San Raman Creek Improvement Project January 5, 1999 Page Two 111. Reasons for Recommendations and Background: Russell Hagerstrand owns and occupies real property affected by the recent construction of the Flood Control District's San Ramon Creek Improvement Project In order to reduce the load on the creek's bank during construction, the District's engineers required that Mr. Hagerstrand's swimming pool be partially drained for approximately eight months. The standing water during this period damaged the fiberglass lining of the pool. The above- referenced payment will compensate Mr. Hagerstrand for the cost to clean and repair damage to his pool and other improvements which occurred during construction. As consideration for this payment, Iver. Hagerstrand agrees to waive all further claims ;in connection with this project. IV.
