1. RECOMMENDATION
APPROVE a Lease, commencing October 1, 1999, with the Holmgren Partnership for the
premises at 2371 Stanwell Drive, Concord, for continued occupancy by the Employment and
Human Services Department, under the terms and conditions more particularly :set forth in said
Lease, and AUTHORIZE the Director of General Services to EXECUTE said Lease on behalf of
the County.
DETERMINE that the above project is an activity not subject to the California Environmental
Quality Act.
DIRECT the Community Development Department to FILE a Notice of Exemption with the
County Clerk.
11. FINANCIAL IMPACT
Payments required are to come from the budget of the Employment and Human Services
Department.

RECOMMENDATION:
ADOPT the attached schedule of Board meetings in 2000, at which meetings it is
anticipated that there will not be a quorum of Board members present as well as
noting two special events which have been scheduled, the Martin Luther King, Jr.
Celebration on January 18, 2000 and Cesar Chavez Celebration on April 11, 2000.
BACKGROUND:
Each year the Board adopts a schedule indicating those Board meetings that are
anticipated not to be held because a quorum of the Board will not be present. These
generally include those Tuesdays that fall in a week with a County holiday, the fifth
Tuesday of a month, the last two Tuesdays in August, and the Tuesday which falls
in the week of the Annual Meeting of the California State Association of Counties.
Such a schedule has been prepared and is recommended for the Board's adoption.
Supervisor Gerber has asked that the cancellation of the November 28, 2000 Board
meeting be considered tentative at this time because it may be necessary to hold
that meeting.

DETERMINE that there is a need to continue the emergency action taken by the Board on August
10, 1999 pursuant to Public Contract Code Sections 22035 and 22050, to complete the Juvenile Hall
Renovation, Tamalpais Wing project at 202 Glacier Drive, Martinez.
FINANCIAL. IMPACT
Funding for this project has been budgeted. Per the Board's authorization on August 10, 1999,
County Counsel is pursuing appropriate legal remedies against Patrick M. Donaghue, Insurance
Company of the West and any other parties responsbile for damages and expenses incurred by the
County in excess of the previous construction contract balance.
BACKGROUND
1. On December 1, 1998, the Board awarded the construction contract for the Juvenile Hall
Renovation, Tamalpais Wing (Tamalpais) project, located at 202 Glacier Drive, Martinez to
Patrick M. Donaghue (Donaghue) for $1,034,570. The contract required the placement of a
considerable amount of exposed concrete within specified tolerances, consistent with industry
standards.
2. Donaghue performed extensive concrete work that was seriously defective. The resulting work
threatened to compromise the security and appearance of the facility. Donaghue repeatedly
failed to either remove the defects or develop a viable plan for their correction. On August 10,
1999, the Board declared Donaghue to be in material breach and ter ina ona hue's rights
under the contract. f`

3. On August 10, 1999, the Board declared that, due to the public safety threat posed by the
temporary closures at the project, and due to the possible loss of state grant funding, a state of
emergency exists. Furthermore, the Board delegated authority to the County Administrator or
designee to complete the project and to enter into contracts without the need to re-solicit
competitive bids.
4. The County received the bonding company's (Insurance Company of the West, "ICW') response
to the County's claim on November 5, 1999. In its response, ICW recognized the seriousness of
the defective work and recognized that it likely will cost the County at least $510,985.05 over and
above the contract price to fix the defective work. Despite this, ICW gave two unreasonable
alternatives to the County—either accept back the original contractor (Donaghue) who did the
defective work or accept a "low ball" payment of $118,004.31. IOW's bad faith response
amounts to a rejection of the County's claim. Therefore, the County is left with no viable choice
but to hire its own contractor to properly complete the contract work in strict accordance with the
plans and specifications. This will involve removing the defective construction down to the slab
and rebuilding the concrete from that point up.
5. On November 30, 1999, the County Administrator's Office executed a contract with Taber
Construction of Martinez for the completion of the project, and issued a Notice to Proceed
effective December 6, 1999. The contract amount is $1,198,435, and the contract duration is
150 calendar days.

BACKGROUND:
Section 104.6 of the Streets and Highways Code authorizes the State Department of
Transportation to lease any lands it holds which are not presently needed for State highway
purposes and provides that 24 percent of such rental revenue shall be allocated pursuant to
Section 104.10. Section 104.13 provides that all funds distributed to the County shall be
deemed to be in full or partial payment of the possessory interest taxes due on such leased
properties. The recommended distribution is in accordance with these State laws.

DETERMINE that there is a need to continue with the emergency action taken by the
Board on November 16, 1999 regarding the issue of homelessness in Contra Costa
County.
BACKGROUND:
On November 16, 1999, the Board of Supervisors declared a local emergency,
pursuant to the provisions of Government Code Section 8630, on homelessness in
Contra Costa County.
Government Code Section 8630 required that, for a body which meets weekly that
the need to continue the emergency declaration be reviewed at least every 14 days
until the local emergency is terminated. In no event is the review to take place more
than 21 days after the previous review.
With the winter weather arriving and with no additional resources having been able
to be placed on line to assist in sheltering homeless individuals and families, it is
appropriate for the Board to continue the declaration of a local emergency regarding
homelessness.

declaration action taken by the Board on December 14, 1999 regarding HIV/AIDS
and Hepatitis C in Contra Costa County.
BACKGROUND:
On December 14, 1999, the Board of Supervisors declared a local public health
emergency, pursuant to the provisions of Government Code Section 8630, on
HIV/AIDS and Hepatitis C in Contra Costa County.
Government Code Section 8630 required that, for a body which meets weekly that
the need to continue the emergency declaration be reviewed at least every 14 days
until the local emergency is terminated. In no event is the review to take place more
than 21 days after the previous review.
HIV/AIDS and Hepatitis C continue to be serious threats to the public health in
Contra Costa County and until the Board has evidence that the prevention steps
being taken are working to reduce the threat of HIV/AIDS and Hepatitis C, it is
appropriate for the Board to continue the declaration of a local public health
emergency regarding HIV/AIDS and Hepatitis C.

