On April 6, 1933, the Board of Supervisors authorized aging and Adult Services Bureau, Director or his
desire(A. .A.: Office on Aging)to let Request For Proposals(Pl✓P) for Respite .eg tryAn- o€
Service Registry(RFP 4015), Home Visiting(RFP 4411.4), Alzheimer's Day Care Resource Center
Program(RFP#012) and Brown Bag Network Program(RFP#013). In response to the RFP°s,the Aging
and Adult Services Bureau(A. A..: Office on Aging)received one proposal]for each of the above except
for Respite Registry-iln-Home Service Registry, which received two proposals.
An evaluation team consisting of members of the Advisory Council on Aging, general public, staff from
other County departments and technical experts reviewed all the proposals. The evaluation teams were
designed to represent Contra Costa County geographically,ethnically, and according to gender. Std
aggregated the scores and presented them to the Planning Committee of the-Advisory Council our Aging.
The Planning Committee reviewed the scores and made a funding recommendation to the Executive
Oomrrfittee of the Advisory Council.
On flay 19, 1999,the Advisory Council on Aging approved the recommendation of its Planning
Committee and is recommending to the Board of Supervisors that the contractors be awarded the
contracts with the provisions set forth in this Board Order.
On June 15, 1999 the Board of Supervisors approved the Director,Aging and Adult Services.Bureau
(. . ,A,: Office on Aging), or his designee,to negotiate and execute the Brown Bag Netvmrk Program
under the Older Californian's Act (OCA) with,a Paymwnt Limit of 18,615. On Jure 22, 1999 the Board
of Supervisors approved the Director, Aging and Adult Services Bureau(A.K.A.: Office on Aging), or
his designee,to-negotiate and execute the Senior Companion Program under the Older C ifon 's Act
(OCA)'%ith a Pay ent Liniit of 9,767. OnJuly 26, 1999 the Area Agency on Aging received
notification of budget augmentation for both of these programs from the California Department of aging,
therefore, Aging and,adult Services Bureau(A. .A.: Office our Aging) is requesting the Board of
Supervisors to rescind and replace the previous Board Orders to include the additional$8,899 for the
Senior Companion Program and the additional$4,662 for the Contra Costa Food Bank.

RECOMMENDATION(S).
1 . APPROVE and AUTHORIZE the County Administrator or his designee to execute
the Seventh Amendment to the Consulting Services Agreement with Stephen E.
Harriman, AIA &Associates ("Architect"), in the amount of$61,400.00, pursuant to
Resolution No. 99/429, for the above project.
2. APPROVE and AUTHORIZE E the County Administrator or his designee to execute
the Eleventh Amendment to the Consulting Services Agreement with O'Brien
l reitzberg, Inc. ("Construction Manager"), in the amount of $74,000.90, pursuant
to Resolution No. 99/429, for the above project.
3. AUTHORIZE the County Administrator or his designee to issue written
authorizations for extra work under the above-described agreements, provided that
the cumulative total extra cost for all such authorizations shall not exceed
$25,000.00 for each agreement.
FINANCIAL IMPACT
These amendments increase the Architect's payment limit by $51,400.00 and the
Construction Manager's payment limit by $74,000.00. Adequate funds to cover the
amendments have been established in the General Funds Plant Acquisition Account
(Budget Unit 4413-4399). To the extent that the contract funds are not sufficient to cover
all expenses, the County presumably will be able to recover the additional amount from
the original contractor (Patrick M. Donaghue) or his surety (Insurance-L ompany of the
West).

On August 19, 1999, the Board adopted Resolution leo. 99/429, which terminated and
cancelled the rights of Patrick M. Donaghue under the construction contract for the
Renovation of Juvenile Hall, Tarnalpais Wing, Martinez, and authorized the County
Administrator or his designee to enter into one or more contracts to'complete the project
in the most expeditious manner. In order to provide necessary design and construction
management support for the completion of the project and to further implement the
above resolution, it is recommended that the Board approve these amendments and
authorize execution by the County Administrator or his designee.

AUTHORIZE the Community Development Director or his designee to sign a data
sharing agreement with the Contra.Costa Water District that would allow Community
Development to use and update a Geographic Information System computer file related
to mapping of General Plan land use designations.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECC7MMENDATIOL4S
The attached Data Use Agreement ("Agreement") describes the teras and conditions
for sharing a particular computer file, a reap of the County's Genual Flan land use
designations in the eastern half of the County, that was developed by Contra Costa
Water District ("CCWD"'). The Community Development Department ("CDD") has
recently obtained mapping or Geographic Information System ("GIS") software, but
lacks computerized base maps. The CCWD map would be veryuseful to CDD,
allowing the Department to verify and update an existing computer file rather than
devoting considerable'time and expense to completely redrawing the General Plan mala
on computer (the Department intends to obtain a template for the western half of the
General Plan reap from E13MUD under a pre-existing data sharing agreement). CCWD
is willing to provide the data, but in return asks that, if CIT updates the map in the
next 15 years, that the Department provide updates to therm,
The Agreement describes this arrangement and adds a few ether ',conditions. For

