RECOMMENDATION DETERMINE that there is a need to continue the emergency action taken by the Board on April 27, 1999 pursuant to Public Contract Code Sections 20134 and 22050, to expand the computer room. at 595 Center Avenue, Suite 210,Martinez for Health Services. II. FINANCIAL IMPACT Funding for this project has been budgeted. III. BACKGROUND A. The computer room expansion involves remodeling a portion of an existing building for Health Service's two primary patient health care computer systems: the Contra Costa Health Plan Management Information System ("CCHP MIS"), and the Primary Patient Care Delivery and Billing System. After remodeling is complete, Health Services will install, test, and make operational these two computer systems. B. The Health Services Department has determined that the current estimated remodeling completion date of October 1999 will not leave adequate time for the subsequent installation and Year 2000 ("Y2K")compliance testing of the two computer systems before the Year 2000 arrives. In addition, an October 1999 remodeling completion date will not meet the September 1999 deadline established by the State Department of Health Services (DHS) for a Y2K. compliant CCHP MIS system. D. The continuous operation of these two systems is vital to Health Services' ability to deliver health care and treatment services to their patients, and is therefore necessary for the life, health, welfare, and safety of the citizens who rely on Health Services for critical health care services, medical treatment, and emergency medical services. E. Consequently, on April 27, 1999 (Agenda Item C.72), the Board 1) found that an emergency exists, 2) delegated authority to the General Services Director to proceed in the most expeditious manner with the Computer Room Expansion, 595 Center Avenue, Suite 210, Martinez for health Services, 3) directed the General Services Director to make reports to enable the Board to review the emergency actions and to determine that there is a need to continue the action and 4) declared that the project, as an emergency, is exempt from the provisions of the California Environmental Quality Act. F. The condition that the Board found to be an emergency on April 27 continues to exist. Therefore, it is necessary to continue the emergency action previously taken by the Board so that the work can be completed in the shortest time possible. G. On April 27, 1999 the Board approved a consulting services agreement with Marcy Li Wong Architects for architectural and engineering services for the Computer Doom Expansion. On April 22, 1999 a First Amendment was issued to amend Appendix B, Paragraph A of the consulting services agreement to include Classifications and rates specified in Marcy Li Wong Architect's 1999 Hourly Billing Rates and Reimbursables Schedule. There was no increase in the payment limit. On July 8, 1999 a Second Amendment was issued for additional engineering design services due to increased project scope and construction administration services. The revised agreement payment limit is $97,900.00. H. Contracts for the emergency work have been negotiated. A contract was issued to the Contractor, RGM and Associates, Inc., on :tune 17, 1999, with an effective date of May 10, 1999 and a payment limit of$837,982.40. On June 25, 1999, a formal notice to proceed was issued to confirm the contract starting date of March 10, 1999 and a project completion date of September 15, 1999. 1. Change order No. 1 for $1,011.63 was issued August 26, 1999, to make window changes and revise the generator enclosure. The revised payment limit is $838,993.63. The completion time was increased by seven days. Additional change order items are pending. J. Pre-testing of new emergency generator and electrical systems occurred on October 5, 1999. Activation of new generator and deactivation of old generator occurred on October 10, 1999. Inspection by Consultants and County was done on October 14, 1999. "Punch List" corrections are underway. Construction is proceeding satisfactorily and was approximately 98% complete as of October 19, 1999. Substantial completion is expected by the end of October. AUMORIZE the Chair, Board of Supervisors to execute a Hold Harmless Agreement with the East Bay Regional Park District for the use of the Martinez Regional Shoreline Park on Thursday, November 18, 1999 for the Contra. Costa County Employee Wellness Program's 14th Annual "Cold Turkey Trot" Fun Run and Fun Walk. 2. APPROVE awarding of T-shirts and prizes to County employees participating in the 1999 Great American Smokeout activities. BACKGROUND: On Thursday, November 18, the American Cancer Society will celebrate the 23rd anniversary of the Great American Smokeout. The purpose of this nationwide annual event is to encourage smokers to give up smoking for 24 hours. The desired goal of the Smokeout is to convince smokers to quit smoking for life after participating in the Great American Smokeout. The successful County participation in the Great American. Smokeout will help work toward the American Cancer Society's goal of a smoke-free society. For the fourteenth year, the Employee Wellness Program is organizing;County-wide activities for the Great American Smokeout, Smokeout Coordinators representing the County departments will assist the Employee Wellness Program to promote the Great American Smokeout in order to achieve maximwn County involvement. BACKGROUND/REASQNS FOR-`M?ECt NA QNS This matter concerns a request by the Blackhawk Homeowners Association to allow the transfer of portions of common open space parcels for attachment to several existing private (residential lots) within the Blackhawk development . The Blackhawk development was originally approved by the County in the mid-1.970s under the Planned Unit (P®1) zoning district and approved Final Development Plan. Blackhawk is a guarded access, clustered residential development community. Virtually all of the lots adjoin either common open space area owned by the HOA, or a commercial golf course within the development . As a condition of approval for the project, the development was required to convey development rights over the common area to the County. This action was intended to protect the common open space area and assure that planning concerns in the development process were adequately addressed. The proposals are seeking lot line adjustments affecting 9 residential lots . The proposals involve a marginal increase in the lot sizes (none exceeding 10, 000 square feet in area. The owner of the common area, the Blackhawk Homeowners Association, is supportive of these proposed transfers of land and improvements. Last year, several affected residents and the Blackhawk HOA filed an application with the County to amend the Final Development Plan, County File ##DP983022 to allow for these project modifications . Staff has viewed the proposed changes and is satisfied that they will not result in substantial impacts to the community, and determined that for purposes of compliance with the California Environmental Quality Act, the proposal is Categorically Exempt (Class 5; minor alterations in land use limitations) . Last summer, the County distributed notices of the proposed changes to the owners of nearby properties that the County was considering rendering a decision on this matter, and providing ten days in which to request that the matter be heard. No requests for hearing were received from that notice. The request also pertains to proposed landscape and fencing improvements relative to proposed landscape easements for two parcels . Zoning &dmi n strator _Decision On October 21, 1999, after determining that the proposed changes do not constitute a substantial modification to the Final Development Plan, pursuant to Section 84-66 . 