CONFIRM that Contra Costa County and the Superior Court of California are committed to the construction of a new Family Law Center in downtown Martinez to consolidate court operations into a single, functional, cost-efficient, and appropriately designed facility. 2. AGREE that the County committed $7,500,000 for the planning, design, and construction of this new Family Law Center. 3. RECEIVE this report that acknowledges the two most desirable sites identified for this development are either the parking lot adjacent to 1911 Ward Street or the Assessor's block at 834 Court Street. 4. CONCUR that site development and environmental mitigation costs are a determining factor between these two desirable sites. 5. ACCEPT estimates from the County's professional consultants that indicate site development costs for the 1111 Ward Street site are approximately $36,400 whereas, development costs for the 834 Court Street site exceed $860,000 (excluding tenant relocation costs). 6. The estimated cost for planning, design, and construction of the Court's essential requirements exceeds the budgeted commitment of $7,500,000. 7. AGREE that to minimize this budget deficit, the Family Law Center should be located on the least expensive site alternative. 8. ACKNOWLEDGE that the Superior Court has identified additional funds to eliminate the deficit between the estimated construction cost of $11.5 million and the budget commitment of $7.5 million, and the Court is willing to ratify its funding commitment by executing a Memorandum of Agreement with the County. 9. APPROVE the selection of the Parking Lot adjacent to 1111 Ward Street for development of a new Family Law Center as it is the least expensive alternative, and AUTHORIZE the County Administrator to proceed with the design of this facility. 10. AUTHORIZE the County Administrator's Office to execute, in order that this project may proceed, a Memorandum of Agreement between the Superior Court of California and Contra Costa County to formalize agreement on the additional funding identified by the Superior Court to finance the balance of the facility construction cost. FISCAL, IMPACT: The total estimated cost of the new Family Law Center is $11.5 million. The County has committed $7.5 million towards the total cost. The Superior Court has identified additional funds to finance the balance of the estimated project cost. BACKGROUND: On November 24, 1998 the Board of Supervisors AGREED with plans to construct a Family Law Center in the parking lot across the street from 1111 Ward Street and adjacent to the Bray Courthouse Annex. The Board also DIRECTED the County Administrator to proceed with the Center's financing and construction. By memorandum dated March 18, 1999 the County Administrator expressed a desire to study alternative building sites for the Family Law Center and future County Government Center. On April 6, 1999 the Board of Supervisors APPROVED and AUTHORIZED Michael Ross/Charles Drulis Architects and Planners to study these alternative sites. On May 14, 1999 Ross/Drulis presented preliminary findings to the Board of Supervisors for their CONSIDERATION. These findings indicated that the best sites for the Family Law Center were either the parking lot adjacent to 1111 Ward Street (site C) or the Assessor's block at 834 Court Street (site D). On June 15, 1999 the Board heard further discussion of these sites and reviewed the parameters of a proposed cost analysis. A critical component of this cost analysis was an assessment of potential environmental hazards within the buildings and in the ground of the proposed sites. This Environmental Due Diligence review involved sampling and analysis of building construction materials to determine lead and or asbestos hazards, and soil sampling to determine the existence of designated wastes. These reports estimated the total cost for environmental mitigation of site C at $36,000 and $300,000 for site D.
