1. Appoint the following individual to a regular member position on the Bay Point Municipal Advisory
Council, for a term to expire in November, 2002.

Advisory Council, for a term to expire in November, 2002.

BACKGROUND INFORMATION:
Members of the Bay Point Municipal Advisory Council are elected by members of the public.
However, in the event that a vacancy occurs prior to the end of a member's term, the Board of
Supervisors becomes the appointing authority.
Mr. Shrivastava is being appointed to fill a vacancy created by Lilya Valladolid (who was
elected during the November 1998 election period and whose term would have commenced in
December 1998). Ms. Valladolid is now ineligible to serve on the Bay Point Municipal Advisory
Council as she has moved out of the Bay Point area.
Several vacancies have occurred in the past on the Bay Point MAC between election periods,
necessitating recruitment, interviewing and appointment by the Board of Supervisors. As a result, the
District V Supervisor has determined that an alternate should be appointed at this time. This
alternate would attend all regular meetings. In the event that a future vacancy should occur, this
alternate would automatically beppointed to fill that seat. f n

Title: A RESOLUTION affirming the recommendation of the Municipal Advisory Council
to seat Ivan Williams as Councilman and condemning Supervisor Canciarnifla's recent
rejection of that recommendation.
WHEREAS,the Municipal Advisory Council is composed of members seated through the
process of a general election by the residents of Bay Point;
WHEREAS, in those instances in which there arises a vacancy on the Council,
appointment to fill that vacancy is made by the Board of Supervisors upon the nomination
of the Supervisor for District 5,
WHEREAS,there is a long-standing tradition that the Supervisor respect the
recommendation of the Council in the nomination of candidates to fill those vacancies as
they arise from time to time whether on the Council or on other committees and bodies
throughout the County that require such nominations;
WHEREAS,at its regular meeting on January 5 of this year, the Council considered four
applicants for the purpose of recommending an individual to fill a vacancy on the Council;
WHEREAS,the Council on a vote of 4-2-0 recommended that Ivan Williams be nominated
to fill that vacancy;
WHEREAS,there,have,been no indications of irregularity or impropriety in the deliberative
process by which that vote could reasonably be inferred to have been the result of actions
violative of Federal,State,or Local law;
WHEREAS,there have been no indications that any of the four candidates were in any way
unsuitable for service on the Council;
WHEREAS,the vote having been taken,the Council's recommendation was forwarded to
the Supervisor in a proper and customary manner;
WHEREAS,the Supervisor rejected that recommendation;
WHEREAS,the Supervisor has announced without adequate explanation his intention to
nominate Vinay Shdvastava to sit as Councilman;
WHEREAS,the Supervisor has announced without adequate explanation his intention to
nominate Glen Williams to serve as an alternate to Vinay Shrivastava;
WHEREAS,the Supervisor's action is highly irregular and without precedent during the
existence of the Bay Point Municipal Advisory Council,
NOW,THEREFORE,BE IT RESOLVED by the Bay Point Municipal Advisory Council
seated in special session,January 18, 1999 as follows:
1. the Municipal Advisory Council reaffirms its recommendation that Ivan
Williams be seated as Councilman;
2. the Municipal Advisory Council condemns the capricious and arbitrary
action taken by the Supervisor as unjust and without merit. ........................................................ ........

BACKGROUND INFORMATION:
On June 23, 1998, after six months of study, the Oakley/Knightsen Fire Review Committee submitted a report
to the Board regarding the provision of fire services to the Oakley and Knightsen communities. On August 4,
1998 the Board of Supervisors formally accepted the report, adopting the recommendations contained therein.
Included in those recommendations was the re-establishment of the Oakley Fire Advisory Commission. The
District V Supervisor was authorized to commence recruiting efforts to fill the Commission positions. The
District V office advertised and established a recruiting timeframe. The Supervisor subsequently interviewed
applicants, resulting in the above recommended appointments.

Staff has received the attached letter from the Chair of the Advisory Fire
Commission noting that the recent boundary change for the Contra Costa County
Fire Protection District means that Seth Cockrell no longer lives in the District It is,
therefore, appropriate to declare his seat vacant and proceed to take the necessary
steps to replace Mr. Cockrell with someone who lives in the District.
