The Public Works Director having reported that on June 4, 1996,the Board accepted a Grant
Deed of Development Rights from Louise Bisset (owner), as a requirement for Development
Number MS 64-87.
On the recommendation of the Public Works Director, IT IS BY THE BOARD ORDERED
that the Chairperson is AUTHORIZED to execute the following "Quitclaim Deed" of the
development rights to "West Coast Home Builders, Inc.", a California Corporation.
Being a portion of Parcel "B" as shown on the map of Subdivision MS 64-87, recorded in
Book 169 of Parcel Maps at page 16, Contra Costa County Records.
I hereby certify that this is a true and correct copy of an

For valuable consideration,receipt of which is hereby acknowledged, the County of Contra Costa,
a political subdivision of the State of California,hereby remises,releases and forever quitclaims to
West Coast Home Builders,Inc., a California corporation, all of its right,title and interest in the real
property, specifically"development rights"as defined in the deed to the County of Contra Costa,
recorded June 4, 1996, in Series No. 96-105523,Contra Costa County Records, State of California;
over those certain parcel of land, situated in Contra Costa County,being a portion of"Parcel"B,of

SUBJECT: Releasing Deficiency Deposit for Subdivision 7279, Danville area.
The Board on February 2, 1999, having accepted as complete the improvements in
Subdivision 7279, Danville area, with the exception of minor deficiencies for which a $7,500.00
deficiency deposit has been retained as follows: $1,800.00 cash deposit(Auditor's Deposit Permit
No. 326005, dated January 21, 1999, made by Barra Limited partnership along with the$5,700.00
cash deposit (Auditor's Deposit Permit No. 288308, dated December 26, 1996) made by Dame
Construction Company, Inc., all to insure correction of the outstanding deficiencies.
The Public Works Director having reported that the aforesaid minor deficiencies have been
corrected and having recornmended that he be authorized to refund the$5,700.00(Auditor's Deposit
Permit No. 288308, dated December 266, 1996 plus interest in accordance with Government Code
section 53079, if appropriate, to Dam6 Construction Company, Inc., and the $1,800.00 (Auditor's
Deposit Permit No. 326005, dated January 21, 1999)plus interests, if appropriate, to Barra Limited
Partnership.

The Flood Control District on March 31, 1999 contracted with C.A. Rasmussen, Inc., for placing rock
slope protection, constructing gabion wall and concrete wall, drop structure and channel, with American
Home Assurance Company as surety, for work to be performed on the grounds of the County; and
The Chief Engineer reports that said work has been inspected and complies with the approved plans,
special provisions and standard specifications and recommends its acceptance as complete as of
December 29, 1999.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

Additional funding is needed to pay the contractor for but not limited to delay incurred during
the start of the contract waiting for approvals from the Department of Fish and Game;
subsurface conditions; overtime incurred to complete the project by the specified date; and
other items included on Contract Change Orders 1 through 10.
IV. Consequences of Negative Action:
The lack of approval would preclude payment for work that was performed by the contractor

The activity is funded by Developer Fees (100%).
III. REASONS FOR RECOMMENDATIONI'BACKGROUND:
The purpose of the activity is to annex 13 lots of Subdivision 8104 into Drainage Area 1010.
Runoff from new impervious surface created by Subdivision 8104 will drain into the Bettencourt
Detention Basin, which will provide flood protection. In 1988 Drainage Area 1010 was created
to provide a legal entity under which benefit assessments for maintenance of the basin can be
levied. The annexation will provide funds to maintain the detention basin.
It can be seen with certainty that there is no possibility that the activity may have a significant
adverse effect on the environment. The activity has been determined to be in compliance with
the General Plan
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize
funding.

pursuant to Article 5, Section 15061 (b) (3) of the CEQA Guidelines.
It can be seen with certainty that there is no possibility that the activity may have a
significant adverse effect on the environment.
DESCRIPTION OF THE ACTIVITY:

8104, County File #CP 9949 . Project Description: The purpose of the activity is to annex 13 lots of
Subdivision 8104 into Drainage Area 1010. Runoff from new impervious surface created by Subdivision 8104
will drain into the Bettencourt Detention Basin, which will provide flood protection. In 1988 Drainage Area
1010 was created to provide a legal entity under which benefit assessments for maintenance of the basin
can be levied. The annexation will provide funds to maintain the detention basin. Project location: The
existing Drainage Area 1010 is located in south county in the Blackhawk area, near the Town of Danville.
The area to be annexed is located south of the northeast area of the existing Drainage Area 1010, north of
Camino Tassajara, and west of Lawrence Road. (Figures 1-4).
