4. The parameters of the project shall be limited to a seven-story office building and a
parking garage.The office uses shall be limited to 180,000 sq.ft and the ground floor retail
uses shall be a minimum of 15,000 sq.ft. The parking garage shall include retail uses on the
ground floor along Oak Road. Office or retail uses may be included on the second and third
floor parking garage frontage. The remainder of the parking garage shall include a"false
front"on the east,north and west facades.

The applicant shall participate in a design review process with representatives from the
Walden District Improvement Association, Fox Creek Residential Association, and the
Madison Owners Association. The purpose of the design review process is to develop a joint
recommendation to the Board of Supervisors on the design of the project. The design review
process shall address the exterior design, building placement footprints; a design that
involves engagement of the street; issues of setbacks and variances; the concept of pedestrian
friendly streetscape and internal circulation.
The final design of the proposed project is subject to the review and approval of the Board
of Supervisors.
6. Prior to the issuance of a building permit,detailed elevations and architectural design of the
buildings, and pedestrian and bicycle circulation system,consistent with the design approved
by the Board, building roofing materials; and sign program shall be submitted for final review
and approval of the Board of Supervisors
hearift. The roofs and exterior walls of the buildings shall be free of such objects as air
conditioning or utility equipment,television aerials, etc., or screened from view. The applicant
shall work with the hotel developers in preparing the preliminary drawings for the
"artwork" at the corner of Buskirk and Oak Road.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On January 21, 1999, an application was filed for approval of a development involving 235,000
sq, ft. of office space in a seven story building, 15,000 sq. ft. of retail space and a parking structure.
The project was later revised increasing the office building height from seven stories to nine stories.
On September 28, 1999,the County Planning Commission heard this item on September 28, 1999.
After taking testimony,the Commission approved the.final development plan,subject to the staff
recommendations(reduce office building height to seven stories and 180,000 sq.ft.,increase retail uses
to 15,000 sq. ft.,etc.)and revised Conditions of Approval.
In a letter dated October 8, 1999, Walden District Improvement Association, Fox Creek
Residential Association and Madison Owners Association appealed the Planning Commission's
decision to approve the project. Listed below is a summary of the points contained in the
appellant's October 8, 1990 letter and staff's response to each point.
On December 14, 1999,during the scheduled appeal hearing,the appellants withdrew their appeal and
the applicant agreed to go through a design review process with neighborhood representatives. The
Board directed staff to come back on January 11,2000 with revisions to Conditions of Approval #4
and 6 related to the final review and approval of the project design. The Board further directed that the
final design review be determined by the Board on January 25,2000.
The revised Conditions of Approval are included herein. Condition of Approval#4 presumes the
parties will be able to develop some consensus on the project's design. In the event a joint
recommendation cannot be forged,the Board of Supervisors may wish to approve the final design
of the building or provide finiher direction to staff or the applicant. Condition of Approval #6
requires a final sign-off by the Board of Supervisors. Since the detailed elevations and
architectural design must be consistent with those previously approved by the Board, the Board
may wish to defer the final approval to either the County Zoning Administrator or the Planning
Commission, as an alternative.
FISCAL IMPACT
None,the applicant pays all costs associated with processing the application.
