HomeMy WebLinkAboutMINUTES - 01051999 - C119 THE BOARD OF SUPE'RVI'SORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 5 , 1999 , by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, GERBER, DeSAULNIER and CANCIAMILLA NOES: NONE ABSENT: NONE ABSTAIN:NONE SUBJECT: State Identification Systems (SIS) Program Grant RESOLUTION OF THE GOVERNING BOARD 99/ 4 WHEREAS the Board of Supervisors, Contra Costa County, desires to receive funds made available through a certain project designated ,NATE IDENTIFICATION SYSTEMS (SIS) PROGRAM GRANT, to be funded from funds made available through the Bureau of Justice Assistance (hereinafter referred to as BJA) and administered by the Office of Criminal Justice Planning (hereinafter referred to as OCJP). The SIS Program grant is authorized by Public Law 104-132, the Antiterrorism and Effective Death Penalty Act, Section 891. NOW, THEREFORE, BE IT RESOLVES?that the Sheriff-Coroner of the County of Contra Costa is authorized, on its behalf, to submit the proposal to OCJP and is authorized to execute on behalf of the Board of Supervisors the Grant Award Agreements, including any extensions or amendments thereof. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions or damages, shall be the responsibility of the grant recipient and the authorized agency. The State of California, OCJP and BJA disclaim responsibility for any such liability. Box 391 Martinez,California 94553 Dear Sheriff Rupf: The Governor's Office of Criminal Justice Planning (OCJP) has applied for and received the State Identification Systems Program (SIS) Grant administered by the Bureau of Justice Assistance(BJA). The SIS Program will enhance the capability of State and local governments to identify and prosecute offenders by establishing or upgrading information systems and DNA analysis. As submitted and approved the initial SIS grant will provide$172,729 to two California counties. An additional SIS grant has been received and will augment the original grant by an additional$194,711. In an effort to best serve the grant recipients the original SIS grant RFA was combined with the augmented grant funds to be the lease disruptive to the receiving crime laboratories. Contra Costa and San Bernardino will receive, upon completion and finalized approval of the RFA by OCJP, $183,716 and $183,724 in SIS grant money respectfully. The OCJP will within the next few weeks be sending both Contra Costa and San Bernardino Counties the formulated SIS grant RFA packages for their review and submission. Even though your agency will be receiving the SIS grant RFA package, fund availability and process are governed by Section 1400 of the OCJP Grantee Handbook. Section 1400 reads as follows: 1400 FUND AVAILABILITY If, during the term of the grant award, the state andlor federal funds appropriated for the purposes of the grant award are reduced or eliminated by the California Legislature or by the United States Government or in the event revenues are not collected at the level appropriated, 0CJP may immediately terminate or reduce the grant award upon written notice to the project. However, no such termination or reduction shall apply to allowable costs already incurred by the project to the extent that state or federal funds are available for payment of such costs. The grant award entered into with IJCJP is subject to any applicable restrictions, limitations, or conditions enacted by the California Legislature andlor the United States Government subsequent to execution of the grant award. Projects that spend grant funds before the grant application is approved and placed into grant award agreement do so at the risk of an UCJP determination thiSuppr;ession ZBranch ed.
