SUBJECT. REPORT ON EXECUTION OF CONSULTANT CONTRACT AMENDMENTS TO CONTINUE
WORK ON SAN FRANCISCO TO STOCKTON (SUISUN SAY CHANNEL AND NEW YORK
SLOUGH CHANNEL) MAINTENANCE ASSESSMENT DISTRICT 1999-1
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. AUTHORIZE the Community Development Director, on behalf of the County Water
Agency, to execute a contract amendment adding $25,000 to Mike Cheney's (Maritime
Engineer) contract with the County Water Agency for a total of$75,000 for 1999.
2. AUTHORIZE the Community Development Director, on behalf of the County Water
Agency, to execute a contract amendment adding $20,000 to attorney Larry Mallon's
contract with the County Water Agency for a total of$55,000 for 1999.
FISCAL IMPACT
Funds from the County Water Agency have been set aside for work on this project, and
are available to complete work. Once the assessment district is confirmed (scheduled for
November 16, 1999) and assessments are paid, the County Agency will be reimbursed for
consultant costs on this project.

BACKGROUNDIREASONS.FOR RECOMMENDATIONS
Contract amendments are necessary for the two contractors to complete work on the Joint
Assessment District with the Port of Stockton, allowing recovery of local costs associated
with maintenance dredging and disposal for the Suisun and New Fork Slough channel
reaches. The Assessment District process is nearing completion. A Preliminary
Engineer's Report was completed, and a series of public meetings were conducted, to
provide industries (industry beneficiaries which will be assessed), the opportunity to learn
about the costs of upland disposal, the factors used to apportion costs according to benefit
and subsequently hove the assessments were derived. The Assessment process, in part
through the Public greetings, allows the assessees the opportunity to inform the assessor
if there are factual inaccuracies. Industry provided to the County detail as to parcels not
included in marine operations as well as vessel use data. The data has been evaluated,
determined to be valid and the Engineer's Report will become more factually correct with
it's inclusion. This in turn requires the Engineer of Record to do additional work on the
benefit apportionment, and the assessments will be modified, necessitating a revised
notice to be seat to those included in the Assessment District. A final draft Engineer's
Report is currently being completed.
Both Mr, Cheney and Cllr. Mallon have been involved in the Assessment District originally
proposed by the fort of Stockton and have been the primary architects of its current
version.
Mr. Cheney has been under contract with the County for some years, to provide
engineering expertise for the County's ship channel navigation projects. The increase to
his contract should see the JPA/Assessment process through to its conclusion, and allow
for some minor work on related ship channel navigation projects.
Mr. Mallon has been under contract to the County since 1998, to allow the County Water
Agency to utilize his services on contract negotiation and related activities for the ship
channel projects. The contract increase will allow for completion of his work on the
JPA/Assessment project, and, if necessary, to remain involved in contract negotiation on
the other ship channel improvement projects, should this become necessary in 1999.
