RECOMMENDATIONS
1. AUTHORIZE the Contra Costa County Redevelopment Agency(Agency)to convey the following below
market rate real properties to eligible moderate-income purchasers: assessor's parcels 203-061-006, 203-
061-053, and 203-061-022, pursuant to California Health and Safety Code sections 33431 and 33449,
2. AUTHORIZE the Deputy Director-Redevelopment, or his designee, to enter into the legal documents
required for the transfer of title of above properties from the Agency to eligible purchasers,
3. DIRECT the Real Property Division to have the County Deed of Trust, Buyer's Resale Agreement, and
other such documents as required recorded in the Office of the County Recorder.
FISCAL IMPACT
No Redevelopment Agency impact.This program utilizes the Affordable Housing Special Revenue Fund(Fund
111300, Org. 1596) to acquire the properties from sellers; the properties are resold to eligible buyers. The
Affordable Housing Special Revenue Fund is reimbursed net of transaction costs.

BACKGROUND/REASONS FOR RECt7NMMNDATIONS
In accordance with the terms of a Development Agreement between the County and Dame
Construction Company(1993), Dame agreed to provide 23 Affordable Units in the Somerset
Homes development in exchange for development approvals, including a density bonus, received
from the County. As required by the Agreement, the Affordable Units were sold to qualified
moderate-income households at below-market prices providing a homeownership opportunity to
the purchaser. Purchasers of the affordable units were required to enter into a Buyer's Purchase
Agreement which provided the County with the right of first refusal to acquire, or to assign its
right to acquire the unit at a predetermined price, in the event of resale. The purpose of the resale
restriction is to provide the County with an opportunity to maintain the affordability of the unit
for another moderate-income household.
Three owners of affordable units in the Somerset Homes development informed the County that
they wished to sell their units. In order to preserve the affordable units for a minimum of ten years
in accordance with State Density Bonus law, the County purchased the three properties. State law
requires Counties to sell property at auction, unless below-market property is being sold to
eligible buyers. The former is not practicable to maintain affordability, and the latter requires a 30-
year term of affordability which is in conflict with the Somerset program 15-year term.
In order to facilitate the sale of these properties to eligible households, the County transferred the
properties to the Agency. California Health and Safety Code Section 33449 allows redevelopment
agencies to acquire property located outside of a project area to provide housing for persons of
very-low, low or moderate income.
An eligible purchaser has been identified for each of the three affordable Somerset properties.

RESOLUTION OF THE CONTRA COSTA COUNTY REDEVELOPMENT AGENCY
APPROVING THE SALE BY THE AGENCY OF THREE HOMES IN THE SOMERSET
HOMES DEVELOPMENT TO ELIGIBLE HOUSEHOLDS IN FURTHERANCE OF THE
CONTRA COSTA COUNTY DENSITY BONUS PROGRAM
WHEREAS, in furtherance of the long-term affordability goals of the Contra Costa
County density bonus program, Contra Costa County(the "County") acquired three(3)homes in
the Danville Area located at 10 Conejo Lane(APN 243-061-006), 225 Portola Drive(APN 203-
061-022), and 34 Maximo Court(APN 203-061-053)(the "Homes"), for the purpose of
maintaining the affordability of the Homes through the Somerset Density Bonus Program.
WHEREAS,the County transferred the Homes to the Agency pursuant to Government
Code Section 25365, to facilitate their resale to eligible moderate income households under the
Somerset Density Bonus Program; and
WHEREAS, the County authorized execution and recordation of Buyers Resale
Agreements, secured by deeds of trust, against each of the Homes upon their sale to the
Homebuyers, in furtherance of the Somerset Density Bonus Program; and
WHEREAS, pursuant to Health and Safety Code Sections 33431 and 33449, the Agency
is authorized to convey property in order to provide housing for persons and families of low and
moderate income; and
WHEREAS, the Agency has received purchase offers for the Homes from Steven and
Carol Priete (10 Conejo Lane), Brendalyn Benson Washburn(225 Portola Drive), and Melissa
Cabrae(34 Maximo Court)(the "Homebuyers"), and has prepared agreements for the sale and
purchase of said Homes ("Purchase Agreements")copies of which are on file with the Agency
Secretary; and
WHEREAS, the Agency has conducted a duly noticed public hearing on the sale of the
Homes pursuant to Purchase Agreements under Health and Safety Code Section 33431, for the
purpose of receiving the input and comments of the public on sale of the Homes to the
Homebuyers pursuant to the Purchase Agreements.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The recitals contained in this Resolution(the "Recitals") are accurate and have
formed the basis, in part, for the Agency's and actions set forth below.
2. Pursuant to Health and Safety Code Section 33430, the Agency hereby: (i)
approves the Purchase Agreements and all ancillary documents; (ii) approves execution by the

Agency Deputy Director-Redevelopment of the Purchase Agreements and all ancillary
documents in substantially the form on file with the Agency Secretary, with such changes as are
approved by the Agency Deputy Director-Redevelopment (such approval to be conclusively
evidenced by the execution of the Purchase Agreements); (iii)approves the sale of the Homes by
the Agency to the Homebuyers pursuant to the provisions of the Purchase Agreements; (iv)
directs the Agency Deputy Director-Redevelopment to record grant deeds to each Homebuyer
and to record, on behalf of the County, the Buyers Resale Agreements, and accompanying deeds
of trust; and (v) directs that all net proceeds of sale be utilized to reimburse the County
Affordable Housing Special Revenue Fund.
3. This Resolution shall take immediate effect from and after its passage and
approval.
