THE BOARD OF SUPERVISORS OF

Adopted this Order on February 1, 2000, by the following vote:

Subject: Introduction of Ordinance 2000-04 (Amending County Ordinance
Code Section 24-22.008), Ordinance 2000-05 (Road commissioner and surveyor
consolidated) and Ordinance 2000-06 (County Surveyor-Exempt)
IT IS BY THE BOARD ORDERED THAT the attached ordinances (2000-04,
2000-05 and 2000-06) amending the Ordinance Code of Contra Costa County as
indicated is INTRODUCED, reading WAIVED and February 15, 2000 is FIXED
as the time for adoption of same:
(2000-04) SECTION I: Section 24-22.008 is amended to read:
24-22.008 Duties combined---Appointment. (a) Offices and Duties Combined. The
duties of road commissioner are combined with those of public works director,
who holds the two offices and performs their duties. The public works director also
hold, ex officio, the offices and positions in subsection (c) of this section and
performs their duties, which are hereby combined with his other duties pursuant to
Government Code Section 24300.
(2000-05) SECTION I: Section 24-22.004 is amended to read:
24-22.004 Road commissioner and surveyor consolidated. The duties of the offices
of road commissioner and surveyor are consolidated, pursuant to Government
Code Section 24300, whenever the public works director (road commissioner) is
authorized to practice land surveying in this state and is appointed county surveyor.
(2000-06) SECTION I: Section 33-5.348 is added to the County Ordinance Code
to exclude the class of County Surveyor—Exempt from the merit system.

(Amending County Ordinance Code Section 24-22.008)
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes
from the official text of the enacted or amended provisions of the County Ordinance Code):
SECTION I: Section 24-22.008 is amended to read:
24-22.008 Duties combined---Appointment. (a) Offices and Duties Combined. The duties
of road commissioner are combined with those of public works director, who holds the two
offices and performs their duties. The public works director also holds, ex officio, the offices
and positions in subsection (c) of this section and performs their duties, which are hereby
combined with his other duties pursuant to Government Code Section 24300.
(b)Appointment. The public works director is appointed by the board pursuant to Streets &
Highways Code Section 2006, and the parenthetical authorities listed after the positions in
subsection(c)of this section.
(c) Other Positions. The public works director may also hold the following positions on
appointment by the respective governing bodies: Chief engineer of county sanitation districts
(Health & Safety Code Sections 4739, 4749); the chief engineer of the Contra Costa County
Storm Drainage District (Stats. 1953, Chap 1532, Sec. 9 , see Water Code Appendix), chief
engineer of the Storm Drain Maintenance Districts in this county(Stats. 1937, Chap. 265, Sec.
6; See Water Code Appendix); and whenever the public works director(road commissioner)is
authorized to practice land surveying in this state and is appointed county surveyor, during the
period of such service,the offices of road commissioner and surveyor are consolidated. (Ords.

The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical

SECTION I: Section 33-5.348 is added to the County Ordinance Code to exclude the class of

(SUBDIVISIONS AND INDIVIDUAL SYSTEMS)
The Contra Costa County Board of Supervisors ordains as follows(omitting the parenthetical
footnotes from the official text of the enacted or amended provisions of the County Ordinance
Code):
SECTION I. Section 420-6.505 of the County Ordinance Code is amended,to allow alternative
systems to be used in subdivisions in the unincorporated area without creating a government
agency to install and maintain the alternative systems,and to expressly require operating permits
for alternative systems,to read:
420-6.509 Alternative individual system. (a)Allowed. The health officer may
approve, conditionally approve,or deny an application to use an alternative system. No
alternative system will be approved for installation in a septic tank moratorium area, a water
quality control board prohibition zone,or in any incorporated city,or sanitary or sanitation
district without approval by that city or district.
(b) Requirements. An alternative system must meet all applicable provisions of this
chapter and:
(1)All local, state,and federal laws and regulations;
(2) Certification and testing requirements of an appropriate governmental agency; and
(3)Approval requirements of N.S.F. (National Sanitation Foundation), I.A.P.M.O.
(International Association of Plumbing and Mechanical Officials),or other recognized industry
standard.
(c) Operating Permit Required. The property owner shall obtain and at all times
maintain an operating permit for an alternative system. The operating permit may be issued for
such period, and include such conditions(such as monitoring requirements) as the health officer
determines for the protection of the public health,welfare and the environment. Pursuant to
section 420-6.307,the health officer may from time to time,establish regulations for operating
permits and the operation of alternative systems.

SECTION IL The Board hereby finds and determines that it can be seen with certainty that
there is no possibility that the adoption of this ordinance may have a significant effect on the
environment because any prospective subdivision is required to undergo environmental review.
SECTION III, EFFECTIVE DATE. This ordinance becomes effective 30 days after passage,
and within 15 days after passage shall be published once with the names of the Supervisors
voting for and against it in the Contra Costa Times, a newspaper published in this County.