data more often than once a year and also limits CCWD to internal use of the updated
data (unless a request for the information is received under the Public Records Act).
The agreement also includes a disclaimer which applies to the use of CCWD data by
CDD and the use of CDD updates by CCWD. The intent of the disclaimer is to
establish that neither party guarantees the quality of the data shared with the other
party, and that neither party can be held accountable by the other for any errors.
County Counsel has reviewed and approved the Agreement from a legal perspective.

• The above Agency requests the following basemap graphic data files and agrees to
the terms and conditions set forth in this Agreement, including Attachment:

• The Disclaimer of Liabilities and Warranties detailed in Attachment I apply to this
agreement for use of the transmitted data, and also will apply to any updated data

• The above Agency shall notify CCWD of any updates or improvements of the data
performed by the Community Development Department, and shall make such
updated or improved data, if any, available to CCWD free of charge upon request at
intervals no more frequent than 1 year for a period not less than 15 years. CCWD
will limit use of the updated and/or improved digital General Flan Map to its own
uses (i.e. CCWD will not distribute file to any 3rd party other than a consultant
retained for one or more CCWD projects). CCWD shall refer any requests to the
CCC Community Development Department except that if a request under the Public
Records Act, a court order or other similar type of compulsory request is made,
CCWD will make the Map available and will at the same time notify the CCC
Community Development Department of its action..
• The effective date of this Agreement shall be August 24, 1999.
• This Agreement is for a 15 year period ending August 19, 2014 and shall continue
thereafter unless terminated by either party upon 30 day written notice to the other
ply.

DISCLAIMER OF LIABILITY AND WARRANTIES
The parties to the attached agreement ("Parties"), the Contra Costa 'Nater District
("CCWD") and the Contra Costa County Community Development Department ("CDD")
recognize that electronic files can be readily corrupted or altered by storage conditions,
viruses, or users beyond the control of either CCWD or CDD and that the usefulness,
accuracy, and integrity of electronic files are dependent upon the software]used to access
or utilize the data contained in the files). In addition, the Parties understand and agree
that is quite possible that errors and omissions will occur in data input and/or
programming done by CCWD or CDD to provide that data in the form desired, and the
Parties further understand and agree that it is highly probable that errorsand omissions
will occur in any record keeping process, especially when large numbers of records are
developed and maintained and that the data may not meet company standards as to
accuracy or completeness; notwithstanding, the Parties agree to take the data`bas is", fully
expecting that there may well be errors and omissions in the data obtained from CCWD
and CDD.
The Parties further understand and agree that CCWD and CDD make absolutely no
warranty whatsoever, whether expressed or implied, as to the accuracy, thoroughness,
value, quality, validity, merchantability, suitability, condition or fitness for a particular
purpose of the data or any programming used to obtain the data, nor as to whether the
data is error-free, up-to-date, complete or based upon accurate or meaningful facts.
The Parties further understand and agree that each forever waives any and all rights,
claims, causes of action or other recourse that it might otherwise have against the other
Party for any injury or damage of any type, whether direct, indirect, incidental,
consequential or otherwise, resulting from any error or omission in data or in any
programming used to obtain the data or in any manner arising out of or related to this
agreement or the data provided hereunder. The Parties agree that neither Party shall be
liable to the other Party for any liability, claire, loss, damage, injury or expense of any
kind caused or alleged to be caused, directly or indirectly, by the inadequacy of any CAIS
or GIS data or any other deficiency of the systems, by any delay or failure to provide any
service or by any other interruption, disruption or loss of operations. The Parties agree
that they will, irrespective of any alleged liability, claim, loss, injury, damage or expense,
continue to pay all charges in the amounts stated herein until this agreement is properly
terminated in accordance with its terms.
The Parties further agree that the above-described electronic file was neither requested
nor produced under the Public Records Act, and that nothing in this Agreement shall be
construed to give any rights or benefits to anyone other than the Parties.

described in Proposal Request No. 12.1, dated June 18, 1999, for the parking lot expansion:
a. site demolition
b. survey
c. excavation, grading
d. storm sewer
e. concrete curbs and planters
f. concrete retaining walls
g. parking area pad, and Class II aggregate base compacted ready for fixture asphaltic concrete.

Item 8-2: Delete original aluminum gall canopy. This canopy is no longer required due to the covered walk
added by Change Order No. 7.
