Pursuant to the Government Code (§§ 27640 ff.), the term of the current incumbent
of the Office of County Counsel is hereby extended to January 31, 2001 and shall expire on that
date unless sooner terminated.
After February 29, 2000 and before January 1, 2001, the current incumbent may
choose and receive a second vacation buy back reimbursement pursuant to section P (pages
19 and 20) of Part IV of Exhibit C of Resolution No. 99/655 notwithstanding any contrary
provision of Resolution No. 99/655 (as adopted or amended prior to January 1, 2001). Should
this second vacation buy back reimbursement be taken prior to January 1, 2001, the current
incumbent shall not be entitled to any vacation buy back reimbursement during calendar year
2001.

implementation of the "high priority actions" recommended by C.S.I. Telecommunications, Inc. The County
Administrator's Office in conjunction with the County Telecommunications Division is currently proceeding with
the delineation of specifications for the required work, as well as the identification of appropriate vendors to
complete the work.

BACKGROUND:
On 8/10/99 the janitor discovered the broken kitchen door at 8:00 a.m. The door from the kitchen/staff
room to the meeting room had been shouldered or kicked in. Antioch police were called. When staff
arrived about 9:00 a.m. it was discovered that the padlocked locker in the staff room containing the
library's money had been broken into and all of the money stolen. Denalect Alarm had reported the
alarm had gone off on Monday 8/9/99 at 8:17 p.m., but police found nothing suspicious from the outside
of the building.

SUBJECT: Library Report of Shortage and Request for Relief of Accountability
We have reviewed the attached report of the break-in into the Antioch library, which resulted in a loss
of$276 undeposited collections and revolving funds, and the request for discharge from accountability
for these funds.
The Library has since improved its closing procedures to mitigate control weaknesses that precipitated
this loss. In our opinion, implementation of the security measures will deter reoccurrence of the events
that resulted in this loss.
In accordance with the provisions of Administrative Bulletin 207.6, since amount of loss exceeds $250
the matter should be presented to the Board of Supervisors for action. We recommend that the Board
of Supervisors grant relief of shortage and accountability for these funds.

I received a call at home from the Antioch police Dept about 8:35am. They said the janitor had
reported that the kitchen door had been kicked in and would I come down and see if anything had been
taken. At gam,the rest of the staff also arrived at work(Confetti,Bryant,Johnson,Shipe). Nothing had
been disturbed except the padlocked locker in the staff room containing the library's money had been
broken into and all of the money stolen.
Apparently the outside meeting room door was shut,but not latched tightly. Someone came into the
meeting room. Then threw their shoulder/weight at the kitchen r breaking the door frame and
forcing the door open. There was no damage to the door or signs of it being kicked. Then they kicked
the padlock and the handle off the bottom locker marked pat. The door was dusted for fingerprints,but
no luck. However,all of the broken pieces and the padlockwere not on the floor and no where to be
found. A gray metal money box(about 41/2"x1111x7") with about$20 in Friends Booksale money was
taken. Also a brown vinyl zippered pouch with$96.64 in CCC Library money/checks from 8/6 and 8/7.
Also a blue vinyl zippered pouch with$50 daily money and an unknown amount from 8/9. Also a
red/white Tupperware container with$40 Xerox machine change. Total cash about$206-$256. There
were padlocks on 4 other staff lockers,but they were not broken into.

SUBJECT: REQUEST ENVIRONMENTAL HEALTH DEPARTMENT AND COUNTY COUNSEL
TO REVISE CONTRA COSTA CODE SECTION 428-6.589 RELATIVE TO
SUBDIVISIONS AND INDIVIDUAL SEPTIC SYSTEMS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)AND JUSTIFICATION
RECOMMENDED ACTION:
1. Request Environmental Health Department and County Counsel to revise Contra Costa County Code
Section 420-6.509 to eliminate the requirement for a government agency to be formed to provide
oversight for the use of an alternative sewage system. Further request that the revised code section
be brought back to the Board no later than January 25, 2000 for commencement of the necessary
legal hearings required to implement the revised code.
2. Request that the Environmental Health Department provide a status report on revisions to the County's
septic ordinance, including a timeline for public hearings on the draft ordinance prior to its
consideration by the Board of Supervisors.
BACKGROUND INFORMATION:
The current code for subdivisions states "that the health officer shall not consider or approve ...use of a
alternative sewage disposal system for a subdivision, outside of an existing incorporated city, or sanitary or
sanitation district, unless a governmental agency is formed, which agency shall have the authority and
responsibility to install and maintain such system."
We have encountered a situation where, due to this code, the property owners have had to request
annexation to a non-contiguous sanitary district, just to get their subdivision map recorded. This then negates
the alternative system, as the sanitary district will require hook-up to their system and extremely significant
cost because the existing system is far away from this location. The property owner is now in danger of losing
their property. In fact, alternative systems are now being allowed on individual lots by the Health Department,
subject to certain requirements. The current code places property owners in a catch-22 situation.
Residents and contractors alike in East Contra Costa County have encountered significant problems in
obtaining septic permits dating back over the last decade. Some of the problems have been related to the
property itself; however, many of the problems have been directly attributable an outdated County code which
did not allow for alternative systems, or placed substantial restrictions, as well as to the process employed by
the County in granting and processing septic applications.

In 1992 the Board provided specific direction to the County Health Department to establish a task force
comprised of property owners, as well as contractors, to identify specific problems with the septic process.
The Board requested that the Health Department immediately pursue modification to the current code,
particularly the use of alternative systems.
To date, these actions have not been completed. Throughout this almost decade long process, homeowners
have continued to experience difficulties obtaining septic permits, particularly in the East County agricultural
areas.

SUBJECT: REQUEST THAT THE BOARD RECONSIDER ADOPTING AN ORDINANCE
ALLOWING FOR THE IMPLEMENTATION OF PROPOSITION 90 RELATIVE TO
PROPERTY TAX TRANSFERS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)AND JUSTIFICATION
RECOMMENDED ACTION: Request that the Board of Supervisors reconsider adoption of an
ordinance allowing for the implementation of Proposition 90 relative to property tax transfers. Refer
this issue to the Finance Committee and, request that staff prepare a preliminary report evaluating
the budgetary impact of re-adopting this ordinance for the Finance Committee's next agenda.
BACKGROUND INFORMATION: In March 1989 the Board of Supervisors adopted Ordinance 89-25
allowing for the implementation of Proposition 90, implementing provisions of a state ballot measure
which allowed the transfer of base property tax values for those over 55 moving from another county
into Contra Costa County and amended Chapter 66-10, Taxation of Replacement Residences, The
Board subsequently repealed Chapter 66-10 by the Board in 1993.
There have been a number of"over 55" developments constructed in Contra Costa County,
and my office has received several inquiries from incoming residents who were either not aware that
this ordinance had been repealed in our County, and are simply inquiring why it is not in effect.
I believe it is appropriate to revisit this issue.
