FISCAL IMPACT
Staff estimates the cost for processing the revocation to be $1,000.
BACKGROUND INFORMATION
On May 19, 1909,the San Ramon Valley Regional Planning Commission approved a new land
use permit to permanently establish a used car dealership on the subject property located at
3212 Danville Boulevard in Alamo. The County Board of Supervisors held the initial public
hearing on April 18, 2000 to determine if cause exists to revoke the permit approved under
County File #LP952061 since the applicant was not in compliance with conditions of approval
for the project. At the October 24, 2000 meeting, the Board declared its intent to reject the
revocation of the use permit for Bridges car dealership if Mr. Bridges complied with conditions
of approval#1, #13, #16F and #30 by December 31, 2000. The Board directed staff to prepare
a status report on condition compliance for the December 19, 2000 meeting.
COMPLIANCE WITH CONDITIONS OF APPROVAL #1,-413,#16F & 430:
Condition of Approval 441: The lot has forest green striping for the display areas. Striping
along the north frontage is not entirely consistent with the plans
approved by the San Ramon Valley Regional Planning
Commission. Space #24 and 423 (located at the rear) are at
tandem and not next to one another as indicated on the
drawing.
Condition of Approval #13: Mr.Bridges has not paid the $12,000 application fee as required
by Condition of Approval #13.
Condition of Approval #16F: Mr. Bridges has painted the parallel parking street markings as
required by Condition of Approval #16F.
Condition of Approval #30: Condition of Approval #30 requires the property owner and
applicant to execute a Statement of Obligation, stating that they
will remove a deck that encroaches on a drainage easement,
following notification by the County, to allow maintenance work
to be performed along the creek. A written executed statement
has not yet been returned to Public Warks yet.

OTHER ISSUES OF NONCOMPLIANCE
During the month of November and December, staff received several telephone calls from the
adjacent business owner on Dale Bridges' lack of compliance with several of the conditions of
approval for the use permit. The complaints received as evidenced by the photographs
submitted dated received by the Community Development Department on November 30,2000
consist of the following:
1. Parking Bridges Christmas tree delivery truck in the customer parking space area.
2. Displaying automobiles in the aisle areas.
3. Parking automobiles in the common driveway easement to the north of the property.
4. Blocking driveway/turnaround areas by parking automobiles and/or display cars.
5. urge fiberglass Santa/banners on property.
CAUSES FOR REVOCATION
The ordinance authorizes the County to revoke a permit for any of the following reasons.
1. Continued violation of the terms, limitations or conditions of the permit after notice of the
violation.
2. Violation of requirements of this code relating to the premises or activities authorized.
3. Failure to abate a nuisance after notice.
4. Any suspension or revocation of a license required for the conduct of the business on
the premises covered by the permit.
5. Any act or failure to act resulting in the conviction of a permittee, operator, or employee
of a violation of Federal or State law, or County ordinance in connection with the
operation of the permitted use.
RECOMMENDATION
As of the time of preparation of this report, Mr. Bridges is not fully in compliance with the
conditions of approval of the project. However the Board granted Mr. Bridges until December
31, 2000 to comply with the conditions. Staff recommends that the Board continue the hearing
to the first available hearing in January 2001 to determine if compliance was achieved.
