Project No. 4660-6X4147-93, CDD-CP #99-68 DATE: October 26, 1999 PAGE: 2 11. FINANCIAL IMPACT: The estimated project cost is $10,000.00 funded by Contra Costa Transportation Authority (100%). Ill. REASONS FOR RECOMMENDATION/BACKGROUND: Bailey Basin is an artificial wetland created to mitigate the loss of wetlands associated with the construction of the Bailey Road/State Route 4 Interchange. The project is needed to repair a small leak in the culvert that conveys water from Bailey Basin under State Route 4. The wetlands are not functioning as designed because the basin can no longer retain water, due to the leak in the culvert. The project will consist of removing the rock slope protection on top of the existing culvert and excavating the area on both sides of the culvert in order to expose and repair the hole. The volume of excavation will be approximately 8 cubic yards. Wood forms will be constructed to hold the concrete when it is poured. Approximately 1 cubic yard of concrete (1'x2' doughnut shaped)will be poured around the portion of the culvert with the hole. Alter the concrete has set, the excavated area will be filled with native material, rock slope protection will be replaced, and disturbed areas seeded by hand broadcasting. All of the work will be conducted from above the culvert, so no wetlands or aquatic areas will be affected. The project is needed to repair a small leak in the culvert that conveys water from Bailey Basin under State Route 4. The project has been determined to be in compliance with the General Plan and is exempt from CEQA because it consists of the repair of an existing structure, involving no expansion of use beyond that existing. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of design and construction, and may delay completion of mitigation requirements. Recommended Action: APPROVE agreement to provide right of way services to Solano County for various projects and AUTHORIZE the Board Chair to sign the agreement on behalf of the County. 11. Financial Impact: Solano County will pay the actual costs for Real Property staff right of way services on a case by case basis. Ill. Background and Reasons for Recommendations: Solano County requires a variety of right of way services but has no right of way staff and desires to contract with the County for these services. IV. Consequences of Negative Action: Less efficient government because Solano County would have to find another agency certified by the State of California for right of way acquisition with federal funds and possibly hire additional private contractors at greater expense. Auditor-Controller(via R/P) By 9Deputy P.W.Accounting 61 AGREEMENT FOR SERVICES WHEREAS, Solano County is not qualified to procure right-of-way for federal aid projects, and WHEREAS, The Solano County Transportation Department requires additional right-of-way for some federal aid projects, and WHEREAS,Contra Costa County is qualified to procure right-of-way for federal aid projects, and WHEREAS, Contra Costa County will provide right-of-way services for the Solano County Transportation Department. NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: Real Property Division of the Contra Costa County Public Works Department on an "As Needed," project by project basis, upon a written request from the Director of the Solano County Transportation Department, or his designee, specifying the scope of the services required, and written confirmation from the Principal Real Property Agent for Contra Costa County, or his designee, of the County's willingness to perform said services, Contra Costa County will provide those agreed upon services required to obtain right of way, which include but not limited to preparing appraisals, submitting offers to property owners, negotiating right-of-way, assisting in condemnations, preparing right-of-way contracts, and property deeds. 2. Contra Costa County reserves the right to decline to provide services requested by Solano County on a project by project basis. 3. Solana County agrees to reimburse Contra Costa County for all labor costs as shown on Appendix "A." Solano County will make payments within 34 days of billing by Contra Costa County. Rates will change periodically due to contracted salary and overhead increases. Centra Costa shall notify Solano County thirty days before such rate increases. 4. Solano County will pay for all acquisition settlement and any other cost of acquisition such as title fees, recording fees, etc. 5. Solano County agrees to defend, indemnify and save harmless Contra Costa County, its officers, and employees against any and all loss, damage, liability, expense, claims or demands of whatever character, direct or consequential, directly or indirectly contributed or caused by Contra Costa County assuming and acting as the right of way agency for and on behalf of Solano County. b. The term of this agreement shall be for one year from the date of execution by the County Administrator. Solano County may renew this agreement on an annual basis. 7. Nothing herein shall be construed to imply that a Contra Costa County employee providing services is a Solano County employee. 8. Either party may terminate this agreement upon a 30 day written notice. 9. For services rendered pursuant to this Agreement, the County shall pay a sum not to exceed Twenty-Five thousand dollars ($25,000). All of the projects will be funded through Transportation Enhancement Activities Grant Funds, Road Funds, and/or Redevelopment Agency Funds, III. Reasons for Recommendations and Background: Applying for and obtaining grants allows the County to construct more improvements than would be possible without obtaining grants. The following is a brief description of each of the projects listed above: The Interstate 680 Landscaping Enhancement at Circle Drive project consists of purchasing a twenty foot wide strip of land adjacent to 1-680, installing an irrigation system, and planting trees near Circle Drive, The FY 2000/2001 Countywide Sidewalk Gap Closure project consists of installing curb and sidewalk and widening the street where necessary at five locations in the County. The Iron Horse Trail Overcrossing project will install an overcrossing at Treat Boulevard for the Iron Horse Trail. IV. Conseguences of Negative Action: Failure to approve the submittal of these applications will eliminate a potential funding source and possibly delay the construction of the projects.
