ADOPT Resolution to(1)extend for five years the period during which the Redevelopment Agency may
retain certain real property located in the Bay Point Redevelopment Project Area; and (2) reaffirm the
intention of the Board of Supervisors that the property be used for the development of affordable housing
for low- and moderate-income families.

In December 1993, the Redevelopment Agency acquired residential property in the Bay Point
Redevelopment Project Area. The property was acquired by the Agency as part of a Settlement
Agreement between the Agency, Westamerica Bank and D & M Development, Co. The Agency and
Westamerica Bank had been construction lenders for a ten-unit, affordable condominium development
proposed by D & M Development, Co. The Developer defaulted on the construction loan. Because
Agency funds had been disbursed for property acquisition., the property was conveyed to the
Redevelopment Agency.

California Redevelopment Law(Health and Safety Code Section 33334.16) requires that for property
acquired using moneys from the Low and Moderate Income Housing Fund, the Agency must initiate
activities related to development within five years from the date it first acquires the property. If the
activities have not been initiated,the legislative body may extend the period during which the Agency
may retain the property for one additional period not to exceed five years. The resolution of
extension shall affirm the intention of the Board of Supervisors that the property be used for the
development of low-to moderate-income housing. Since the property is within the boundaries of the
Bay Point/Pittsburg BART Station Specific Plan, the Agency has postponed doing substantive work
until the Specific Plan is adopted. Adoption of the Specific Plan is expected to occur in 1999.
Development of said property would occur within the next five years. Staff' is therefore
recommending that the Board of Supervisors adopt the resolution to extend by five years the period
that the Agency may retain the property for the development of housing affordable to low- and
moderate-income households,

A RESOLUTION OF THE BOARD OF SUPERVISORS OF CONTRA COSTA
COUNTY PURSUANT TO HEALTH AND SAFETY CODE SECTION 33334.16
APPROVING AN EXTENSION OF TIME TO DEVELOP PROPERTY WITHIN THE
BAY POINT REDEVELOPMENT PROJECT AREA FOR LOW AND MODERATE
INCOME HOUSING
WHEREAS,the Board of Supervisors(the "Board") of the County of Contra Costa(the
"County")has adopted the West Pittsburg/Bay Point Redevelopment Plan by Ordinance No. 87-
102 on December 29, 1987, (the "Redevelopment Plan"). The Redevelopment Plan sets forth a
plan for redevelopment of the Bay Point Redevelopment Project Area(the "Project Area"); and
WHEREAS,the Redevelopment.Agency of the County of Contra Costa(the"Agency")
is responsible for administering the Redevelopment Plan to cause redevelopment of the Project
Area, including assembly, site preparation and redisposition of property within the Project Area
for private redevelopment consistent with the Redevelopment Plan; and
WHEREAS, the Agency is the owner of certain real property located in the Project Area
on Bailey Road,more particularly described in the attached Exhibit A(the"Property"); and
WHEREAS,pursuant to Health and *Safety Code Section 33334.2, the Agency set aside a
portion of the tax increment revenue that it received, in the Agency's Low and Moderate-Income
Housing Fund (the"Housing Fund") for the purpose of increasing, improving, and preserving the
County's supply of low and moderate income housing; and
WHEREAS, the Agency initially conveyed the Property to a developer to construct low
and moderate income housing on the Property, and also provided a construction loan to the
developer out of the Housing Fund; and
WHEREAS, the Property was deeded back to the Agency when the developer failed to
perform its obligations; and
WHEREAS, for the past five years the Agency has been unable to develop the Property
due to the fact that the Property is a small parcel with limited access and assemblage with other
parcels has been difficult because of the existence of an aqueduct that intersects the area, and
further, since the Property is within the boundaries of the Bay Point/Pittsbug BART Station
Specific Plan, the Agency has been unable to do any substantive development work until that
plan has been completed and adopted; and
WHEREAS,pursuant to Health and Safety Code Section 33334.16 the Board may by
resolution extend the period for which the Agency may retain the Property by another five years;

WHEREAS,the Agency has requested that the Board pass such a resolution since five
years have passed since the Agency acquired the Property; and
WHEREAS, the Agency intends within the extended five year period to develop on the
Property affordable housing for low and moderate income families.
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
Section 1. Pursuant to Health and Safety Code Section 33334.16, the period during
which the Agency may retain the Property is extended for five years from the passage and
approval of this Resolution.
Section 2. The Board hereby affirms that the Property shall be used for the
development of affordable housing for low and moderate income families and persons.
Section 3. This Resolution shall take immediate effect from and after its passage and
approval.
