to dominate use of County parks to the exclusion of other users. A negative action would force local individual residents to continue to clash with organized sports leagues for use of their neighborhood park. Without posting a sign at each County park, this and other County Ordinance/s that are pertinent to the County's parks, cannot be enforced. ORDINANCE NO. 99- REQUIRING PERMITS FOR GROUP USE OF COUNTY PARKS SECTION 1. SUMMARY. This ordinance adds Article 1114-2.10 to the County Ordinance Code, to require groups of 20 or more persons and sports leagues to obtain a permit from the Public Works Director to use a signposted park. SECTION IL Article 1110-2.10 is added to the County Ordinance Code, to read: Article 1110-2.10 Permits for Groups, Sports Leagues 1110-2.1002 Permit Required. Groups of 20 or more persons and organized sports leagues may use a signposted park only pursuant to a permit issued by the Public Works Director. (Ord. 99-_, § 2.) 1110-2.1004 Public Works Director. The Public Works Director is authorized to develop terms and conditions for the issuance of permits for the use of a signposted park. (Ord. 99-_, § 2.) SECTION IIL EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times, a newspaper published in this County. Rain, wet field: Permittee may not use the Premises for sports activities, including practice, if it is raining or the field is wet. Use of a wet field can cause severe damage to the field. County will not mow the field in inclement conditions;therefore,the field may not be mowed on the dates and times noted in Paragraph 1, above. 8. Permittee and all persons attending the County Park pursuant to this permit shall comply with all applicable laws, including those laws signposted in the County Park. 9. Permittee and all persons attending the County Park pursuant to this permit shall not commit,or suffer to be committed, any waste upon the County Park and its facilities,or any nuisance or other act or thing which may disturb the quiet enjoyment of the use of the surrounding property. 10. County reserves the right to cancel this permit at any time for any reason or no reason, including,but not limited to, emergency, casualty,damage to facility or violation of any term or condition of this permit, including, but not limited to,time limitations. DRAINAGE AREA LOCATION AND DESCRIPTION Drainage Area 520 was formed on December 1, 1987, and is located in the vicinity of the Laurel Road crossing of Marsh Creek in the City of Oakley. The existing site is bounded on the south by Laurel Road, west by Marsh Creek and east by the Atchison, Topeka and Santa Fe Railway and is comprised of two subdivisions, Tracts 5946 and 6819. The exact location is shown on Contra Costa County Flood Control and Water Conservation District Drawing No. D-12574. The proposed annexation of pending Subdivision 6963 (Delta Isle) to Drainage Area 520 will extend these boundaries to the south by 36.28 acres. A boundary description is attached as Exhibit „A„ 3. REASONS FOR THE ANNEXATION The area of the proposed annexation consists of 36.28 acres of land, which includes one pending subdivision, Tract 6963. The subdivision will create 197 single-family residential parcels that vary in size from 4000 square feet to 8999 square feet. The impervious surface created by the subdivision will decrease storm water infiltration into the soil and increase the storm water runoff rate. If the increased flow is allowed to drain into Marsh Creek without some form of mitigation, there is a potential that the capacity of the creek would be exceeded and flooding will occur. As a mitigation measure, the developer will excavate a detention basin within the project area to regulate the storm water flowing into Marsh Creek. The detention basin requires annual maintenance to ensure that it operates as designed. It is, therefore, equitable in the opinion of the Flood Control District that all properties benefiting by the existence of the detention basin pay a fair share toward its annual maintenance. The annexation to Drainage Area 520 provides a legal entity under which the benefit assessment for maintenance of the detention basin can be levied, after a vote has been taken. 4. FACILITIES TO BE MAINTAINED Funds collected under the benefit assessment for Drainage Area 520 from Subdivision 6963 will be used for maintenance of the detention basin including its access road. Basin maintenance will also cover silt removal, embankment repair, and other scheduled maintenance type activities. 2 5. ESTIMATE OF MAINTENANCE COST The annual maintenance cost for the detention basin is estimated to be $ 12,000.00. The breakdown of the cost is enumerated below: 1. General Cleanup and Right of Way $ 6,000 Maintenance 2. Desalting $3,000 3. Inspection & Storm Patrol $1,000 4. Embankment & Outlet Control Structure Repair $2,000 Total Annual Maintenance Costs $12,000 6. BENEFIT ASSESSMENT For Subdivision 6963, the annual benefit assessment per lot, on the average, is approximately $65.00. Below is the information about the benefit assessment for this development: A. Annual Maintenance Benefit Assessment: The impervious surface that will be created by Subdivision 6963 is approximately 545 Impervious Area Units (1 IAU = 1,000 square feet) based on information on file in the Flood Control District office. The annual maintenance cost assigned to each IAU is $22.02 ($12,000 divided by 545 IAU). This results in an annual levy of approximately $65 per lot. The exact levy per lot is listed in Table A. B. Reserve Fund: To provide adequate funding for unscheduled maintenance or contingencies, it is recommended that a reserve fund equal to five times the estimated annual maintenance cost be established. For Subdivision 6963, this,reserve fund will be $60,000.00. The reserve fund will be reached by levying a benefit assessment of one and one- half (1.5) times the annual rate but not less than $33.03 per IAU. The $33.03 annual levy per IAU should be implemented until the reserve fund of$60,000.00 is established. 