FISCAL IMPACT: Funding for this Contract is included in the Health Services Department' s budget, and the source of funding is County/Realignment 100% . CHILDREN'S IMPACT STATEMENT: The Contract between Contra Costa County Children' s Mental :Health and True to Life Children' Services supports three of the Board of Supervisors community outcomes : 1) Children ready for and succeeding in school, (2) Families that are safe, stable and nurturing, and (3) Communities that are safe and provide a high quality of life for children and families . The expected program outcomes which include all goals identified by Children' s Statewide System of Care guidelines are as follows : A) To increase and maintain school attendance as measured by school records; B) To increase positive social and emotional development as measured by the Child and Adolescent Functional Assessment Scale (CAFAS) ; C) To increase family satisfaction - as measured by the Parent Satisfaction Survey; D) To decrease use of acute care 'systems; and E) To impact placement at discharge to a lower level of care. BACKGROUND/REASON(S) FOR RECOMMENDATION(S) : On May 12, 1998, the Beard of Supervisors approved Contract #24-941 (as amended by Contract Amendment Agreement #24-941-1) with True to Life Children' s Services, for the period from March 9, 1998 through June 30, 1998 (which included a 'sx-month automatic contract extension through December 31, 1998) , to provide intensive day treatment and mental health ' services to Seriously Emotionally Disturbed (SED) children. Expected outcomes include delivery of drug-free babies, decreased use of alcohol, tobacco and other drugs, reduction in the number of relapses, and creation of a sober social network. BACKGROUND&EASON(S) FOR RECONMENDATION(S): On September 23, 1997, the Board of Supervisors approved Novation Contract #24-618-7 with East Bay Perinatal Council for the period from July 1, 1997 through June 30, 1998 (which included provisions for a six-month automatic extension through December 31, 1998) for the provision of perinatal case management services for pregnant and postpartum substance abusing women and their children. Worms""" artwork for use in local composting education efforts. FISCAL..[ItIPACT None. BArKGtOUND/REASONS F R RECOMMENDATIONS This Licensing Agreement with Ecology Action of Santa Cruz, a non-profit corporation, grants the County, as licensee, the right to use the name and artwork known as "Wiggle E. Wormsm" for printed literature pieces and as colored stickers for composting education purposes. A copy of the Licensing Agreement is attached which includes an example of the "Wiggle E. Worm8m" artwork. This character and name have become well known around the Bay Area as an informal composting mascot. The artwork was originally developed for use in the Santa Cruz area however over the past five years has been used more and more by jurisdictions throughout the Bay Area. ("Licensee"), Licensor is the sole and exclusive owner of all rights in and to the name, likeness and all renditions of the artwork known as Wiggle E. Worm, a.k.a. Wormy (the"Property"), an example of which appears below. Licensor grants to Licensee a non-exclusive, revocable, non-transferable License,without the right to grant sublicenses, to use the Property solely for printed literature pleceslor educational purposes, including but not limited to municipal composting programs. The Property may not be used by Licensee for product promotion nor may the Property be printed on items for sale. Licensee shall acknowledge all uses of the name Wiggle E. Worm and Wormy as servicemarks with the superscript "SM", and shall acknowledge all uses of the likeness of Wiggle E. Worm as a copyright of Ecology Action by a notice on all printed materials of the form "01993 Ecology Action"and "Wiggle E. Wormsm and "Wormysm are servicemarks of Ecology Action." The term of this License is ten years, and renewal will be considered provided Licensee is not in violation of any provision herein. This license may be immediately terminated by Licensor due to Licensee's failure to comply with any provision herein. Licensee may be required to provide for Licenser's review copies of all uses or intended uses of the Property. In the event Licensor must employ attorneys to enforce its rights under this Agreement, Licensor will be entitled to recover its attorneys' fees whether or not a lawsuit is file&I'd This is the entire agreement between the parties, and can only be modified by a written document signed by the parties hereto.
