SUBJECT: Fire Protection Districts Vehicle Acquisition
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommendation: APPROVE the vehicle purchase and replacement plans for the
Contra Costa, Oakley, and East Diablo Fire Protection Districts
as provided for in the 2000-01 Final Budget.
Fiscal Impact:
The cost of the planned vehicle acquisitions were budgeted.
Background/Reasons for Recommendation:
During the July 2000 budget hearings, Administrative Bulletin 508: `Vehicle and
Equipment Acquisition" was implemented. At that time, it was unclear whether Special
Districts were required to participate in this process. Subsequently, the Internal
Operations Committee has declared that Special Districts shall also abide by this
Administrative Bulletin. Therefore, attached are the itemized vehicle lists and
replacement and acquisition plans for FY 2000-01.

SUBJECT: RATIFY DECISION OF GENERAL MANAGER TO EXECUTE AMENDMENT TO STANDARD
FORM MAINTENANCE SERVICES AGREEMENT BETWEEN THE CANYON LADES CHAD
AND DOVER CONSTRUCTION, INC., EXTENDING EFFECTIVE DATE OF CONTRACT
FROM JUNE 30, 2000 TO JUNE 30, 2001, SAN RAMON AREA. WO#5148
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND ANIS JUSTIFICATION
I. Recommended Action:
RATIFY decision.of William R. Gray and Company, as General Manager of the Canyon Lakes Geologic Hazard
Abatement District(GHAD),to execute an amendment to the standard form maintenance services agreement with
Dover Construction,Inc. for general maintenance activities and preventative maintenance services for the Canyon
Lakes CHAD extending the contract effective date from June 30, 2000 to June 30,2001.
II Financial Impact:
There will not be any impact on the County General Fund. The Canyon Lakes CHAD is funded through special
assessments on properties within the boundaries of the Canyon Lakes CHAD.
III. Reasons for Recommendation and Backimouind:
Dover Construction, Inc.1174 Killarney Street, Livermore, California has been providing general maintenance and
preventative maintenance services to the Canyon Lakes GHAD since the GHAD's inception in 1986. Dover
Construction, Inc. has extensive experience in responding to and assisting the GHAT)with the repair of landslides
and landslide related work in Canyon Lakes and the surrounding area. William R. Gray and Company negotiated
and approved a standard form maintenance services agreement between the Canyon Lakes CHAD and Dover
Construction,Inc. for the Fiscal Years of 1998-99 and 1999-2000 and their performance was acceptable each year.
William R. Gray and Company recommends approval of the extension of the contract expiration date to June 30,
2001.

AMM4 NIDMENT TO CONTRACT
This Contract amendment is effective July 1, 2000 between the Canyon Lakes Geologic
Hazard Abatement District(Public Agency), an agency formed under Section 26500 of
the Public Resource Code and Dover Construction(Contractor), a company doing
business at 1174 Killarney Street, Livermore, CA, 94550.
WHEREAS, Public Agency and Contractor previously entered into a contract dated July 1,
1999, which Contract was approved by the Board of Supervisors on August 17, 1999;
THEREFORE, Public Agency and Contractor mutually agree to amend said contract to
lengthen the effective date of the contract from June 30,2000 to June 30, 2001.
In all other respects, the contract dated July 1, 1999 shall remain in hill force and effect.
In WTI'NE--SS WI—IEREOF,Public Agency and Contractor have executed this Contract as of
date written on the first paragraph of this Contract.

I. Recommended Action:
APPROVE and AUTHORIZE the General Manager of the Blackhawk GHAD to execute an amendment to the
Consulting Services Agreement between the Blackhawk GHAD and Engeo,Inc. for additional geological and
geotechnical services for the Blackhawk GHAD.
II Financial Impact:
There will not be any impact on the County General Fund. The Blackhawk GHAD is funded through revenues
generated by County Service Area M-23. Sufficient funds are available from GHAD reserves for this work.

IIL Reasons for Recommendation and Background:
The Blackhawk Geologic Hazard Abatement District(GHAD)was formed in 1986 and is located in the Danville
area.
In June of 1999, Engeo, Inc., San Ramon, California was retained to provide on-call geotechnical engineering
and geologic consulting services during Fiscal Year 1999/00. The initial term of the contract was one year and
the contract payment limit was $190,800.00. Under this contract, Engeo provided geotechnical engineering and
consulting services, assisted the GHAD in responding to emergencies and monitored piezometers and horizontal
drains maintained by the District. At the end of June 2000 (the end of the 1999/00 Fiscal Year), almost
$80,000.00 remained unallocated in the contract.
In lieu of terminating Engeo's contract at the end of the 1999/00 Fiscal Year and renegotiating a new contract for
the 2000/01 Fiscal Year, the General Manager amended the FY 1999/00 contract and extended it's term through
the end of the 2000/01 Fiscal Year. It was understood at the time that a subsequent contract amendment might be
required to increase the contract payment limit. Funds in the original FY 1999/00 contract are now fully
expended and William R. Gray and Company, as General Manager of the GHAD, is recommending that the
contract payment limit be raised from$190,800 to$278,800. The increase in the contract payment limit should
be sufficient to cover expenses through the remainder of the 2000/01 Fiscal Year, as well as provide a
contingency to cover potential emergency responses.
Under this contract,Engeo evaluated and prepared repair recommendations for a number of landslides and
potential landslides within the boundaries of the CHAD. Work on two landsides account for a significant portion
of Engeo's total billings under this contract. A landslide on the sixth fairway of the County Club's Lakes Golf
Course turned out to be much more complex than originally anticipated. Engeo's charges for work on this slide
(geotechnical engineering,testing and inspection services)total in excess of$70,000. Engeo also provided
engineering,testing and observation services on a large landslide to the rear of 189/190 Silver Pine Lane.
Engeo's charges for work on the Silver Pine project totaled in excess of$56,000. The total cost to repair these
two landslides is approximately$1.7 million. Engeo's charges for work on these two projects are well within
industry standards.
IV. Consequences of Negative Action:
Without Board approval,the GHAD will not be able to effectively respond to emergencies during the remainder
of this fiscal year.

