RECOMMENDATIONS
Authorize the Chair of the Board of Supervisors to sign a letter to the Contra Costa
Transportation Authority in support of the proposed amendments to the Measure C-
88 Growth Management Program.
FISCAL IMPACT
Mone to the General Fuad. The County rust satisfy the requirements of the Growth
Management Program in order to receive its share of the Measure C-SS sales
tax
revenue, which is commonly referred to as "return-to-source funds". The County
received approximately $1.8 million in such revenue in 2000, which is used by the
County primarily for road maintenance and construction purposes. The proposed
amendments to Measure C-SS will streamline some of the Growth Management
Program requirements.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On November 16, 2000, the Executive Director of the Contra Costa Transportation
Authority (Authority) circulated a request for comments on two proposed
amendments to the Measure C-SS Growth Management Program (see Exhibit A).
The first, and probably the more significant of the two, would allow jurisdictions that
are found in compliance with the GMP to submit a Compliance Checklist every two

years, rather than annually. This would reduce the amount of paperwork that County
staff would need to submit to the Authority in support of our compliance efforts.
The second amendment allows jurisdictions to adopt either a Transportation System
Management (TSM) ordinance or resolution. Using a resolution to convey the TSM
policies required by the GMP is considered fitting since for some time now State law
has prohibited cities and the County from imposing trip-reduction requirements on
employers. Currently, the GMP requires each jurisdiction to use an ordinance to
meet this requirement.
County staff has reviewed these changes and supports their adoption by the
Authority. A draft letter indicating this support is enclosed as Exhibit B. Included in
this letter is a request that the Authority clarify when the annual sales tax revenue
would be received by jurisdictions that have been found in compliance with the GMF'
in the prior year. Currently, a jurisdiction that has been found in compliance with
Measure C-88 can receive their return-to-source funds no earlier than April 1 of the
fiscal year the sales tax is collected. One scenario is that once a jurisdiction has
submitted its Checklist and is found in compliance with the GMP, it will automatically
receive its return-to-source funds for the following fiscal year on April 1 of that fiscal
year.
You may recall that on February 15, 2000, the Board of Supervisors adopted
principles for establishing transportation priorities for the renewal of Measure C-85.
Those principles included the following one that was directed at the Growth
Management Program.
Transportation investments for the cities and the County should be linked to a growth
management programa that requires measurable results for traffic relief, affordable
housing, and compact development.
At this time, the Authority has not seen the deed to amend the GMP in order to
achieve such results.
The deadline for commenting on the proposed amendments is December 31, 2000.
Assuming that no significant issues arise, the Authority is expected to adopt these changes
in January 2001.

unanimously supported these two amendments. Consequently,we do not anticipate these

On December 19, 2400, the Board of Supervisors authorized the Chair to transmit a letter in support of adopting
the proposed amendments to the Measure C-88 Growth Management Program, Based on our years of
experience with the Growth Management Program, these amendments appear to be non-controversial.
If the Authority adopts these amendments, the Board would like the Authority to determine a schedule for
dispersing Measure C-88 return.-to-source revenues to jurisdictions that are allowed to submit a Compliance
Checklist every two years. Currently, a.jurisdiction that has been found in compliance with Measure C-88 can
receive sales tax revenue no earlier than.April 1 of the fiscal year the sales tax is collected. For such
jurisdictions, how soon could they expect to receive their return-to-source allocation in their second year of
compliance?
The Board of Supervisors appreciates the opportunity provided by the Authority to comment on these proposed
amendments.
