SUBJECT: APPROVE AND AUTHORIZE EMERGENCY REPLACEMENT OF DEFECTIVE
SPRINKLER NEARS FOR THE CONTRA COSTA REGIONAL MEDICAL CENTER

I. FIND and DECLARE based on the evidence set forth below and pursuant to Public Contract
Code sections 22035 and 2205€3, that an emergency exists and that the emergency will not permit
a delay resulting from a competitive solicitation for bids, and DELEGATE to the County
Administrator or designee the authority to proceed in the most expedition manner to complete the
project.
2. APPROVE and AUTHORIZE the County Administrator or his designee to enter into construction
and consulting services agreements for project execution without the need for competitive
solicitations for bids or additional Board Approval.
FINANCIAL LIMPACT.,
The total estimated project coast is between $75,0€30 and $1013,000 inclusive of construction,
management, permit, and inpection fees.
The scope of this project includes the replacement of approximately 1,750 defective Omega band
fire sprinkler Deeds. On July 27, 1999 the Board of Supervisors authorized the County Administrator
to submit a claim to Central Sprinkler Company for reimbursement of the defective heads and begin
design of a replacement program. The County is entitled to a $5 reimbursement per sprinkler lead
under a court-sanctioned settlement with the U.S. Consumer Product Safety Commission. To be
reimbursed for management and installation costs, the County must finance and complete the
replacement work. Cance the replacement work is complete, the County may file a reimbursement
claire through a trust fund established by the sprinkler head manufacturer.

Rolf Jensen Associates, e fire protection consultant to the County, recently completed specifications
for the replacement program. These specifications outline an after hours work plan to avoid
interruption to hospital operations and establish minimum qualifications of the sprinkler contractor.
CONSEQUENCES OF NEGATIVE ACTION
Time is of the essence for replacement of the defective fire sprinkler heads. The 1,750 heads are
located throughout hospital operating and recovery rooms, patient. rooms, and public waiting areas.
The replacement cost may exceed established thresholds for informal biddingprocedures. A
preliminary market survey indicates that qualified contractors are too busy with existing or scheduled
work to prepare formal bids for the replacement project.