3 The reserve fund would provide immediate funding for unscheduled maintenance such as: 1. This could result in the basin being left in an unsightly condition, which could have a negative impact on adjacent dwellings. Should unscheduled maintenance or contingency charges reduce the reserve fund below the above-recommended amount, the reserve should be restored by increasing the annual levy per IAU to one and one-half (1.5) times the estimated annual rate. C. Maximum Assessment During a storm of unusual duration or intensity, or during storms that closely follow each other, the detention basin and basin structures could be damaged. This damage would be in addition to that requiring unscheduled maintenance as outlined under B. We estimate the cost for repair of damage due to unusual storms to be $70,000.00. It is recommended that the maximum benefit assessment used in the formation of Drainage Area 520 be adopted for this annexation. Those rates are shown in Table A. The only change made is the addition of a maximum assessment for lot sizes in the 8000 to 8999 square feet range. This lot size range was not covered in the report for the formation of DA 520 since there was no lot size in that range for the two previous subdivisions. The maximum benefit assessment for lot sizes ranging from 8000 to 8999 square feet is $ 115.02 (i.e., 3 times 3.23 times $11.87), which is consistent with the rate established in 1987. . The District appreciates the fact that the annual maximum benefit assessment being recommended appears high, and hopes that it never has to be levied. However, to allow a lower maximum assessment may result in the inability to make repairs in a timely manner. The maximum assessment shall be increased annually to account for inflation. 4 7. BENEFIT ASSESSMENT IMPLEMENTATION The annexation to Drainage Area 520 provides a vehicle for the maintenance of the detention basin and associated drainage structures. The annexation also provides that a levy be authorized by a vote of the various properties involved in the annexation. It is recommended that: 1) all new lots shall be assessed in the fiscal year following the filing of the final map creating said lots; 2) all existing lots that receive impervious surfaces shall be assessed in the fiscal year following the construction of impervious surfaces; 3) the maximum assessment to individual lots be established at $35.61 per IAU which matches the maximum annual assessment established for DA 520 in 1987 and is subject to annual increase due to inflation, 4) that a levy equal to one and one-half the annual maintenance amount be levied on the 197 lots within Tract 6963 until a Reserve Fund equal to 5 times the estimated annual maintenance cost has been created, and that after the reserve fund has been depleted the annual levy be increased by the factor of 1.5 to restore the reserve fund to its recommended amount; and 5) the developer of Tract 6963 shall reimburse the Flood Control District for all maintenance costs in excess of the revenue from levies assessed until such a time as 75 percent of the lots have been improved and these lots are paying the annual assessment. RECOMMENDATION It is recommended that the real property known as pending Subdivision 8104, Stevens Ranch, (Assessor's Parcel Number 220-080-022, Parcel B of Minor Subdivision 166- 77) in an unincorporated area of Contra Costa County be annexed into Contra Costa County Flood Control and Water Conservation District Drainage Area 1010, and that benefit assessments pursuant to Government Code Sections 54701 through 54718 be levied. 2. LOCATION: The drainage area is located in the Danville area. The area is bounded by the Blackhawk development to the north and the southern boundary of the West Branch development to the south. The east and west boundaries are approximately Hansen Lane and the Dougherty Hills ridge line, respectively. The specific location is shown on Contra Costa County Flood Control and Water Conservation District Drawing D- 12619. A boundary description of the area to be annexed is attached as Exhibit"A". 3. REASON FOR ANNEXATION: On May 10 1988, Drainage Area 1010 was established to provide a legal entity under which benefit assessments for maintenance of West Alamo Creek and the Bettencourt Detention Basin can be levied. The 13 lots of pending Subdivision 8104 will create new impervious surface. This will result in additional runoff that will drain into the detention basin. The basin provides flood protection benefit for the subdivision. It is equitable that all properties benefiting by the existence of the detention basin pay a fair share toward its annual maintenance. Therefore, Subdivision 8104 should be annexed to Drainage Area 1010. BENEFIT ASSESSMENT: The benefit assessments collected within Drainage Area 1010 are used only for maintenance and operation of West Alamo Creek,within the boundaries of the drainage area within the Flood Control District right-of-way limits, and the regional detention basin, also within its right-of-way. The annual benefit assessment amount for each Impervious Area Unit(one IAU equals 1,000 ftz) is the quotient of the total annual maintenance cost divided by the total IAU's in the drainage area. The annual benefit assessment for each lot is the product of the number of IAU's assigned to each lot times the annual benefit assessment per IAU. The annual benefit assessment is adjusted periodically to account for inflation and maintenance needs. The annual assessment cannot exceed $24.18 per IAU, the Maximum Assessment. The current fee is $2.00 per IAU, which equates to an average rate of$11.26/year per lot. Please refer to the Engineer's Report for the establishment of the Contra Costa County Flood Control and Water Conservation District Drainage Area 1010 approved by the Board of Supervisors on May 10, 1988 for additional information on the benefit assessment. 4. BENEFIT ASSESSMENT IMPLEMENTATION: It is recommended that Subdivision 8104 be annexed into Drainage Area 1010 to provide a vehicle for maintenance and operation of the regional detention basin, West Alamo Creek and creek improvements located within the drainage area. It is recommended that: (1) assessments on the new lots be levied in the fiscal year following the filing of the final map creating them; (2)the legislative body(Board of Supervisors)may annually determine the cost of the services financed by the assessment and,by ordinance or resolution, establish the amount of the assessment; (3) a portion of the assessment may be used for maintaining a reserve fund equal to five times the estimated annual cost of the services; and(4)the annual assessment established by the Board of Supervisors shall not exceed a maximum of$24.18 per IAU(1,000 square feet of impervious surface), as adjusted annually to account for inflation.