1. AGREE to continue to contract with Community Alert Network (CAN) for the
automated telephone dial emergency alert system, a component of the
Community Warning System.
2. DIRECT the Health Services Director to work with the community and
community-based organizations representing immigrant groups in all areas of
the County where there are significant non-English speaking populations to
develop lists of telephone numbers of non-English speaking individuals.
3. DIRECT the Health Services Director to work with CAN to implement discrete
language messages for those groups of non-English speaking individuals
where it has been possible to develop lists of telephone numbers which
should receive an alert message in a specific foreign language.
4. DIRECT the Health Services Director to report to the 2000 Internal Operations
Committee in May, 2000 on the status of the implementation of the above
recommendations, and for that purpose REFER this subject matter to the
2000 Internal Operations Committee.

BACKGRgUND:
On May 4, 1999,the Board of Supervisors referred to our Committee the issue of the
Community Alert Network/Community Warning System. Our Committee has been
concerned about whether CAN was state-of-the-art in terms of the number of
telephone calls which can be placed at the same time and how many can be
accepted at the same time by the telephone company. Our Committee agreed that
a nationwide solicitation should be made to see what other companies there are that
provide a similar service and whether another firm might be better able to meet our
needs. An additional problem raised by representatives of the Laotian community
in West County is the fact that, currently, the CAN system can only send messages
in English. Cour Committee agreed to include in the Request for Information (RFI)
questions about the ability of the firm to transmit messages in languages other than
English. We asked that the RFI be circulated to the Laotian and other community
organizations for their comments before returning it to our Committee for approval.
On September 27, 1999 our Committee approved and agreed to the release of the
RFI. Can December 13, 1999, the Department reported back on the results of the
RFI and recommended that we continue to contract with CAN. Staff also reported
that CAN maintains that it can issue messages to any number of languages.
However, to successfully do that, it will be necessary to identify individuals who do
not speak English, identify their address, telephone number, and the language they
speak and then provide that information to CAN. It will,of course, also be necessary
to update that information regularly to insure that it remains accurate. The problems
here may be more one of getting the cooperation of the community and particularly
community-based organizations that work with immigrants than it is with the
technology of providing messages in an individual's native language.
We have, therefore, agreed to make the above recommendations to the Board of
Supervisors in the form of a status report. We believe that the 2000 Internal
Operations Committee should receive an update in May and provide additional
direction to the Department at that time.

Subj : Report on the Request For Information(RFI) Emergency Telephone
Ring-Down System
On 27 SEP 99 the Internal Operations Committee directed the Health Department to send
out a Request For Information(RFI)for the County's Emergency Telephone Ring-Down
System. This was done to evaluate the present status of our current system and to gather
information on the ability of providers of this kind of service to deliver community
notification messages in other languages. This is the Report on that RFI.
The RFI was discussed at our last meeting with suggested changes going into the
document that was mailed on 11 OCT 99 with a return date of 5 NOV 99(see ATTACHs
I&II). A list of six(6)vendors was compiled to whom the RPT was mailed(see
ATTACH III).
A Review Panel was recruited to read,evaluate and rank the RFI responses. This Panel
consisted of.

On 5 NOV 99 the Review Panel met to go over the Review Criteria, Evaluation Form
(see ATTACHs IV,V and VI)and receive copies of the RFIs reaching our office as of
that date. Four(4)of the respondents submitted their survey answers before the due date
and one submitted their response five(5)days late. We decided to evaluate the late
response and the Panel members were given a copy.

On 2 DEC 99 the Panel met to review their evaluations of the RFIs, discuss issues in the
responses and formulate a ranking. After each member had an opportunity to discuss the
merits and issues of the responses that they evaluated, the Panel came to a consensus on
the overall ranking of the responses:

III. Dialogic Communications Corporation
IV. SCC Communications
V. Not Ranked by three(3)Panelists because of inadequate submittal-

While all the responses indicated that they would be able to transmit communications in
other languages,there was a range of additional alternative actions that the user would
have to undertake before the other than English language was able to be transmitted. The
preliminary effort required by the user for each responder to institute multi-language
transmissions appears similar.It is the general feeling of the Panel that there is much
work that needs to be done with the community first,notwithstanding the vendor used,
before multi-lingual messages could be transmitted.
Significant weight appears to have been given by the Panelists to the length of experience
in providing telephone ring-down service by each of the responders. While one responder
stated they had a significant number of years in " 911"service,the panelists did not
equate this as similar to our program needs.
The comparison of the communities served by the responders was also a topic of
discussion.The largest community served by responders other than the first ranked was
370,000 in Florida.This low number coupled with the geography of the regions served
and the length of experience further distinguished the relative rankings of the responders.
The overall quality and completeness of the responses to the RFI questions were also
evaluated. While several responses appeared to have been put together with careful
thought,others presented as being completed without this quality. The more complete
responses gave the detail that we requested, while the others had short responses not
muting the level of detail we sought.
The Panel reached a consensus that given the relatively low experience of the lessor
ranking responses, it would be appropriate to continue the contract with our present
provider but renew our review in two (2)to three(3)years after the responders have
gained experience
