Grant vs. Contra Costa County u ty ul WCAB No. WCK 0041761 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)3 BACKGROUND AND JUSTIFICATION RECOMMENDATION: Receive this report concerning subject final settlement and payment from the Workers' Compensation Trust fund in the amount of$55,000. BACKGROUNDIREASONS FOR RECOMMENDATION: Keith A. Epstein, defense counsel for the County, has advised the County Administrator that within authorization an agreement has been reached settling the workers' compensation claim of Carlee D. Grant vs. Contra Costa County. This Board's December 7, 1999 closed session vote was: Supervisors Canciamilla, Gioia, Uilkema, DeSaulnier, and Gerber, yes. This action is taken so that terms of this final settlement and the earlier December 7, 1999 closed session vote of this Board authorizing its negotiated settlement are known publicly. We would request that your office proceed to have the attached list of surplus equipment declared surplus by the Board of Supervisors and authorize the Fire District to dispose of same. Some of the items may be of interest to other County fire agencies and they will be alerted by sending the attached list. Should there be no intra-county or inter-fire agency transfers, we would like to send surplus items to public auction at "Nationwide Commercial Auction Services" in Napa or the County Recycling Center and/or dispose of items ourselves. We will also transport the surplus equipment to the auctioneers ourselves. Donaghue (Donaghue) for $1,034,570. The contract required the placement of a considerable amount of exposed concrete within specified tolerances, consistent with industry standards. 2. Donaghue performed extensive concrete work that was seriously defective. The resulting work threatened to compromise the security and appearance of the facility. Donaghue repeatedly failed to either remove the defects or develop a viable plan for th ' ction. On August 10, 1999, the Board declared that, due to the public safety threat posed by the temporary closures at the project, and due to the possible loss of state grant funding, a state of emergency exists. Furthermore, the Board delegated authority to the County Administrator or designee to complete the project and to enter into contracts without the need to re-solicit competitive bids. 4. The County received the bonding company's (Insurance Company of the West; "ICW') response to the County's claim on November 5, 1999. In its response, ICW recognized the seriousness of the defective work and recognized that it likely will cost the County at least $510,985.05 over and above the contract price to fix the defective work. Despite this, ICW gave two unreasonable alternatives to the County—either accept back the original contractor (Donaghue) who did the defective work or accept a "low ball" payment of $118,004.31. lCWs bad faith response amounts to a rejection of the County's claim. Therefore, the County is left with no viable choice but to hire its own contractor to properly complete the contract work in strict accordance with the plans and specifications. This will involve removing the defective construction down to the slab and rebuilding the concrete from that point up. 5. On November 30, 1999, the County Administrator's Office executed a contract with Taber Construction of Martinez for the completion of the project, and issued a Notice to Proceed effective December 6, 1999. The contract amount is $1,198,435, and the contract duration is 150 calendar days. BACKGROUND: CONTINUED NEEM FOR EMERGENCY The spread of disease, particularly HIV and Hepatitis C, through the sharing of needles continues to be a grave concern in Contra Costa County. 30% of all people living with AIDS in Contra Costa were infected by injection drug use with the highest number of AIDS cases in West County. As of December 1997,Richmond had the highest cumulative incidence of AIDS (4.8 per 1000 population) among Contra Costa cities, with at least 50 cases. Injection drug use was the estimated mode of infection among 40% of all individuals diagnosed with AIDS in Richmond. Among African Americans diagnosed with AIDS in Richmond 1982-1998 53% were most likely infected through injection drug use. Contra Costa Health Services does not currently provide needle exchange services (it is prohibited from doing so absent a declared public health emergency). CCHS does provide services focused on injection drug users including: 1-HIV/AIDS Outreach and Education, 2-HIV antibody testing, 3-Substance Abuse Treatment,4-Health on Wheels Van, and 5-Substance Abuse Counseling and Treatment for HIV-infected clients. Exchange Works, a community-based needle exchange service currently in operation in Contra Costa currently distributes clean needles on a one-to-one basis. Their volunteer staff currently exchange 5,000 needles per week at two sites. There are no established needle exchange program in East or Central County. The acquisition of additional space is necessary for the Crisis Center to meet current and future needs of the residents of Contra Costa. Crisis Center intends to combine the two offices in order to add more grief counseling rooms (especially a children's grief room), more space for homeless services staff, a larger crisis line room, space for a senior outreach program, and a room to house a mobile crisis unit.