1604 (a) of the Ordinance Code, the Zoning Administrator conditionally approved the proposed amendment to the Final Development Plan. The approval will become final on Monday, November 1, 1999 unless an appeal is filed by that time. Board Authorization fQr Use of Dee!d-Reutricted AKea To address the existing encumbrance held by the County over the affected land, the approval was made subject to a requirement that the Board of Supervisors first approve the proposed transfer of land and related proposed improvements . Disclosure fQr Processing of Future SimilaK 2roposals The approval also informs the HOA that County staff wishes to change the manner in which future similar requests are to be processed. The approval requires that the HOA notify prospective applicants that the Community Development Department will discourage similar incremental requests to acquire and use the common open space for private lot area, and that instead any future proposals to the County should lead with a comprehensive analysis of planning and environmental considerations by the HOA and the County for the entire project . The Blackhawk HOA has accepted the terms of the Zoning Administrator approval as reflected in a letter dated April 26, 1999 . No appeal of the Zoning Administrator approval is anticipated, but should one be timely filed, then staff would inform the Board before the Board considers this matter. Consequence of Inaction or Denial- of PrQposal by- the Board In the event that the request were to be denied, then the proposed transfers of land would not satisfy a requirement of the amended Final Development Plan, and the County would not be authorized to approve any related lot line adjustment applications. To be valid, a protest must be in writing pursuant to Government Code Section 66020 and delivered to the Community Development Department within 90 days of the approval date of this permit. c.\wpdoo\3p983022.coa RD\ -3- may} i ACKNOWLEDGEMENT TO ACCOMPANY PROPOSALS TO THE COUNTY TO EXPAND PRIVATE LOTS INTO COMMON OPEN AREA WITHIN THE BLACKHAWK RESIDENTIAL PROJECT Community Development Department Contra Costa County This document is to be used where the Blackhawk Homeowners Association (HOA) and the owner of a private residential lot within Blackhawk are proposing to transfer a portion of a common open space parcel within Blackhawk to the residential lot. When such a lot line adjustment (LLA) is proposed to the County, it shall be accompanied by this statement after it has been filled out by both a duly authorized representative of the HOA and the affected residential lot owner. When parties initially inquire to the HOA on a proposed LLA, the Association will provide this document to them. If the HOA agrees to the LLA, then a representative of the HOA shall complete this form and provide it to the affected lot owner to fill out and submit to the Countywith the appropriate development permit application. Blackhawk Planning Back round A. In the mid-1970's, the County approved the Blackhawk residential project Final Development Plan under the Planned Unit(P-1)District. Prior to its approval, the County undertook an extensive analysis of various environmental impacts of the proposed project in an Environmental Impact Report which assessed such factors as geotechnical, biologic, land use, aesthetic, and archaeological impacts. B. As a result of that environmental review and review of the project, the approved Final Development Plan provided that a major portion of the Blackhawk project would be retained in open space parcels. To further assure appropriate protection of the project open space in an undeveloped condition, the County approval provided that the development rights for the open space parcels would be grant deeded to the County. C. Unless otherwise authorized, proposed improvements to, or transfer of land from, the open space parcels requires that the interested parties file with and obtain from the County: 1) an application to amend the Final Development Plan; and 2) Board of Supervisors authorization for the proposed changes within the deed restricted open space parcels. Where a transfer of land is involved, an application for a lot line adjustment must also be approved by the Community Development Department, and properly executed. Moreover, pursuant to the requirements of the California Environmental Quality Act, it is the County responsibility to fully assess potential environmental impacts of any such proposal including cumulative as well as project-level, indirect as well as direct. County Planning Agency Position on Lot Line Adjustment Proposals A. Ai2pr ach Preferred by the County - It is the County Planning Agency position that no new LLA's should be authorized until the HOA has processed an amendment to the Final Development Plan that provides for an overall plan that considers potential expansion of all private lots adjoining open space areas. Such a plan would consider soil stability conditions, grading restrictions, drainage, structure placement, privacy considerations, fence design, and appropriate protection of wildlife and mature trees. Before hearing such a proposal, the County would conduct appropriate environmental review and provide notice to all residents within Blackhawk, and other potentially interested parties. B. Processing of Individual LLA's in Absence of an Overall Approved Plan In the absence of an overall plan proposal from the HOA for accommodating LLA's throughout the project that has been approved by the County, the County Community Development Department will discourage but still accept individual LLA proposals. Due to the cumulative effect of such proposals, they will be treated as a substantial modification to the Final Development Plait which will require a noticed public hearing. The full cost of processing an application with the County must be borne by the applicant, even if the application is denied. Any proposal will initially require application to amend the Final Development Plan. The submittal shall include the following: 1) Completion and submittal of this acknowledgement form. 2) A written statement from the HOA on why it would not be reasonable for the County to require processing of an overall plan proposal before considering the current application. 3) Other standard application submittals(site plans, application forms, fees, notification materials, etc.)which the applicant can secure after consulting with the Community Development Department.
