RECOMMENDATIONS
Adopt a motion to designate 242 trees nominated for heritage status
as recommended by the San Ramon Valley Regional Planning Commission
in Resolution 435-2000 .

BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1599, the Board of Supervisors approved the Stone Valley Oafs
project authorizing the construction of 47 single family residences
in a clustered development which allowed retention of open space
area. As a requirement of the subdivision approval, the applicant
was required to file an application to nominate native trees on-
site for heritage status pursuant to the County' s Heritage Tree
Preservation Ordinance (Chapter 816-4) .
The developer, Summerhill Homes, filed such an application to
nominate 242 trees within the project for heritage status . The
matter was initially heard by the San Ramon Valley Regional
Planning Commission on June 21, 2000, at which time the Commission
voted to recommend that the Board designate these trees for
heritage designation.

If authorized by the Hoard, this designation would prohibit the
affected trees from removal without an interested party first
obtaining a tree permit from the County.
It should be noted that the Stone Valley Oaks project at the
present time is in the early stages of development .
Prior Board Hearing Date
This item was initially scheduled to be heard by the Board of
Supervisors on September 26, 2000 . At that time, concerns had been
raised regarding grading activity by the subdivision developer
particularly as applied to an off-site emergency vehicle access
road connection (on the Humphrey property) . At staff' s
recommendation, the Board continued the hearing on this matter to
allow staff an opportunity to further investigate the grading
activity.
Subsequent to the prior Board hearing on this item, staff
investigated the grading activity. The developer agreed to make
changes to the final grading on the Humphrey property to allow it
to better complement the surrounding natural terrain. The
developer is presently implementing those changes .
Staff also determined that the grading activity that had been in
question did not affect trees that have been nominated by the
Commission for heritage status . Accordingly, the proposed
designation should be approved as recommended by the Commission.

RESOLUTION OF THE SAN R.AMON ''VALLEY REGIONAL
PLANNING COMMISSION, COUNTY OF CONTRA COSTA,
STATE OF CALIFORNIA CONCERNING THE REVIEW OF AN
APPLICATION (HT990016) TO NOMINATE 242 NATIVE
TREES WITHIN SUBDIVISION 8016 FOR HERITAGE STATUS,
IN THE ALAMO AREA.
WHEREAS, in 1999, the County Board of Supervisors approved
Subdivision 8016 located on the north side of Stone Valley Road, just
east of its intersection with Smith Road in the Alamo area; and
WHEREAS, as a condition of approval of that project, the
applicant was required to preserve and protect mature native trees on
site, and to file an application with the County to nominate the trees for
heritage status; and
WHEREAS, prior to filing the final map for the subdivision, the
applicant filed a Heritage Tree nomination application with the County,
File HT990016; and
WHEREAS, after notice was lawfully given, the project was
scheduled for'hearing before the San Ramon Valley Regional Planning
Commission on lune 21, 2000, at which time testimony was taken and,
at the conclusion of which, the hearing was closed; and after having
fully reviewed, considered and evaluated all the testimony and evidence
submitted in this matter;
NOW, THEREFORE, BE IT RESOLVED, that the San Ramon
Valley Regional. Planning Commission NOMINATES to the Board of
Supervisors of the County of Contra Costa, State of California, the 242

BE IT FURTHER RESOLVED, that the foregoing
NOMINATION was given by the San Ramon Valley Regional Planning
Commission in a regular meeting on Wednesday, June 21, 2000 by the
following vote:

Matsunaga, Neely
NOES: Commissioners- None

I. INTRODUCTION
SUMMERHILL HOMES (Applicant and Owner), County File # IIT990015�- A
request to nominate 242 native trees for heritage status within Subdivision 8016.The
property fronts for approximately 1,363 feet on the north side of Stone Valley Road,
just west of its intersection with Smith Road, in the Alamo area. (P-1) (ZA: R-16)
(CT: 3461.02) (Parcel #193-200-016).
II. RECOMMENDATION
Adopt a motion recommending to the Board of Supervisors that the nominated trees
be designated for heritage status pursuangq Chapter 816-4 of the ordinance.
IIL GENERAL INFORMATION
A. Environs: The site is located in the community of Alamo, near the Town of
Danville.
B. Recent Activity: Grading of the subject property began in September 1999 and
will be continuing this year in anticipation of home construction. The final
map was filed by the Board of Supervisors on April 4, 2000.
IV. DISCUSSION
This application has been submitted in compliance with the subdivision approval.
Favorable County action would provide extra legal protection to the County in the
event that someone in the future were to contemplate an action that might damage one
of the trees. If this nomination is approved by the County, then before an individual
could undertake improvements within the dripline of a tree, the ordinance would
require they obtain an encroachment permit from the Building Inspection Department
(Section 816-4.802).

Before a Heritage Tree could be removed, the ordinance would require that an
individual apply to the Community Development Department for a tree removal
permit pursuant to Article 81.6-4.10. The Zoning Administrator is required to inspect
the tree(s)and determine whether the permit should be granted,conditionally granted
or denied based on several criteria specified in the code. The Zoning A.dministraatoes
decision may be appealed to the Planning Commission.
Protection of the trees will help retain the semi-rural character of the areas in accord
with the policies of the General Plan. Nomination of trees for heritage status is the
only means of providing ongoing protection of mature oak trees. Accordingly, staff
recommends that the Commission support the proposed nomination.
It should be noted that the County adopted another tree ordinance in 1994, the Tree
Protection and Preservation Ordinance (Chapter 816-6). That ordinance protects
mature indigenous trees only in certain situations. None of those situations would
apply to the lots within subdivision once they are developed.
It should also be noted that in filing the Heritage Tree application, the applicant has
completed his obligations with respect to protection of the trees. Failure of the
County to act favorably on this request will have no effect on the applicant's right to
complete the-development-ofthis project.