111. Reasons ns for Recommendation and Back round
During the winter of 1998,a landslide occurred in the rear of two homes on Chestnut Place in Blackhawk,
Danville,California. The landslide impacted a common area, a storm drain line and the rear yards of the homes
at 49 and 53 Chestnut Place. The landslide occurred within the boundaries of the Blackhawk GHAD.
The repair of the landslide is complete.
License Agreements were executed on October 12, 1998 with the two homeowners(Goza and Watson)and
provided the GHAD with the necessary rights and indemnification to proceed with the repair. The Agreements
also provided for the CHAD to partially reimburse the homeowners the cost of repairing and/or replacing
landscaping and other improvements damaged by the landslide. Change Order#1 increased the costs associated
with the landscaping at the Watson's home. Change Orders#2 and#3 extended the contract expiration dates.
The current change order reflects the actual costs for repair of the cabana structure that was damaged by the
landslide and increases the allowance to the homeowner to a total reimbursement amount of$81,996.00. The
current change order also extends the contract expiration date to December 31, 2001 to allow repairs to take
place.
Actual payment of the allowance to the homeowners is subject to actual repair of damage and/or completion of
improvements and submittal of invoices to the GHAD.
1V. ConseNtve Action:

Without approval of this amendment,the affected homeowners would not be able to make the necessary repairs
to their landscaping that resulted from the GHAD's landslide repair project.
FOURTH AMENDMENT TO LICENSE
AGREEMENT FOR LANDSLIDE REPAIR
1. El?'l"ECTIVE DATE AND PARTIES
Effective November 22, 2000,M(KE and JULIE WATSON(referred to as "OV, S")
and BLACKIAWK.GEOLOGIC HAZARD ABATEMENT DISTRICT, a political
subdivision of the State of California (referred to as "CHAD")mutually agree as follows:
2. PURPOSE
Effective October 12, 1998, the parties entered into a written agreement entitled "License
Agreement for Landslide Repair" (referred to as the "Agreement"),which covered the
repair of a landslide located on OWNERS'property located at 53 Chestnut Place,
Danville, California.. The original License Agreement provided a total allowance of
$58,934.00 to the homeowners for reimbursement of damage to landscaping and for the
repair of damage to the cabana and pool caused by the landslide. This Agreement was
amended on July 20, 1999 to provide an additional $13,062.00 to the homeowners for
additional repair work to their home, bring the total allowance for reimbursement to the
homeowners to $71,996.00. Additionally,the Agreement was modified to extend the
contract expiration date first to December 31, 1999, and ultimately to its current
expiration date of December 31, 2000. Pursuant to Section 7 of the Agreement, the
parties wish to amend the Agreement to extend the payment limits of the Agreement, as
well as the expiration date.
3. AMENDMENTS TO AGREEMENT
A. In the Agreement, Section 2,replace with the following:
"The irrevocable licenses granted hereby shall commence on the effective
date of this Agreement and shall continue until December 31, 2001, or
until the Work is completed, whichever occurs first. GHAD shall have the
right to terminate this Agreement upon ten days' notice to OWNERS."
In the Agreement, Section 3 and Exhibit D are replaced with the
following:
Upon completion of the Work, CHAD will make available to OWNERS
an allowance in an amount not to exceed$81.,996.00.00 for the purpose of
replacing or repairing landscaping, fencing,pool,pool decking and other
improvements, as well as repairing damage to the cabana and swimming
pool damaged or destroyed by the landslide or the GHAD's contractor
during repair of the landslide. GHAD will, at its expense, remove and
replace the foundation of the cabana structure. OWNERS will be
responsible for all other work on the cabana structure. Such amounts or

portions thereof will be payable to OWNERS upon presentation of
invoices satisfactory to Gly showing that OWNERS have paid for
replacement or repair of the items above."
4. REMAINING PROVISIONS
Except for the changes made by this and prior amendments, all provisions of the
Agreement shall remain in fall force and effect.
